15+SYNOPSIS:
16+Under existing law, animals that are killed or
17+otherwise die must be burned or buried within 24 hours
18+of death.
19+This bill would further provide the methods by
20+which these animals may be disposed.
21+A BILL
22+TO BE ENTITLED
23+AN ACT
1624 Relating to animals; to amend Section 3-1-28, Code of
1725 Alabama 1975, to further provide the methods by which dead
1826 animals may be disposed.
1927 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2028 Section 1. Section 3-1-28, Code of Alabama 1975, is
2129 amended to read as follows:
2230 "ยง3-1-28
2331 All owners or custodians of animals which that die or
2432 are killed in their his or her possession or custody, other
2533 than such as are those slaughtered for food, within 24 hours
2634 shall cause the bodies of such animals to be burned or burn,
2735 buried bury at least two feet below the surface of the ground ,
2836 or otherwise dispose of the animals' bodies in accordance with
29-Alabama Department of Agriculture and Industries rules . Hogs
30-dying from cholera or any other disease whatsoever shall be
31-burned. No such animal shall be burned or, buried, or disposed
32-of sufficiently near a residence or residences as to create a
33-nuisance. Any person individual violating this section,
34-whether by failure to burn or, bury, or dispose of an animal,
35-dying or being killed in his possession or by causing the same
36-animal to be burned in such proximity to a dwelling residence
37-or in such other way as to become a nuisance , shall be guilty
38-of a misdemeanor and, on conviction, shall be fined not more
39-than fifty dollars ($50).00."
40-Section 2. This act shall become effective on October
