15+SYNOPSIS:
16+Under the existing law, termination dates are
17+established for enumerated state agencies. The agencies
18+are periodically reviewed by the Alabama Sunset
19+Committee. After the review process is completed, the
20+committee prepares its recommendations for the agencies
21+to the Legislature in the form of sunset bills which
22+either continue, terminate, or continue with
23+modification each agency reviewed.
24+This bill would provide for the continuance of
25+the Alabama Onsite Wastewater Board until October 1,
26+2025, with the following changes: To allow an
27+organizational meeting of the board to be considered a
28+regular quarterly meeting of the board.

30+TO BE ENTITLED
31+AN ACT
1632 Relating to the Alabama Sunset Law; to continue the
1733 existence and functioning of the Alabama Onsite Wastewater
1834 Board until October 1, 2025, with certain modifications; to
1935 amend Section 34-21A-4, Code of Alabama 1975, to allow an
2036 organizational meeting of the board to be considered a regular
21-quarterly meeting of the board.
22-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23-Section 1. Pursuant to the Alabama Sunset Law, the
24-sunset committee recommends the continuance of the Alabama
25-Onsite Wastewater Board until October 1, 2025, with the
26-additional recommendation for statutory change as set out in
27-Section 3.
28-Section 2. The existence and functioning of the Alabama
29-Onsite Wastewater Board, created and functioning pursuant to
30-Chapter 21A of Title 34, Code of Alabama 1975, is continued
31-until October 1, 2025, and those code sections are expressly
32-preserved.
33-Section 3. Section 34-21A-4 of the Code of Alabama
34-1975, is amended to read as follows:
35-"§34-21A-4
36-(a) Within 30 days after the annual appointment of new
37-members, the board shall meet for the purpose of organizing,
38-electing new officers, and transacting such business as deemed
39-necessary. This organizational meeting shall not may be
40-considered a regular quarterly meeting of the board.

68+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
69+Section 1. Pursuant to the Alabama Sunset Law, the

7490 meeting. Regular meetings shall be called by the chair who
7591 shall designate the time and place of each regular meeting.
7692 The chair or a majority of the members of the board may also
7793 call a special meeting of the board.
7894 (c) Board members shall be given at least 10 days'
79-notice of regular meetings and a minimum of five days' notice
80-for special meetings. The executive director shall give notice
81-of any meeting to the media as considered appropriate under
82-the circumstances.
83-(d) A quorum of the board shall consist of not less
84-than five of the duly appointed members.
85-(e) Any motion passed by the board requires a majority
86-of those members present.
87-(f) The members of the board shall receive one hundred
88-dollars ($100) per day for board meetings and a per diem as
89-recommended by the board consistent with applicable state laws
90-for attending sessions of the board and for time spent in
91-necessary travel to attend meetings of the board. In addition,
92-each member shall be reimbursed for related travel expenses at
93-the same rate as state employees receive, all to be paid from
94-fees collected and deposited in the board fund."
95-Section 4. The Legislature concurs in the
96-recommendations of the Sunset Committee as provided in
97-Sections 1, 2, and 3.
98-Section 5. This act shall become effective June 1,
