1515 SYNOPSIS:
1616 This bill would define the terms "child sexual
1717 abuse material," "sexually explicit conduct," and
1818 "virtually indistinguishable depiction."
1919 Under existing law, it is unlawful for any
2020 person to knowingly disseminate, display publicly,
2121 knowingly possess, knowingly possess with intent to
2222 disseminate, or knowingly film, print, record,
2323 photograph, or otherwise produce certain obscene
2424 material depicting an individual under 17 years of age.
2525 This bill would provide that it is unlawful for
2626 any person to knowingly disseminate, distribute,
2727 display publicly, knowingly possess, knowingly possess
2828 with intent to disseminate, or knowingly film, print,
2929 record, photograph, or otherwise produce child sexual
3030 abuse material.
3131 This bill would also provide that it is unlawful
3232 for any person to knowingly advertise, promote,
3333 present, or solicit by any means, including by
3434 computer, child sexual abuse material.
3535 Under existing law, it is unlawful for any
3636 parent or guardian to knowingly permit or allow their
3737 child, ward, or dependent under 17 years of age to
3838 engage in the production of certain obscene material
3939 containing a visual depiction of the child, ward, or

6969 containing a visual depiction of the child, ward, or
7070 dependent.
7171 This bill would provide that it is unlawful for
7272 any parent or guardian to knowingly permit or allow
7373 their child, ward, or dependent under 18 years of age
7474 to engage in the production of child sexual abuse
7575 material depicting the child, ward, or dependent.
7676 This bill would authorize an individual to
7777 commence a civil action against a person who commits
7878 the crime of distribution of a private image,
7979 dissemination or public display of child sexual abuse
8080 material, possession of child sexual abuse material,
8181 possession with intent to distribute child sexual abuse
8282 material, permitting or allowing a child, ward, or
8383 dependent to engage in the production of child sexual
8484 abuse material as a parent or guardian, or production
8585 of child sexual abuse material.
8686 This bill would also authorize a court to award
8787 certain punitive damages against an individual who,
8888 with wantonness or malice, commits the crime of
8989 distribution of a private image, dissemination or
9090 public display of child sexual abuse material,
9191 possession of child sexual abuse material, possession
9292 with intent to distribute child sexual abuse material,
9393 permitting or allowing a child, ward, or dependent to
9494 engage in the production of child sexual abuse material
9595 as a parent or guardian, or production of child sexual
9696 abuse material.
9797 This bill would direct the State Board of

127127 This bill would direct the State Board of
128128 Education to require local school boards to develop
129129 policies related to the distribution of private images
130130 and the distribution, dissemination, public display,
131131 possession, possession with intent to distribute, and
132132 production of child sexual abuse material.
133133 This bill would also make nonsubstantive,
134134 technical revisions to update the existing code
135135 language to current style.
136136 Section 111.05 of the Constitution of Alabama of
137137 2022, prohibits a general law whose purpose or effect
138138 would be to require a new or increased expenditure of
139139 local funds from becoming effective with regard to a
140140 local governmental entity without enactment by a 2/3
141141 vote unless: it comes within one of a number of
142142 specified exceptions; it is approved by the affected
143143 entity; or the Legislature appropriates funds, or
144144 provides a local source of revenue, to the entity for
145145 the purpose.
146146 The purpose or effect of this bill would be to
147147 require a new or increased expenditure of local funds
148148 within the meaning of the section. However, the bill
149149 does not require approval of a local governmental
150150 entity or enactment by a 2/3 vote to become effective
151151 because it comes within one of the specified exceptions
152152 contained in the section.

192192 material; to provide a cause of action for certain offenses
193193 involving child sexual abuse material; to authorize a court to
194194 award punitive damages against an individual who commits
195195 certain offenses involving child sexual abuse material; to
196196 direct the State Board of Education to require local school
197197 boards to develop policies related to certain crimes; to
198198 repeal Section 13A-12-195, Code of Alabama 1975, relating to
199199 the commercial exploitation of child sexual abuse material; to

202202 therewith would have as its purpose or effect the requirement
203203 of a new or increased expenditure of local funds within the
204204 meaning of Section 111.05 of the Constitution of Alabama of
205205 2022.
206206 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
207207 Section 1. This act shall be known and may be cited as
208208 the Alabama Child Protection Act of 2024.
209209 Section 2. Sections 13A-6-240, as last amended by Act

244244 "§13A-6-240
245245 (a) A person commits the crime of distributing a
246246 private image if he or she knowingly posts, emails, texts,
247247 transmits, or otherwise distributes a private image when the
248248 depicted person individual has not consented to the
249249 transmission and the depicted person individual had a
250250 reasonable expectation of privacy against transmission of the
251251 private image.
252252 (b)(1) For purposes of this section, "private image"
253253 means a photograph, digital image, video, film, or other
254254 recording of a person an individual who is identifiable from
255255 the recording itself or from the circumstances of its
256256 transmission and who is engaged in any act of sadomasochistic
257257 abuse, sexual intercourse, sexual excitement, masturbation,
258258 breast nudity, as defined in Section 13A-12-190, genital
259259 nudity, or other sexual conduct sexually explicit conduct, as
260260 defined in Section 13A-12-190 .
261261 (2) The term includes a recording that has been edited,
262262 altered, or otherwise manipulated from its original form.
263263 (c)(1) For purposes of this section, a "reasonable
264264 expectation of privacy" includes, but is not limited to,
265265 either of the following circumstances:
266266 a. The person individual depicted in the private image
267267 created it or consented to its creation believing that it
268268 would remain confidential.

299299 b. The sexual conduct depicted in the image was
300300 involuntary.
301301 (2) There is no reasonable expectation of privacy
302302 against the transmission of a private image made voluntarily
303303 in a public or commercial setting.
304304 (d) It is a defense to distributing a private image if
305305 the distribution of the private image was made in the public
306306 interest, including, but not limited to, the reporting of
307307 unlawful conduct; the lawful and common practices of law
308308 enforcement, legal proceedings, or medical treatment; or a
309309 bona fide attempt to prevent further distribution of the
310310 private image.
311311 (e) For the purposes of determining jurisdiction, the
312312 crime of distributing a private image shall be considered to
313313 be committed in any county in which any part of the crime took
314314 place, in the county of residence of the victim or defendant,
315315 or any county where the image is received.
316316 (f) A violation of this section is a Class A
317317 misdemeanor. A subsequent adjudication or conviction under
318318 this section is a Class C felony."
319319 "§13A-12-190
320320 For the purposes of this division, the following terms
321321 shall have the following meanings respectively ascribed to
322322 them by this section :
323323 (1)(4) DISSEMINATE. To transmit, distribute, sell,
324324 lend, provide, transfer, or show, including through electronic
325325 means.
326326 (2)(3) DISPLAY PUBLICLY. The exposing, placing,

356356 (2)(3) DISPLAY PUBLICLY. The exposing, placing,
357357 posting, exhibiting, or in any fashion displaying in any
358358 location, whether public or private, an item in such a manner
359359 that it may be readily seen and its content or character
360360 distinguished by normal unaided vision viewing it from a
361361 public thoroughfare, depot, or vehicle.
362362 (3)(9) PUBLIC THOROUGHFARE, DEPOT, OR VEHICLE. Any
363363 street, highway, park, depot, or transportation platform or
364364 other place, whether indoors or outoutdoors, or any vehicle
365365 for public transportation, owned or operated by government,
366366 either directly or through a public corporation or authority,
367367 or owned or operated by any agency of public transportation
368368 that is designed for the use, enjoyment, or transportation of
369369 the general public.
370370 (4)(6) KNOWINGLY. A person knowingly disseminates or
371371 publicly displays obscene matter acts regarding child sexual
372372 abuse material when the person knows the nature of the
373373 mattermaterial. A person knows the nature of the matter
374374 material when either of the following circumstances exist:
375375 a. The person is aware of the character and content of
376376 the mattermaterial.
377377 b. The person recklessly disregards circumstances
378378 suggesting the character and content of the mattermaterial.
379379 (5)(10)SADO-MASOCHISTIC SADOMASOCHISTIC ABUSE. Such
380380 term means either Either of the following:
381381 a. Flagellation or torture, for the purpose of sexual
382382 stimulation, by or upon a person an individual who is nude or
383383 clad in undergarments or in a revealing or bizarre costume.
384384 b. The condition of a person an individual who is nude

414414 b. The condition of a person an individual who is nude
415415 or clad in undergarments or in a revealing or bizarre costume
416416 being fettered, bound, or otherwise physically restrained for
417417 the purpose of sexual stimulation.
418418 (6)(12) SEXUAL EXCITEMENT. The condition of human male
419419 or female genitals when in a state of sexual stimulation.
420420 (7)(13) SEXUAL INTERCOURSE. Intercourse, real or
421421 simulated, whether genital-genital, oral-genital,
422422 anal-genital, or oral-anal, whether between persons
423423 individuals of the same or opposite sex or between a human and
424424 an animal.
425425 (8)(7) MASTURBATION. Manipulation, by hand or
426426 instrument, of the human genitals, whether one's own or
427427 another's for the purpose of sexual stimulation.
428428 (9)(8) OTHER SEXUAL CONDUCT. Any touching of the
429429 genitals, pubic areas, or buttocks of the human male or
430430 female, or the breasts of the female, whether alone or between
431431 members of the same or opposite sex or between humans and
432432 animals in an act of apparent sexual stimulation or
433433 gratification.
434434 (10)(1) BREAST NUDITY. The lewd showing of the
435435 post-pubertal human female breasts below a point immediately
436436 above the top of the areola.
437437 (11)(5) GENITAL NUDITY. The lewd showing of the
438438 genitals or pubic area.
439439 (12) MATTER. Any book, magazine, newspaper, or other
440440 printed material, or any picture, photograph, motion picture,
441441 video cassette, tape, record, digital video disc (DVD), video
442442 compilation, or electronic depiction in a comparable format,

472472 compilation, or electronic depiction in a comparable format,
473473 or an image, file, download, or other content stored, or
474474 reproduced by using a computer or electronic device or other
475475 digital storage, or any other thing, articles, or materials
476476 that either are or contain a photographic or other visual
477477 depiction of a live act, performance, or event.
478478 (13) OBSCENE. a. When used to describe any matter that
479479 contains a visual reproduction of breast nudity, the term
480480 shall include all of the following:
481481 1. Applying contemporary local community standards, on
482482 the whole, appeals to the prurient interest.
483483 2. Is patently offensive.
484484 3. On the whole, lacks serious literary, artistic,
485485 political, or scientific value.
486486 b. When used to describe matter that is a depiction of
487487 an act of sado-masochistic abuse, sexual intercourse, sexual
488488 excitement, masturbation, genital nudity, or other sexual
489489 conduct, the term means matter containing a visual
490490 reproduction that itself lacks serious literary, artistic,
491491 political, or scientific value.
492492 (14) LOCAL COMMUNITY. The judicial circuit in which the
493493 indictment is brought.
494494 (15) VISUAL DEPICTION. A portrayal, representation,
495495 illustration, image, likeness, or other thing that creates a
496496 sensory impression, whether an original, duplicate, or
497497 reproduction.
498498 (16)(11) SEPARATE OFFENSE. The depiction of an
499499 individual less than 17 18 years of age that violates this
500500 division shall constitute a separate offense for each single

532532 (2) CHILD SEXUAL ABUSE MATERIAL. Any visual depiction
533533 of an individual under 18 years of age engaged in any act of
534534 sexually explicit conduct, including a virtually
535535 indistinguishable depiction.
536536 (14) SEXUALLY EXPLICIT CONDUCT. Actual or simulated
537537 conduct that includes sadomasochistic abuse, sexual
538538 excitement, sexual intercourse, masturbation, breast nudity,
539539 genital nudity, or other sexual conduct.
540540 (15) VIRTUALLY INDISTINGUISHABLE DEPICTION. A visual
541541 depiction created, altered, or produced by digital, computer
542542 generated, or other means that an ordinary person would
543543 conclude is of an actual individual under 18 years of age
544544 engaged in sexually explicit conduct. "
545545 "§13A-12-191
546546 (a) Any person who shall knowingly disseminate or
547547 display publicly any obscene matter containing a visual
548548 depiction of a person under the age of 17 years engaged in any
549549 act of sado-masochistic abuse, sexual intercourse, sexual
550550 excitement, masturbation, breast nudity, genital nudity, or
551551 other sexual conduct child sexual abuse material shall be
552552 guilty of a Class B felony.
553553 (b) Any person who shall knowingly advertise, promote,
554554 present, distribute, or solicit by any means, including by
555555 computer, any material or purported material in a manner that
556556 reflects the belief, or that is intended to cause another to
557557 believe, that the material or purported material is a visual
558558 depiction of an actual minor engaging in sexually explicit

591591 (a) Any person who knowingly possesses with intent to
592592 disseminate any obscene matter that contains a visual
593593 depiction of a person under the age of 17 years engaged in any
594594 act of sado-masochistic abuse, sexual intercourse, sexual
595595 excitement, masturbation, breast nudity, genital nudity, or
596596 other sexual conduct child sexual abuse material shall be
597597 guilty of a Class B felony. Any transfer of the visual
598598 depiction child sexual abuse material from any electronic
599599 device to any other device, program, application, or any other
600600 place with storage capability which that can be made available
601601 or is accessible by other users, is prima facie evidence of
602602 possession with intent to disseminate.
603603 (b) Any person who knowingly possesses any obscene
604604 matter that contains a visual depiction of a person under the
605605 age of 17 years engaged in any act of sado-masochistic abuse,
606606 sexual intercourse, sexual excitement, masturbation, breast
607607 nudity, genital nudity, or other sexual conduct child sexual
608608 abuse material shall be guilty of a Class C felony."

610610 (a) In proving that a person in a visual depiction who
611611 is engaged in any obscene act set out in Sections 13A-12-191,
612612 13A-12-192, 13A-12-196 and 13A-12-197 is under the age of 17
613613 years, the state is not required to introduce into evidence a
614614 birth certificate, produce testimony as to the date of birth
615615 of such person, or produce testimony of any person who knows
616616 or is acquainted with the person alleged to be under the age

646646 or is acquainted with the person alleged to be under the age
647647 of 17 years. If the defendant or the state intends to rely on
648648 a birth certificate to prove the date of birth of any person
649649 in the visually reproduced matter, such defendant or the state
650650 shall file with the clerk of the court in which the action is
651651 pending, at least 15 days prior to trial, a notice of an
652652 intention to rely on an official, certified copy of a birth
653653 certificate together with a copy of the birth certificate.
654654 (b)(a)A jury, or the court if a jury trial is waived,
655655 The factfinder may infer from the following factors whether or
656656 not the person individual displayed or depicted in any obscene
657657 matter visual depiction is under the age of 17 18 years of
658658 age:
659659 (1) The general body growth and bone structure of the
660660 person;individual.
661661 (2) The development of pubic hair or body hair on the
662662 person;individual.
663663 (3) The development of the person's individual's sexual
664664 organs;.
665665 (4) The context in which the person individual is
666666 placed by any accompanying printed or text material ;.
667667 (5) Any expert testimony as to the degree of maturity
668668 of the personindividual.
669669 (c)(b) The existence of any or all of the factors
670670 listed in subsection (b) of this section (a) shall not operate
671671 to change the requirement that before any conviction may be
672672 had, the state must convince the factfinder beyond a
673673 reasonable doubt that the person individual engaged in the act
674674 of sado-masochistic abuse, sexual intercourse, sexual

709709 (c) It is an affirmative defense to prosecution under
710710 this division if the actual individual purported to be under
711711 18 years of age and engaged in sexually explicit conduct was
712712 an actual individual 18 years of age or older at the time of
713713 the offense."

715715 The state shall not be required to establish the actual
716716 existence or identity, either in the indictment or in any
717717 subsequent proceeding, of the person individual alleged to be
718718 under the age of 17 18 years of age who is engaged in any of
719719 the acts described in Sections 13A-12-191, 13A-12-192,
720720 13A-12-196 and 13A-12-197, which are visual depiction act of
721721 sexually explicit conduct ."

723723 Any parent or guardian who knowingly permits or allows
724724 their child, ward, or dependent under the age of 17 18 years

762762 (a) Any person who knowingly films, prints, records,
763763 photographs, or otherwise produces any obscene matter that
764764 contains a visual depiction of a person under the age of 17
765765 years engaged in any act of sado-masochistic abuse, sexual
766766 intercourse, sexual excitement, masturbation, breast nudity,
767767 genital nudity, or other sexual conduct child sexual abuse
768768 material shall be guilty of a Class A felony.
769769 (b) For any person who violates this section, each
770770 depiction of each individual less than 17 years of age
771771 instance of child sexual abuse material constitutes a separate
772772 offense."
773773 "§13A-12-198
774774 Any article, equipment, machine, materials, matter,
775775 vehicle, or other thing whatsoever used in the commercial
776776 production, transportation, dissemination, display , or storage
777777 of any obscene matter displaying or depicting a person under
778778 the age of 17 years engaged in any of the obscene acts
779779 described in Sections 13A-12-191, 13A-12-192, 13A-12-196 and
780780 13A-12-197 child sexual abuse material shall be contraband and
781781 shall be forfeited to the State of Alabama. The manner,
782782 method, and procedure for the forfeiture and condemnation of
783783 such the thing shall be the same as that provided by law for

839839 Section 4. Civil liability pursuant to Section 2 shall

841841 (1) The full actual damages incurred.
842842 (2) Court costs and reasonable attorney fees.
843843 (3)a. Punitive damages, if the plaintiff proves by
844844 clear and convincing evidence that the defendant consciously
845845 or deliberately engaged in wantonness or malice with regard to
846846 the plaintiff, as defined in Section 6-11-20, Code of Alabama

878878 b. Punitive damages awarded pursuant to paragraph a.
879879 shall consist of up to twenty-five thousand dollars ($25,000)

881881 Section 5. The State Board of Education shall require
882882 each local board of education to do all of the following
883883 before the start of the 2024-2025 school year:
884884 (1) Develop a written policy on student discipline and
885885 education related to the distribution of private images as
886886 defined in Section 13A-6-240, Code of Alabama 1975, and the
887887 distribution, dissemination, public display, advertising,
888888 promoting, presenting, soliciting, possession, possession with
889889 intent to distribute, and production of child sexual abuse
890890 material as defined in Division 4 of Article 4 of Chapter 12
891891 of Title 13A, Code of Alabama 1975.
892892 (2) Include within the written policy a prohibition of
893893 private, explicit, or pornographic images generated with
894894 artificial intelligence.
895895 (3) Broadly disseminate the policy following its
896896 adoption.
897897 (4) Distribute copies of the policy to all teachers,
898898 staff, parents, and students.
899899 Section 6. Section 13A-12-195, Code of Alabama 1975,
900900 relating to the commercial exploitation of obscene material,
901901 is repealed.
902902 Section 7. Although this bill would have as its purpose
903903 or effect the requirement of a new or increased expenditure of
904904 local funds, the bill is excluded from further requirements
905905 and application under Section 111.05 of the Constitution of
906906 Alabama of 2022, because the bill defines a new crime or
