| 21 | 23 | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: | |
| 22 | 24 | Section 1. Section 1 of Act 2023-191 of the 2023 | |
| 23 | 25 | Regular Session, now appearing as Section 45-22-190, Code of | |
| 24 | 26 | Alabama 1975, is amended to read as follows: | |
| 25 | 27 | "ยง45-22-190 | |
| 26 | 28 | (a) The Cullman County Commission shall create the | |
| 27 | 29 | Cullman County Legislative Delegation Fund. | |
| 28 | 30 | (b) The fund shall be comprised of the following monies | |
| 29 | 31 | received by the county: | |
| 30 | 32 | (1) The additional three percent of TVA | |
| 31 | 33 | in-lieu-of-taxes payments received pursuant to Section | |
| 32 | 34 | 40-28-2. | |
| 33 | 35 | (2) The proceeds collected pursuant to Section 35-8B-5. | |
| 34 | 36 | (2)(3) Any other monies provided for by law. | |
| 35 | 37 | (c) The commission shall immediately pay amounts from | |
| 36 | - | the fund as the Cullman County Legislative Delegation may | |
| 37 | - | request. | |
| 38 | - | (d) The legislative delegation shall expend the monies | |
| 39 | - | on allowable public purposes at the discretion and direction | |
| 40 | - | of the legislative delegation , based on the proportion of the | |
| 41 | - | population each member of the delegation represents in the | |
| 42 | - | county. | |

| 81 | 83 | (g) The revenue and expenditures of the legislative | |
| 82 | 84 | delegation office shall be audited on an annual basis." | |
