1515 SYNOPSIS:
1616 Under existing law, a person who provides labor
1717 or materials to manufacture or repair vehicles or
1818 machines of any kind has a statutory mechanic's lien on
1919 the machine after possession of the machine has been
2020 relinquished to the person for whom the work was
2121 performed, and the mechanic's common law possessory
2222 lien is therefore relinquished.
2323 Under existing law, the statutory lien is
2424 subordinate to any Uniform Commercial Code security
2525 interests perfected prior to the time that the work was
2626 performed.
2727 This bill would specify that a person who
2828 stores, fuels, repairs, or performs maintenance work on
2929 an aircraft has a mechanic's lien on the aircraft,
3030 subordinate to certain security interests under the
3131 Uniform Commercial Code that were perfected before the
3232 storage, fuels, repairs, or maintenance work was
3333 provided.
3434 This bill would authorize the holder of a
3535 statutory mechanics lien on an aircraft to record the
3636 lien by filing with the Federal Aviation Administration
3737 Aircraft Registry pursuant to applicable federal
3838 requirements.
3939 This bill would further authorize the holder of
4040 the lien to record the lien on an aircraft that is not

7171 registered in any national jurisdiction or that is
7272 registered in a nation other than the United States by
7373 filing with the Alabama Secretary of State subject to
7474 payment of certain fees that the Secretary of State may
7575 require.

7979 Relating to mechanic's lien on aircraft; to specify
8080 that a person who contributes certain materials, labor, or
8181 other services to an aircraft has a mechanic's lien on the
8282 aircraft; to provide that the lien shall be subordinate to
8383 certain previously perfected security interests; to authorize
8484 the holder of the lien to record the lien with the Federal
8585 Aviation Administration; and to authorize the holder of the
8686 lien to record the lien on certain aircraft with the Alabama
8787 Secretary of State.
8888 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8989 Section 1. (a) A person who stores, fuels, repairs, or
9090 performs maintenance work on an aircraft has a lien on the
9191 aircraft for either of the following:
9292 (1) The amount due under a contract for the storage,
9393 fuel, repairs, or maintenance work.
9494 (2) If no amount is specified by contract, the
9595 reasonable and usual compensation for the storage, fuel,

125125 reasonable and usual compensation for the storage, fuel,
126126 repairs, or maintenance work.
127127 (b) This section applies to a contract for storage only
128128 if:
129129 (1) The contract is written; or
130130 (2) The contract is verbal and provides for a storage
131131 period of at least 30 days.
132132 (c) The lien shall be subordinate to any security
133133 interest in the aircraft under the Uniform Commercial Code,
134134 which security interest was perfected prior to the time the
135135 storage, fuel, repairs, or maintenance work was provided,
136136 unless the secured party holding the security interest
137137 authorized the holder of the lien to provide the storage,
138138 fuel, repairs, or maintenance work.
139139 (d) A holder of a lien under this section may record
140140 the lien on the aircraft by filing with the Federal Aviation
141141 Administration Aircraft Registry not later than the 180th day
142142 after the date of the completion of the contractual storage
143143 period or the performance of the last repair or maintenance a
144144 verified document in the form and manner required by
145145 applicable federal laws and regulations that states all of the
146146 following:
147147 (1) The name, address, and telephone number of the
148148 holder of the lien under this section.
149149 (2) The amount due for storage, fuel, repairs, or
150150 maintenance work.
151151 (3) A complete description of the aircraft.
152152 (4) The name and address of the owner of the aircraft
153153 and the number assigned the aircraft by the Federal Aviation

183183 and the number assigned the aircraft by the Federal Aviation
184184 Administration, if known.
185185 (e) A holder of a lien under this section on an
186186 aircraft that is registered in a nation other than the United
187187 States or that is not registered in any national jurisdiction,
188188 may record the lien on the aircraft by filing with the
189189 Secretary of State not later than the 180th day after the date
190190 of the completion of the contractual storage period or the
191191 performance of the last repair, fueling, or maintenance an
192192 affidavit that states all of the following:
193193 (1) The name, address, and telephone number of the
194194 holder of the lien under this section.
195195 (2) The amount due for storage, repairs, fuel, or
196196 maintenance.
197197 (3) A complete description of the aircraft.
198198 (4) a. The name and last known address of the owner of
199199 the aircraft and the number assigned the aircraft by the
200200 applicable jurisdiction, if known.
201201 b. An inaccurate address stated under this subdivision
202202 does not invalidate the affidavit.
203203 (5) The Secretary of State shall maintain a record of
204204 information filed with the Secretary of State under this
205205 section and index the records in the name of the owner of the
206206 aircraft.
207207 (6) The Secretary of State may establish certain fees
208208 payable by the holder of the lien for filing the information
209209 with the Secretary of State under this section.
210210 Section 2. This act shall become effective on October
211211 1, 2024.
