15	15	SYNOPSIS:
16	16	Under existing law, a person who provides labor
17	17	or materials to manufacture or repair vehicles or
18	18	machines of any kind has a statutory mechanic's lien on
19	19	the machine after possession of the machine has been
20	20	relinquished to the person for whom the work was
21	21	performed, and the mechanic's common law possessory
22	22	lien is therefore relinquished.
23	23	Under existing law, the statutory lien is
24	24	subordinate to any Uniform Commercial Code security
25	25	interests perfected prior to the time that the work was
26	26	performed.
27	27	This bill would specify that a person who
28	28	stores, fuels, repairs, or performs maintenance work on
29	29	an aircraft has a mechanic's lien on the aircraft,
30	30	subordinate to certain security interests under the
31	31	Uniform Commercial Code that were perfected before the
32	32	storage, fuels, repairs, or maintenance work was
33	33	provided.
34	34	This bill would authorize the holder of a
35	35	statutory mechanics lien on an aircraft to record the
36	36	lien by filing with the Federal Aviation Administration
37	37	Aircraft Registry pursuant to applicable federal
38	38	requirements.
39	39	This bill would further authorize the holder of
40	40	the lien to record the lien on an aircraft that is not

71	71	registered in any national jurisdiction or that is
72	72	registered in a nation other than the United States by
73	73	filing with the Alabama Secretary of State subject to
74	74	payment of certain fees that the Secretary of State may
75	75	require.

79	79	Relating to mechanic's lien on aircraft; to specify
80	80	that a person who contributes certain materials, labor, or
81	81	other services to an aircraft has a mechanic's lien on the
82	82	aircraft; to provide that the lien shall be subordinate to
83	83	certain previously perfected security interests; to authorize
84	84	the holder of the lien to record the lien with the Federal
85	85	Aviation Administration; and to authorize the holder of the
86	86	lien to record the lien on certain aircraft with the Alabama
87	87	Secretary of State.
88	88	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
89	89	Section 1. (a) A person who stores, fuels, repairs, or
90	90	performs maintenance work on an aircraft has a lien on the
91	91	aircraft for either of the following:
92	92	(1) The amount due under a contract for the storage,
93	93	fuel, repairs, or maintenance work.
94	94	(2) If no amount is specified by contract, the
95	95	reasonable and usual compensation for the storage, fuel,

125	125	reasonable and usual compensation for the storage, fuel,
126	126	repairs, or maintenance work.
127	127	(b) This section applies to a contract for storage only
128	128	if:
129	129	(1) The contract is written; or
130	130	(2) The contract is verbal and provides for a storage
131	131	period of at least 30 days.
132	132	(c) The lien shall be subordinate to any security
133	133	interest in the aircraft under the Uniform Commercial Code,
134	134	which security interest was perfected prior to the time the
135	135	storage, fuel, repairs, or maintenance work was provided,
136	136	unless the secured party holding the security interest
137	137	authorized the holder of the lien to provide the storage,
138	138	fuel, repairs, or maintenance work.
139	139	(d) A holder of a lien under this section may record
140	140	the lien on the aircraft by filing with the Federal Aviation
141	141	Administration Aircraft Registry not later than the 180th day
142	142	after the date of the completion of the contractual storage
143	143	period or the performance of the last repair or maintenance a
144	144	verified document in the form and manner required by
145	145	applicable federal laws and regulations that states all of the
146	146	following:
147	147	(1) The name, address, and telephone number of the
148	148	holder of the lien under this section.
149	149	(2) The amount due for storage, fuel, repairs, or
150	150	maintenance work.
151	151	(3) A complete description of the aircraft.
152	152	(4) The name and address of the owner of the aircraft
153	153	and the number assigned the aircraft by the Federal Aviation

183	183	and the number assigned the aircraft by the Federal Aviation
184	184	Administration, if known.
185	185	(e) A holder of a lien under this section on an
186	186	aircraft that is registered in a nation other than the United
187	187	States or that is not registered in any national jurisdiction,
188	188	may record the lien on the aircraft by filing with the
189	189	Secretary of State not later than the 180th day after the date
190	190	of the completion of the contractual storage period or the
191	191	performance of the last repair, fueling, or maintenance an
192	192	affidavit that states all of the following:
193	193	(1) The name, address, and telephone number of the
194	194	holder of the lien under this section.
195	195	(2) The amount due for storage, repairs, fuel, or
196	196	maintenance.
197	197	(3) A complete description of the aircraft.
198	198	(4) a. The name and last known address of the owner of
199	199	the aircraft and the number assigned the aircraft by the
200	200	applicable jurisdiction, if known.
201	201	b. An inaccurate address stated under this subdivision
202	202	does not invalidate the affidavit.
203	203	(5) The Secretary of State shall maintain a record of
204	204	information filed with the Secretary of State under this
205	205	section and index the records in the name of the owner of the
206	206	aircraft.
207	207	(6) The Secretary of State may establish certain fees
208	208	payable by the holder of the lien for filing the information
209	209	with the Secretary of State under this section.
210	210	Section 2. This act shall become effective on October
211	211	1, 2024.
