1919 SYNOPSIS:
2020 Under existing law, every individual, except
2121 those specifically exempted by law, is required to
2222 obtain a driver license before driving a motor vehicle
2323 on the highways of this state and every new resident is
2424 required to obtain an Alabama driver license within 30
2525 days after establishing residence in this state.
2626 A nonresident with a license issued in his or
2727 her home state or country may be exempt from the
2828 Alabama license requirement under certain
2929 circumstances.
3030 This bill would invalidate any driver license of
3131 a nonresident driving a motor vehicle in this state,
3232 issued in another state, if the license is of any class
3333 of licenses issued exclusively to undocumented
3434 immigrants unable to prove lawful presence in the
3535 United States.
3636 This bill would also provide that a nonresident
3737 driver with a license issued in his or her home state
3838 or country shall not be exempt from Alabama driver
3939 license requirements if his or her license is of any
4040 class of licenses issued exclusively to undocumented
4141 immigrants unable to prove lawful presence in the
4242 United States.

7474 AN ACT
7575 Relating to driver licenses; to invalidate in this
7676 state any driver licenses, issued in another state, of a class
7777 of licenses exclusively issued to undocumented immigrants; to
7878 amend Section 32-6-2, Code of Alabama 1975, to provide that a
7979 nonresident with a certain class of driver license issued in
8080 another state shall not be exempt from securing a license in
8181 this state.
8282 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8383 Section 1. (a) If a driver license is of a class of
8484 licenses issued by another state exclusively to undocumented
8585 immigrants who are unable to prove lawful presence in the
8686 United States when the licenses are issued, the driver
8787 license, or other permit purporting to authorize the holder to
8888 operate a motor vehicle on public roadways, is invalid in this
8989 state and does not authorize the holder to operate a motor
9090 vehicle in this state. These classes of licenses include
9191 licenses that are issued exclusively to undocumented
9292 immigrants or licenses that are substantially the same as
9393 licenses issued to citizens, residents, or those lawfully
9494 present in the United States but have markings establishing
9595 that the license holder did not exercise the option of

125125 that the license holder did not exercise the option of
126126 providing proof of lawful presence.
127127 (b) A law enforcement officer or other authorized
128128 representative of the Alabama State Law Enforcement Agency who
129129 stops an individual driving with an invalid license as
130130 described in subsection (a) or driving without a valid license
131131 shall issue a citation to the driver for driving without a
132132 license.
133133 (c) To facilitate the enforcement of this section and
134134 to aid in providing notice to visitors and the general public
135135 concerning invalid licenses, the agency shall maintain on its
136136 website a list of out-of-state classes of driver licenses
137137 which are invalid in this state.
138138 Section 2. Section 32-6-2, Code of Alabama 1975, is
139139 amended to read as follows:
140140 "ยง32-6-2
141141 The following personsindividuals when driving a motor
142142 vehicle under the following conditions are exempt from a
143143 license hereunder:
144144 (1) Any personindividual in the service of the federal
145145 government while driving an official motor vehicle in such
146146 service;.
147147 (2) Any personindividual while driving any road
148148 machine, farm tractor, or implement of husbandry temporarily
149149 driven or moved on a highway ;.
150150 (3) A nonresident who is at least 16 years of age and
151151 who has in his or her immediate possession a valid
152152 driver'sdriver license issued in his or her home state or
153153 country. This exemption does not apply if the nonresident's

183183 country. This exemption does not apply if the nonresident's
184184 license is invalid under Section 1. ;
185185 (4) Any nonresident who is at least 16 years of age
186186 whose home state or country does not require the licensing of
187187 drivers for a period of not more than 90 days in any calendar
188188 year, if the motor vehicle so driven is duly registered in the
189189 home state or country of such nonresident . This exemption does
190190 not apply if the nonresident's license is invalid under
191191 Section 1."
192192 Section 3. This act shall become effective on October
193193 1, 2024.
