15-Enrolled, An Act,
15+SYNOPSIS:
16+Under existing law, the salary of the Secretary
17+of Commerce and the salaries of the deputy secretaries
18+of the Department of Commerce may not exceed a specific
19+dollar amount above the highest paid non-merit position
20+in the department.
21+This bill would provide that the salary of the
22+Secretary of Commerce would be set by the Governor in
23+the same manner as other department heads are set.
24+This bill would provide that the salary of the
25+deputy secretaries would be set by the secretary and
26+approved by the Governor.
27+This bill would also make nonsubstantive,
28+technical revisions to update the existing code
29+language to current style.

1633 Relating to the Department of Commerce; to amend
1734 Section 41-29-1, Code of Alabama 1975; to revise the process
1835 for setting the salaries of the secretary and the deputy
1936 secretaries; and to make nonsubstantive, technical revisions
20-to update the existing code language to current style.
21-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
22-Section 1. Section 41-29-1, Code of Alabama 1975, is
23-amended to read as follows:
24-"§41-29-1
25-(a)(1) There is hereby created the Department of
26-Commerce within the office of the Governor and directly under
27-his or her supervision and control. The Department of Commerce
28-shall be headed by the Secretary of Commerce, who shall be a
29-person possessed with extensive responsible an individual with
30-extensive experience in development of economic, human, and
31-physical resources and promotion of industrial and commercial
32-development. The secretary shall be appointed by the Governor
33-and serve at his or her pleasure at a salary of any reasonable
34-amount not to exceed by forty thousand dollars ($40,000) the
35-highest authorized salary for employees of the Department of
36-Commerce who are subject to the Merit System law set in the
37-same manner as other appointed department heads under Section
38-36-6-6. In fixing such the secretary's salary, the Governor
39-shall give due consideration of the salaries of comparable
40-positions in other states and in private industry. All other

68+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

7592 for the office, who shall not be subject to the state Merit
7693 System law and whose compensation shall be determined by the
7794 secretary.
78-(2) The eight additional assistant secretaries shall be
79-persons individuals experienced in industrial and commercial
80-development for at least the two years prior to their
81-employment. Compensation for the eight additional assistant
82-secretaries shall not exceed the amount of compensation paid
83-for the highest classification of state Merit System employees
84-employed by the Department of Commerce.
85-(3) The makeup of the assistant secretaries shall be
86-inclusive and should reflect the racial, gender, geographic,
87-urban,/rural, and economic diversity of the state.
88-(b) On the date determined pursuant to Section 41-29-6,
89-the Department of Commerce shall be comprised of the following
90-divisions: The Business Development Division and the Workforce
91-Development Division. Each division shall be headed by a
92-deputy secretary who shall be appointed by the Secretary of
93-Commerce outside of the classified service and who shall serve
94-at the pleasure of the secretary at a salary of any reasonable
95-amount not to exceed by ten thousand dollars ($10,000) the
96-highest authorized salary for employees of the Department of
97-Commerce who are subject to the Merit System law set by the
98-secretary and approved by the Governor . The deputy secretary

134151 (2) All economic development functions as defined in
135152 subdivision (12) of Section 36-25-1 or otherwise engaged in by
136-any employee, department, agency, or body corporate in the
137-executive branch of the state shall be pre-approved by the
138-Secretary of Commerce or the Governor.
139-(d) The Governor may direct any state department or
140-other agency of state government directly under his or her
141-control and supervision to furnish the Department of Commerce
142-with such personnel, equipment, and services as are necessary
143-to enable it the Department of Commerce to carry out its
144-responsibilities and duties and may prescribe the terms
145-thereof, including reimbursement of costs thereof.
146-(e)(1) The Legislature finds and declares that the
147-Alabama Community College System consists of comprehensive
148-community and technical colleges and the Alabama Technology
149-Network, an effective workforce development initiative. The
150-Alabama Community College System provides a unified system of
151-institutions delivering excellence in academic education,
152-adult education, and workforce development initiatives that
153-are responsive to industry needs for highly specialized
154-training programs that help prepare entry level employees to
155-meet growing demands.
156-(2) Notwithstanding any other provision of this

188205 to provide a wide range of career-technical courses and
189206 short-term training for job-specific certifications."
190207 Section 2. This act shall become effective on June 1,
