15+SYNOPSIS:
16+This bill would propose an amendment to the
17+Constitution of Alabama of 2022, to define the
18+residential zones from which qualified electors may
19+vote for the St. Clair County Superintendent of
20+Education and the members of the St. Clair County Board
21+of Education and to change the Pell City Board of
22+Education from an elected to an appointed board.

24+TO BE ENTITLED
25+AN ACT
1626 To propose an amendment to the Constitution of Alabama
1727 of 2022, relating to St. Clair County, to add Section 59-5.00
1828 to the Constitution of Alabama of 2022, to define the
1929 residential zones from which qualified electors may vote for
2030 the county superintendent of education and the members of the
2131 county board of education; and to amend Section 59A-2.00 of
2232 the Constitution of Alabama of 2022, to change the Pell City
2333 Board of Education from an elected to an appointed board and
2434 to specify the residential zones from which members may be
2535 appointed.
2636 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
27-Section 1. The following amendment to the Constitution
28-of Alabama of 2022, is proposed:
29- PROPOSED AMENDMENT
30-Section 59-5.00 is added to the Constitution of Alabama
31-of 2022, and Section 59A-2.00 of the Constitution of Alabama
32-of 2022, is amended to read as follows:
33-Section 59-5.00
34-(a) The office of St. Clair County Superintendent of
35-Education, if elected, shall be elected by the qualified
36-electors of St. Clair County who are served by the St. Clair
37-County Board of Education, excluding those qualified electors
38-who reside within the Pell City School Attendance Zone and Tax
39-District established in Section 59-10.21.
40-(b) The members of the St. Clair County Board of
41-Education shall be elected by the qualified electors of St.
42-Clair County who are served by the St. Clair County Board of

66+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
67+Section 1. The following amendment to the Constitution
68+of Alabama of 2022, is proposed:
69+ PROPOSED AMENDMENT
70+Section 59-5.00 is added to the Constitution of Alabama
71+of 2022, and Section 59A-2.00 of the Constitution of Alabama
72+of 2022, is amended to read as follows:
73+Section 59-5.00
74+(a) The office of St. Clair County Superintendent of
75+Education, if elected, shall be elected by the qualified
76+electors of St. Clair County who are served by the St. Clair
77+County Board of Education, excluding those qualified electors
78+who reside within the Pell City School Attendance Zone and Tax
79+District established in Section 59-10.21.
80+(b) The members of the St. Clair County Board of
81+Education shall be elected by the qualified electors of St.
7282 Clair County who are served by the St. Clair County Board of
7383 Education, excluding those qualified electors who reside
7484 within the Pell City School Attendance Zone and Tax District
7585 established in Section 59-10.21.

7787 This legislature may by local act provide for the
7888 election of theCommencing upon the expiration of the terms of
7989 office of the members of the board of education of the City of
8090 Pell City Board of Education in St. Clair County serving on
8191 January 1, 2024, the members of the board shall be appointed
8292 as provided by general law. The appointed members shall be
8393 qualified electors who reside within the Pell City School
8494 Attendance Zone and Tax District established in Section
85-59-10.21, with at least two of those members being appointed
86-from the county portion of the Pell City School Attendance
87-Zone and Tax District ."
88-Upon ratification of this constitutional amendment, the
89-Code Commissioner shall number and place this amendment as
90-appropriate in the constitution omitting this instructional
91-paragraph and may make the following nonsubstantive revisions:
92-change capitalization, hierarchy, spelling, and punctuation
93-for purposes of style and uniformity; correct manifest
94-grammatical, clerical, and typographical errors; revise
95-internal or external citations and cross-references; and
96-translate effective dates.
97-END PROPOSED AMENDMENT
98-Section 2. An election upon the proposed amendment
99-shall be held in accordance with Sections 284, 284.01, and 285
100-of the Constitution of Alabama of 2022, and the election laws

132142 a ballot number for the proposed constitutional amendment on
133143 the election ballot and shall set forth the following
134144 description of the substance or subject matter of the proposed
135145 constitutional amendment:
136146 "Relating to St. Clair County, proposing an amendment
137147 to the Constitution of Alabama of 2022, to specify that only
138148 the qualified electors of St. Clair County who are served by
139149 the St. Clair County Board of Education may vote for the
140150 county superintendent of education and the members of the
141151 county board of education; to change the Pell City Board of
142152 Education from an elected to an appointed board; to specify
143-that the appointed members of the Pell City Board of Education
144-shall be qualified electors who reside within the Pell City
145-School Attendance Zone and Tax District; and to specify that
146-at least two members of the Pell City Board of Education shall
147-reside within the county portion of the Pell City School
148-Attendance Zone and Tax District.
149-Proposed by Act ____."
