	17	+	SYNOPSIS:
	18	+	Under existing law, the Board of Dental
	19	+	Examiners of Alabama is responsible for the licensing
	20	+	and regulation of dentists and dental hygienists in the
	21	+	state.
	22	+	This bill would authorize the board to issue
	23	+	special volunteer licenses to allow eligible
	24	+	nonresident dentists and dental hygienists to practice
	25	+	in this state for a limited time under the supervision
	26	+	of a licensed dentist during an organized charitable
	27	+	event.
	28	+	This bill would also increase the annual dental
	29	+	hygiene registration fee and would establish a fee for
	30	+	the issuance of special volunteer licenses.
	31	+	A BILL
	32	+	TO BE ENTITLED
	33	+	AN ACT
18	34		Relating to the Board of Dental Examiners of Alabama;
19	35		to add Section 34-9-10.01 to the Code of Alabama 1975; to
20	36		authorize the board to issue special volunteer licenses to
21	37		allow eligible nonresident dentists and dental hygienists to
22	38		practice in this state for a limited time under the
23		-	supervision of a licensed dentist in connection with an
24		-	organized charitable event; and to amend Section 34-9-16, Code
25		-	of Alabama 1975, to increase the annual dental hygiene
26		-	registration fee and to establish a fee for the issuance of
27		-	special volunteer licenses.
28		-	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
29		-	Section 1. Section 34-9-10.01 is added to the Code of
30		-	Alabama 1975, to read as follows:
31		-	§34-9-10.01 Special Volunteer License
32		-	(a) The board may issue a special volunteer license to
33		-	practice dentistry or dental hygiene, or both, in this state
34		-	pursuant to this section.
35		-	(b) The board may issue or deny issuance of a special
36		-	volunteer license, and the denial, suspension, restriction,
37		-	limitation, or revocation of a special volunteer license does
38		-	not require a contested case proceeding under the Alabama
39		-	Administrative Procedure Act.
40		-	(c) An applicant for a special volunteer license shall
41		-	satisfy all of the following:
42		-	(1) Hold an active, full, and unrestricted license to
43		-	practice dentistry or dental hygiene, as applicable, in

	78	+	(a) The board may issue a special volunteer license to
	79	+	practice dentistry or dental hygiene, or both, in this state
	80	+	pursuant to this section.
	81	+	(b) The board may issue or deny issuance of a special
	82	+	volunteer license, and the denial, suspension, restriction,
	83	+	limitation, or revocation of a special volunteer license does
	84	+	not require a contested case proceeding under the Alabama
	85	+	Administrative Procedure Act.
	86	+	(c) An applicant for a special volunteer license shall
	87	+	satisfy all of the following:
	88	+	(1) Hold an active, full, and unrestricted license to
73	89		practice dentistry or dental hygiene, as applicable, in
74	90		another state or the District of Columbia and not be subject
75	91		to any pending disciplinary action by any applicable licensing
76	92		authority.
77	93		(2) Submit to the board a completed application and a
78	94		fee prescribed by the board.
79	95		(d) The scope of practice authorized by a special
80	96		volunteer license to practice dentistry or dental hygiene, or
81		-	both, shall be the scope of practice for dentists and dental
82		-	hygienists prescribed by this chapter. This chapter and the
83		-	rules adopted by the board pursuant to this chapter are
84		-	applicable to any holder of a special volunteer license, and a
85		-	holder of a special volunteer license is deemed to have
86		-	submitted to the disciplinary jurisdiction of the board for
87		-	purposes of any disciplinary action arising out of his or her
88		-	activities within this state.
89		-	(e)(1) A special volunteer license authorizes the
90		-	holder to provide dental or dental hygiene treatment, or both,
91		-	as applicable, in connection with an organized charitable
92		-	event at a specific location approved in advance by the board.
93		-	Each organized charitable event shall have at least one
94		-	Alabama licensed dentist who regularly practices dentistry in
95		-	this state who shall be the responsible custodian of all
96		-	record of treatment provided in connection with the event.
97		-	(2) All treatment provided by a holder of a special
98		-	volunteer license shall be provided under the direct
99		-	supervision of at least one Alabama licensed dentist who
100		-	regularly practices dentistry in this state, and each record
101		-	of treatment shall specifically identify the supervising

138	154		(4) A holder of a special volunteer license is not
139		-	eligible to receive an Alabama controlled substance
140		-	certificate or any permit to perform sedation or anesthesia.
141		-	(f) A special volunteer license shall be valid for up
142		-	to 15 calendar days, at the discretion of the board, within
143		-	the 30-day period following the date of issuance and shall
144		-	expire automatically by operation of law on the 31st day
145		-	following issuance. The board, upon application, may renew a
146		-	special volunteer license for no more than 15 calendar days
147		-	each.
148		-	(g) The board may adopt rules as necessary to implement
149		-	this section.
150		-	Section 2. Section 34-9-16 of the Code of Alabama 1975,
151		-	is amended to read as follows:

154		-	provided for in this chapter within the ranges set forth below
155		-	and without having to engage in the rulemaking process:
