19+AN ACT
1820 Relating to Marion County; to amend Sections 45-47-230
1921 and 45-47-242.21, Code of Alabama 1975, to abolish certain
2022 expense allowances paid to certain county officials; to revise
2123 the salaries of the sheriff, revenue commissioner, and members
2224 of the county commission; and to repeal Section 45-47-70, Code
2325 of Alabama 1975, relating to expense allowances paid to
2426 members of the Marion County Commission.
2527 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2628 Section 1. Sections 45-47-230 and 45-47-242.21, Code of
2729 Alabama 1975, are amended to read as follows:
2830 "§45-47-230
2931 (a) The County Commission of Marion County is
3032 authorized and directed to pay the chief deputy sheriff, each
3133 deputy sheriff, and the sheriff's clerk an additional expense
3234 allowance of one hundred dollars ($100) per month payable from
3335 the general fund of the county. The expense allowance shall be
3436 in addition to all compensation or allowances heretofore
3537 payable to each such officer.
3638 (b) The Sheriff of Marion County shall be entitled to
3739 receive an expense allowance in the amount of five hundred
38-dollars ($500) per month and each Each deputy sheriff of
39-Marion County shall be entitled to receive an expense
40-allowance of fifty dollars ($50) per month to be paid out of
41-the county general fund. This expense allowance shall be in
42-addition to any and all other compensation, salary, and
43-expense allowances provided for by law. The expense allowance
44-shall be paid out of the General Fund of Marion County."

69+receive an expense allowance in the amount of five hundred

7577 "§45-47-242.21
7678 (a) The judge of probate is relieved of all duties and
7779 responsibilities relating to the assessment and collection of
7880 taxes, commissions, and issuance fees on motor vehicles. The
7981 revenue commissioner shall receive the commissions and fees
8082 currently allocated to the judge of probate for performing
8183 these functions, and those fees and commissions shall be
8284 remitted to the county general fund. Reporting and remitting
8385 the collections of those fees shall be made by the revenue
8486 commissioner or as otherwise required by law.
8587 (b) The Revenue Commissioner of Marion County shall
8688 perform all duties relating to the issuance of motor vehicle
8789 license plates in the county and shall perform all duties
8890 relating to the assessment and collection of ad valorem taxes,
8991 commissions, fees, or other charges imposed by law on motor
9092 vehicles, which have heretofore been performed jointly by the
9193 revenue commissioner and the judge of probate.
9294 (c) The Revenue Commissioner of Marion County shall be
9395 compensated an additional five thousand dollars ($5,000) per
9496 year, paid in equal monthly installments from the general fund
9597 of the county, for performing all of the duties relating to
96-the assessments, collections, and issuance of motor vehicle
97-license plates in Marion County. "
98-Section 2. (a) Beginning on the effective date of this
99-act, the Sheriff of Marion County shall receive an additional
100-expense allowance in an amount that brings his or her total
101-compensation to eighty thousand dollars ($80,000) per year to
102-be paid out of the county general fund. The expense allowance

130+Section 2. (a) Beginning on the effective date of this
131+act, the Sheriff of Marion County shall receive an additional
132+expense allowance in an amount that brings his or her total

135137 (b) Beginning with the next term of office, the expense
136138 allowance provided in subsection (a) shall be void, and the
137139 Sheriff of Marion County shall receive a total yearly salary
138140 of eighty thousand dollars ($80,000), which shall be in lieu
139141 of any other compensation, salary, or expense allowance
140142 provided by law for the sheriff for the performance of his or
141143 her official duties.
142144 Section 3.(a) Beginning on the effective date of this
143145 act, the Revenue Commissioner of Marion County shall receive
144146 an additional expense allowance in an amount that brings his
145147 or her total compensation to seventy-two thousand dollars
146148 ($72,000) per year to be paid out of the county general fund.
147149 The expense allowance shall be in addition to any and all
148150 other compensation, salary, or expense allowances provided by
149151 law.
150152 (b) Beginning with the next term of office, the expense
151153 allowance provided in subsection (a) shall be void, and the
152154 Revenue Commissioner of Marion County shall receive a total
153155 yearly salary of seventy-two thousand dollars ($72,000), which
154-shall be in lieu of any other compensation, salary, or expense
155-allowance provided by law for the revenue commissioner for the
156-performance of his or her official duties. The compensation
157-provided by Section 11-2A-3, Code of Alabama 1975, shall be
158-considered to be included in the total yearly salary.
159-Section 4. (a) Beginning on the effective date of this
160-act, each member of the Marion County Commission shall receive

185+yearly salary of seventy-two thousand dollars ($72,000), which

187+allowance provided by law for the revenue commissioner for the
188+performance of his or her official duties. The compensation
189+provided by Section 11-2A-3, Code of Alabama 1975, shall be
190+considered to be included in the total yearly salary.
191+Section 4.(a) Beginning on the effective date of this
190192 act, each member of the Marion County Commission shall receive
191193 an additional expense allowance in an amount that brings the
192194 total compensation of each member to sixty thousand dollars
193195 ($60,000) per year to be paid out of the county general fund.
194196 The expense allowance shall be in addition to any and all
195197 other compensation, salary, or expense allowances provided by
196198 law.
197199 (b) Beginning with the next term of office, the expense
198200 allowance provided in subsection (a) shall be void, and each
199201 member of the Marion County Commission shall receive a total
200202 yearly salary of sixty thousand dollars ($60,000), which shall
201203 be in lieu of any other compensation, salary, or expense
202204 allowance provided by law for the members for the performance
203205 of their official duties.
204206 Section 5. Section 45-47-70, Code of Alabama 1975,
205207 relating to expense allowances paid to members of the Marion
206208 County Commission, is repealed.
207209 Section 6. This act shall become effective on June 1,
208210 2024.
