1618 Relating to crimes and offenses; to amend Section
1719 13A-7-4.3, Code of Alabama 1975; to further provide for the
1820 crime of unauthorized entry of a critical infrastructure
1921 facility.
2022 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2123 Section 1. Section 13A-7-4.3, Code of Alabama 1975, is
2224 amended to read as follows:
2325 "ยง13A-7-4.3
2426 (a) For the purposes of this section, the following
2527 words have the following meanings:
2628 (1) CRITICAL INFRASTRUCTURE. A system or asset, whether
2729 physical or virtual, so vital to the United States that the
2830 incapacity or destruction of the system or asset would have a
2931 debilitating impact on security, national economic security,
3032 national public health, or national public safety.
3133 (1)(2) CRITICAL INFRASTRUCTURE FACILITY. The term
3234 includes, but is not limited to, any of the following,
3335 including any critical infrastructure located on or in any of
3436 the following types of facilities:
3537 a. a A chemical, polymer, or rubber manufacturing
36-facility,.
37-b.a A pipeline,.
38-c.a A refinery,.
39-d.an An electrical power generating facility .
40-e.and the The area surrounding the an electrical power
41-generating facility,.

9092 regular station, or a natural gas and or hydrocarbon storage
9193 or production facility ,.
9294 p.A mining operations,operation.
9395 q.beneficiation Beneficiation infrastructure and or
94-mining infrastructure ,.
95-r.and a A transportation facility , such as a port,
96-airport, railroad operating facility, or trucking terminal.
97-s. Wireline or wireless telecommunications
98-communications infrastructure.
99-t. A gas processing plant, including a plant used in

129131 t. A gas processing plant, including a plant used in
130132 the processing, treatment, or fractionation of natural gas or
131133 natural gas liquids.
132134 u. A steelmaking facility that uses an electric arc
133135 furnace.
134136 v. A dam that is regulated by the state or federal
135137 government.
136138 w. A crude oil or refined products storage or
137139 distribution facility, including, but not limited to, a valve
138140 site, a pipeline interconnection, a pump station, a metering
139141 station, below ground piping, above ground piping, or a truck
140142 loading or offloading facility.
141143 (2)(3) FRAUDULENT DOCUMENTS FOR IDENTIFICATION
142144 PURPOSES. A document whichthat is presented as being a bona
143145 fide document that provides personal identification
144146 information but which, in fact, is false, forged, altered, or
145147 counterfeit.
146148 (3)(4) PERSON. An individual, trust, estate,
147149 corporation, partnership, limited partnership, limited
148150 liability partnership, limited liability company, or
149151 unincorporated nonprofit association having a separate legal
150152 existence under state law.
151153 (4)(5) UNMANNED AIRCRAFT SYSTEM. A powered, aerial
152-vehicle that does not carry a human operator, uses aerodynamic
153-forces to provide vehicle lift, may fly autonomously through
154-an onboard computer or be piloted remotely, and may be
155-expendable or recoverable. The term does not include a
156-satellite orbiting the Earth or a spacecraft beyond Earth's
157-atmosphere and may not be construed to implicate the provider

183+(4)(5) UNMANNED AIRCRAFT SYSTEM. A powered, aerial
184+vehicle that does not carry a human operator, uses aerodynamic
185+forces to provide vehicle lift, may fly autonomously through
186+an onboard computer or be piloted remotely, and may be
187+expendable or recoverable. The term does not include a
188+satellite orbiting the Earth or a spacecraft beyond Earth's
187189 atmosphere and may not be construed to implicate the provider
188190 of a telecommunications link between an owner or operator of
189191 an unmanned aircraft system and the unmanned aircraft system.
190192 (b) A person commits the crime of unauthorized entry of
191193 a critical infrastructure facility if the person does any of
192194 the following:
193195 (1) Intentionally enters without authority into any
194196 structure or onto any premises belonging to another that
195197 constitutes in whole or in part a critical infrastructure
196198 facility that is completely enclosed by any type of physical
197199 barrier or clearly marked with a sign or signs that are posted
198200 in a conspicuous manner and indicate that unauthorized entry
199201 is forbidden.
200202 (2) Uses or attempts to use a fraudulent document for
201203 identification for the purpose of entering a critical
202204 infrastructure facility.
203205 (3) Remains upon or on the premises of a critical
204206 infrastructure facility after having been forbidden to do so,
205207 either orally or in writing, by any owner, lessee, or
206208 custodian of the property or by any other authorized person.
207209 (4) Intentionally enters into a restricted area of a
208210 critical infrastructure facility which is marked as a
209211 restricted or limited access area that is completely enclosed
210-by any type of physical barrier when the person is not
211-authorized to enter the restricted or limited access area.
212-(c) A person who commits the crime of unauthorized
213-entry of a critical infrastructure facility is guilty of a
214-Class A misdemeanor.
215-(d) If, during the commission of the crime of

241+restricted or limited access area that is completely enclosed
242+by any type of physical barrier when the person is not
243+authorized to enter the restricted or limited access area.
244+(c) A person who commits the crime of unauthorized
245+entry of a critical infrastructure facility is guilty of a
246+Class A misdemeanor.
245247 (d) If, during the commission of the crime of
246248 unauthorized entry of a critical infrastructure facility, the
247249 person injures, removes, destroys, or breaks critical
248250 infrastructure property, or otherwise interrupts or interferes
249251 with the operations of a critical infrastructure asset, the
250252 person is guilty of a Class C felony.
251253 (e) A person who commits the crime of unauthorized
252254 entry of a critical infrastructure facility while possessing
253255 or operating an unmanned aircraft system with an attached
254256 weapon, firearm, explosive, destructive device, or ammunition
255257 is guilty of a Class C felony.
256258 (f) Nothing in this section shall be construed to
257259 prevent lawful assembly and peaceful and orderly petition for
258260 the redress of grievances, including, but not limited to, any
259261 labor dispute between any employer and its employee.
260262 (g) Nothing in this section shall be construed to
261263 prohibit the state, a county, or a municipality from taking
262264 any lawful action on their respective rights-of-way. "
263265 Section 2. This act shall become effective on October
264266 1, 2024.
