19	19	SYNOPSIS:
20	20	Under existing law, every individual, except
21	21	those specifically exempted by law, is required to
22	22	obtain a driver license before driving a motor vehicle
23	23	on the highways of this state and every new resident is
24	24	required to obtain an Alabama driver license within 30
25	25	days after establishing residence in this state.
26	26	A nonresident with a license issued in his or
27	27	her home state or country may be exempt from the
28	28	Alabama license requirement under certain
29	29	circumstances.
30	30	This bill would invalidate any driver license of
31	31	a nonresident driving a motor vehicle in this state,
32	32	issued in another state, if the license is of any class
33	33	of licenses issued exclusively to undocumented
34	34	immigrants unable to prove lawful presence in the
35	35	United States.
36	36	This bill would also provide that a nonresident
37	37	driver with a license issued in his or her home state
38	38	or country shall not be exempt from Alabama driver
39	39	license requirements if his or her license is of any
40	40	class of licenses issued exclusively to undocumented
41	41	immigrants unable to prove lawful presence in the
42	42	United States.

75	75	Relating to driver licenses; to invalidate in this
76	76	state any driver licenses, issued in another state, of a class
77	77	of licenses exclusively issued to undocumented immigrants; to
78	78	amend Section 32-6-2, Code of Alabama 1975, to provide that a
79	79	nonresident with a certain class of driver license issued in
80	80	another state shall not be exempt from securing a license in
81	81	this state.
82	82	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
83	83	Section 1. (a) If a driver license is of a class of
84	84	licenses issued by another state exclusively to undocumented
85	85	immigrants who are unable to prove lawful presence in the
86	86	United States when the licenses are issued, the driver
87	87	license, or other permit purporting to authorize the holder to
88	88	operate a motor vehicle on public roadways, is invalid in this
89	89	state and does not authorize the holder to operate a motor
90	90	vehicle in this state. These classes of licenses include
91	91	licenses that are issued exclusively to undocumented
92	92	immigrants or licenses that are substantially the same as
93	93	licenses issued to citizens, residents, or those lawfully
94	94	present in the United States but have markings establishing
95	95	that the license holder did not exercise the option of

125	125	that the license holder did not exercise the option of
126	126	providing proof of lawful presence.
127	127	(b) A law enforcement officer or other authorized
128	128	representative of the Alabama State Law Enforcement Agency who
129	129	stops an individual driving with an invalid license as
130	130	described in subsection (a) or driving without a valid license
131	131	shall issue a citation to the driver for driving without a
132	132	license.
133	133	(c) To facilitate the enforcement of this section and
134	134	to aid in providing notice to visitors and the general public
135	135	concerning invalid licenses, the agency shall maintain on its
136	136	website a list of out-of-state classes of driver licenses
137	137	which are invalid in this state.
138	138	Section 2. Section 32-6-2, Code of Alabama 1975, is
139	139	amended to read as follows:
140	140	"§32-6-2
141	141	The following personsindividuals when driving a motor
142	142	vehicle under the following conditions are exempt from a
143	143	license hereunder:
144	144	(1) Any personindividual in the service of the federal
145	145	government while driving an official motor vehicle in such
146	146	service;.
147	147	(2) Any personindividual while driving any road
148	148	machine, farm tractor, or implement of husbandry temporarily
149	149	driven or moved on a highway ;.
150	150	(3) A nonresident who is at least 16 years of age and
151	151	who has in his or her immediate possession a valid
152	152	driver'sdriver license issued in his or her home state or
153	153	country. This exemption does not apply if the nonresident's

183	183	country. This exemption does not apply if the nonresident's
184	184	license is invalid under Section 1. ;
185	185	(4) Any nonresident who is at least 16 years of age
186	186	whose home state or country does not require the licensing of
187	187	drivers for a period of not more than 90 days in any calendar
188	188	year, if the motor vehicle so driven is duly registered in the
189	189	home state or country of such nonresident . This exemption does
190	190	not apply if the nonresident's license is invalid under
191	191	Section 1."
192	192	Section 3. This act shall become effective on October
193	193	1, 2024.
