2424 This bill would allow the Board of Dental
2525 Examiners to enter into the Dentist and Dental
2626 Hygienist Compact by adopting Article 5 of Chapter 9 of
2727 Title 34, Code of Alabama 1975, as a means of providing
2828 uniformity in licensing requirements and interstate
2929 practice throughout party states.

3333 Relating to the Board of Dental Examiners; to add
3434 Article 5 to Chapter 9 of Title 34, Code of Alabama 1975, to
3535 adopt the Dentist and Dental Hygienist Compact.
3636 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3737 Section 1. Article 5 is added to Chapter 9 of Title 34,
3838 Code of Alabama 1975, to read as follows:
3939 ARTICLE 5. DENTIST AND DENTAL HYGIENIST COMPACT.
4040 §34-9-100. Title and Purpose.
4141 This article shall be known and cited as the Dentist
4242 and Dental Hygienist Compact. The purposes of this compact are
4343 to facilitate the interstate practice of dentistry and dental
4444 hygiene and improve public access to dentistry and dental

7474 hygiene and improve public access to dentistry and dental
7575 hygiene services by providing dentists and dental hygienists
7676 licensed in a participating state the ability to practice in
7777 participating states in which they are not licensed. The
7878 compact does this by establishing a pathway for dentists and
7979 dental hygienists licensed in a participating state to obtain
8080 a compact privilege that authorizes them to practice in
8181 another participating state in which they are not licensed.
8282 The compact enables participating states to protect the public
8383 health and safety with respect to the practice of dentists and
8484 dental hygienists, through the state's authority to regulate
8585 the practice of dentistry and dental hygiene in the state. The
8686 compact does all of the following:
8787 (1) Enables dentists and dental hygienists who qualify
8888 for a compact privilege to practice in other participating
8989 states without satisfying burdensome and duplicative
9090 requirements associated with securing a license to practice in
9191 those states.
9292 (2) Promotes mobility and addresses workforce shortages
9393 through each participating state's acceptance of a compact
9494 privilege to practice in that state.
9595 (3) Increases public access to qualified, licensed
9696 dentists and dental hygienists by creating a responsible,
9797 streamlined pathway for licensees to practice in participating
9898 states.
9999 (4) Enhances the ability of participating states to
100100 protect the public's health and safety.
101101 (5) Does not interfere with licensure requirements
102102 established by a participating state.

133133 (6) Facilitates the sharing of licensure and
134134 disciplinary information among participating states.
135135 (7) Requires dentists and dental hygienists who
136136 practice in a participating state pursuant to a compact
137137 privilege to practice within the scope of practice authorized
138138 in that state.
139139 (8) Extends the authority of a participating state to
140140 regulate the practice of dentistry and dental hygiene within
141141 its borders to dentists and dental hygienists who practice in
142142 the state through a compact privilege.
143143 (9) Promotes the cooperation of participating states in
144144 regulating the practice of dentistry and dental hygiene within
145145 those states.
146146 (10) Facilitates the relocation of military members and
147147 their spouses who are licensed to practice dentistry or dental
148148 hygiene.
149149 §34-9-101. Definitions.
150150 As used in this compact, the following terms have the
151151 following meanings:
152152 (1) ACTIVE MILITARY MEMBER. Any individual with
153153 full-time duty status in the Armed Forces of the United
154154 States, including members of the National Guard and Reserve.
155155 (2) ADVERSE ACTION. Disciplinary action or encumbrance
156156 imposed on a license or compact privilege by a state licensing
157157 authority.
158158 (3) ALTERNATIVE PROGRAM. A non-disciplinary monitoring
159159 or practice remediation process applicable to a dentist or
160160 dental hygienist approved by a state licensing authority of a

190190 dental hygienist approved by a state licensing authority of a
191191 participating state in which the dentist or dental hygienist
192192 is licensed. This includes, but is not limited to, programs to
193193 which licensees with substance abuse or addiction issues are
194194 referred in lieu of state action.
195195 (4) CLINICAL ASSESSMENT. Examination or process
196196 required for licensure as a dentist or dental hygienist, as
197197 applicable, that provides evidence of clinical competence in
198198 dentistry or dental hygiene.
199199 (5) COMMISSIONER. The individual appointed by a
200200 participating state to serve as the member of the commission
201201 for that participating state.
202202 (6) COMPACT. The dentist and dental hygienist compact.
203203 (7) COMPACT PRIVILEGE. The authorization granted by a
204204 remote state to allow a licensee from a participating state to
205205 practice as a dentist or dental hygienist in a remote state.
206206 (8) CONTINUING PROFESSIONAL DEVELOPMENT. A requirement,
207207 as a condition of license renewal, to provide evidence of
208208 successful participation in educational or professional
209209 activities relevant to practice or area of work.
210210 (9) CRIMINAL BACKGROUND CHECK. The submission of
211211 fingerprints or other biometric-based information for a
212212 license applicant for the purpose of obtaining that
213213 applicant's criminal history record information, as defined in
214214 28 C.F.R. § 20.3(d) from the Federal Bureau of Investigation
215215 and the state's criminal history record repository as defined
216216 in 28 C.F.R. § 20.3(f).
217217 (10) DATA SYSTEM. The commission's repository of
218218 information about licensees, including, but not limited to,

249249 examination, licensure, investigative, compact privilege,
250250 state action, and alternative program.
251251 (11) DENTAL HYGIENIST. An individual who is licensed by
252252 a state licensing authority to practice dental hygiene.
253253 (12) DENTIST. An individual who is licensed by a state
254254 licensing authority to practice dentistry.
255255 (13) DENTIST AND DENTAL HYGIENIST COMPACT COMMISSION. A
256256 joint government agency established by this compact comprised
257257 of each state that has enacted the compact and a national
258258 administrative body comprised of a commissioner from each
259259 state that has enacted the compact.
260260 (14) ENCUMBERED LICENSE. A license that a state
261261 licensing authority has limited in any way other than through
262262 an alternative program.
263263 (15) EXECUTIVE BOARD. The chair, vice chair, secretary,
264264 and treasurer, and any other commissioners as may be
265265 determined by commission rule or bylaw.
266266 (16) JURISPRUDENCE REQUIREMENT. The assessment of an
267267 individual's knowledge of the laws and rules governing the
268268 practice of dentistry or dental hygiene, as applicable, in a
269269 state.
270270 (17) LICENSE. Current authorization by a state, other
271271 than authorization pursuant to a compact privilege, or other
272272 privilege, for an individual to practice as a dentist or
273273 dental hygienist in that state.
274274 (18) LICENSEE. An individual who holds an unrestricted
275275 license from a participating state to practice as a dentist or
276276 dental hygienist in that state.

307307 (19) MODEL COMPACT. The model for the Dentist and
308308 Dental Hygienist Compact on file with the Council of State
309309 Governments or other entity as designated by the commission.
310310 (20) PARTICIPATING STATE. A state that has enacted the
311311 compact and been admitted to the commission in accordance with
312312 the provisions in this compact and commission rules.
313313 (21) QUALIFYING LICENSE. A license that is not an
314314 encumbered license issued by a participating state to practice
315315 dentistry or dental hygiene.
316316 (22) REMOTE STATE. A participating state where a
317317 licensee who is not licensed as a dentist or dental hygienist
318318 is exercising or seeking to exercise the compact privilege.
319319 (23) RULE. A regulation adopted by an entity that has
320320 the force of law.
321321 (24) SCOPE OF PRACTICE. The procedures, actions, and
322322 processes a dentist or dental hygienist licensed in a state is
323323 permitted to undertake in that state and the circumstances
324324 under which the licensee is permitted to undertake those
325325 procedures, actions, and processes. The procedures, actions,
326326 and processes and the circumstances under which they may be
327327 undertaken may be established through means, including, but
328328 not limited to, statute, rules, case law, and other processes
329329 available to the state licensing authority or other government
330330 agency.
331331 (25) SIGNIFICANT INVESTIGATIVE INFORMATION.
332332 Information, records, and documents received or generated by a
333333 state licensing authority pursuant to an investigation for

364364 which a determination has been made that there is probable
365365 cause to believe that the licensee has violated a statute or
366366 rule that is considered more than a minor infraction for which
367367 the state licensing authority could pursue state action
368368 against the licensee.
369369 (26) STATE. Any state, commonwealth, district, or
370370 territory of the United States of America that regulates the
371371 practices of dentistry and dental hygiene.
372372 (27) STATE LICENSING AUTHORITY. An agency or other
373373 entity of a state that is responsible for the licensing and
374374 regulation of dentists or dental hygienists.
375375 §34-9-102. State Participation in the Compact.
376376 (a) In order to join the compact and thereafter
377377 continue as a participating state, a state must do all of the
378378 following:
379379 (1) Enact a compact that is not materially different
380380 from the model compact as determined in accordance with
381381 commission rules.
382382 (2) Participate fully in the commission's data system.
383383 (3) Have a mechanism in place for receiving and
384384 investigating complaints about its licensees and license
385385 applicants.
386386 (4) Notify the commission, in compliance with the terms
387387 of the compact and commission rules, of any state action or
388388 the availability of significant investigative information
389389 regarding a licensee and license applicant.
390390 (5) Fully implement a criminal background check
391391 requirement, within a time frame established by commission
392392 rule, by receiving the results of a qualifying criminal

422422 rule, by receiving the results of a qualifying criminal
423423 background check.
424424 (6) Comply with the commission rules applicable to a
425425 participating state.
426426 (7) Accept the National Board Examinations of the Joint
427427 Commission on National Dental Examinations or another
428428 examination accepted by commission rule as a licensure
429429 examination.
430430 (8) Accept for licensure that applicants for a dentist
431431 license graduate from a predoctoral dental education program
432432 accredited by the Commission on Dental Accreditation, or
433433 another accrediting agency recognized by the United states
434434 Department of Education for the accreditation of dentistry and
435435 dental hygiene education programs, leading to the Doctor of
436436 Dental Surgery (D.D.S.) or Doctor of Dental Medicine (D.M.D.)
437437 degree.
438438 (9) Accept for licensure that applicants for a dental
439439 hygienist license graduate from a dental hygiene education
440440 program accredited by the Commission on Dental Accreditation
441441 or another accrediting agency recognized by the United states
442442 Department of Education for the accreditation of dentistry and
443443 dental hygiene education programs.
444444 (10) Require for licensure that applicants successfully
445445 complete a clinical assessment.
446446 (11) Have continuing professional development
447447 requirements as a condition for license renewal.
448448 (12) Pay a participation fee to the commission as
449449 established by commission rule.
450450 (b) A state is not disqualified from participating in

480480 (b) A state is not disqualified from participating in
481481 the compact by providing alternative pathways for an
482482 individual to obtain an unrestricted license.
483483 (c) When conducting a criminal background check the
484484 state licensing authority shall do all of the following:
485485 (1) Consider the information disclosed in the criminal
486486 background check in making a licensure decision.
487487 (2) Maintain documentation of completion of the
488488 criminal background check and background check information to
489489 the extent allowed by state and federal law.
490490 (3) Report to the commission whether it has completed
491491 the criminal background check and whether the individual was
492492 granted or denied a license.
493493 (d) A licensee of a participating state, who has a
494494 qualifying license in that state and does not hold an
495495 encumbered license in any other participating state, shall be
496496 issued a compact privilege in a remote state in accordance
497497 with the terms of the compact and commission rules. If a
498498 remote state has a jurisprudence requirement, a compact
499499 privilege will not be issued to the licensee unless the
500500 licensee has satisfied the jurisprudence requirement.
501501 §34-9-103. Compact Privilege.
502502 (a) To obtain and exercise the compact privilege under
503503 the terms and provisions of the compact, the licensee must do
504504 all of the following:
505505 (1) Possess a qualifying license as a dentist or dental
506506 hygienist in a participating state.
507507 (2) Be eligible for a compact privilege in any remote
508508 state in accordance with subsections (d), (g), and (h).

539539 (3) Submit to an application process whenever the
540540 licensee is seeking a compact privilege.
541541 (4) Pay any applicable commission and remote state fees
542542 for a compact privilege in the remote state.
543543 (5) Meet any jurisprudence requirement established by a
544544 remote state in which the licensee is seeking a compact
545545 privilege.
546546 (6) Pass a National Board Examination of the Joint
547547 Commission on National Dental Examinations or another
548548 examination accepted by commission rule.
549549 (7) For a dentist, be a graduate from a predoctoral
550550 dental education program accredited by the Commission on
551551 Dental Accreditation, or another accrediting agency recognized
552552 by the United States Department of Education for the
553553 accreditation of dentistry and dental hygiene education
554554 programs, leading to the Doctor of Dental Surgery (D.D.S.) or
555555 Doctor of Dental Medicine (D.M.D.) degree.
556556 (8) For a dental hygienist, be a graduate from a dental
557557 hygiene education program accredited by the Commission on
558558 Dental Accreditation or another accrediting agency recognized
559559 by the United States Department of Education for the
560560 accreditation of dentistry and dental hygiene education
561561 programs.
562562 (9) Successfully complete a clinical assessment for
563563 licensure.
564564 (10) Report to the commission state action taken by any
565565 non-participating state when applying for a compact privilege
566566 and, otherwise, within 30 days from the date the state action

596596 and, otherwise, within 30 days from the date the state action
597597 is taken.
598598 (11) Report to the commission when applying for a
599599 compact privilege the address of the licensee's primary
600600 residence and thereafter immediately report to the commission
601601 any change in the address of the licensee's primary residence.
602602 (12) Consent to accept service of process by mail at
603603 the licensee's primary residence on record with the commission
604604 with respect to any action brought against the licensee by the
605605 commission or a participating state, and consent to accept
606606 service of a subpoena by mail at the licensee's primary
607607 residence on record with the commission with respect to any
608608 action brought or investigation conducted by the commission or
609609 a participating state.
610610 (b) The licensee must comply with the requirements of
611611 subsection (a) to maintain the compact privilege in the remote
612612 state. If those requirements are met, the compact privilege
613613 will continue as long as the licensee maintains a qualifying
614614 license in the state through which the licensee applied for
615615 the compact privilege and pays any applicable compact
616616 privilege renewal fees.
617617 (c) A licensee providing dentistry or dental hygiene in
618618 a remote state under the compact privilege shall function
619619 within the scope of practice authorized by the remote state
620620 for a dentist or dental hygienist licensed in that state.
621621 (d) A licensee providing dentistry or dental hygiene
622622 pursuant to a compact privilege in a remote state is subject
623623 to that state's regulatory authority. A remote state, in
624624 accordance with due process and that state's laws, may by

654654 accordance with due process and that state's laws, may by
655655 state action revoke or remove a licensee's compact privilege
656656 in the remote state for a specific period of time and impose
657657 fines or take any other necessary actions to protect the
658658 health and safety of its citizens. If a remote state imposes a
659659 state action against a compact privilege that limits the
660660 compact privilege, that state action applies to all compact
661661 privileges in all remote states. A licensee whose compact
662662 privilege in a remote state is removed for a specified period
663663 of time is not eligible for a compact privilege in any other
664664 remote state until the specific time for removal of the
665665 compact privilege has passed and all encumbrance requirements
666666 are satisfied.
667667 (e) If a license in a participating state is an
668668 encumbered license, the licensee shall lose the compact
669669 privilege in a remote state and shall not be eligible for a
670670 compact privilege in any remote state until the license is no
671671 longer encumbered.
672672 (f) Once an encumbered license in a participating state
673673 is restored to good standing, the licensee must meet the
674674 requirements of subsection (a) to obtain a compact privilege
675675 in a remote state.
676676 (g) If a licensee's compact privilege in a remote state
677677 is removed by the remote state, the individual shall lose or
678678 be ineligible for the compact privilege in any remote state
679679 until both of the following occur:
680680 (1) The specific period of time for which the compact
681681 privilege was removed has ended.
682682 (2) All conditions for removal of the compact privilege

712712 (2) All conditions for removal of the compact privilege
713713 have been satisfied.
714714 (h) Once the requirements of subsection (g) have been
715715 met, the licensee must meet the requirements in subsection (a)
716716 to obtain a compact privilege in a remote state.
717717 §34-9-104. Active Military Member or Their Spouse.
718718 An active military member or his or her spouse shall
719719 not be required to pay to the commission for a compact
720720 privilege the fee otherwise charged by the commission. If a
721721 remote state chooses to charge a fee for a compact privilege,
722722 the state may choose to charge a reduced fee or no fee to an
723723 active military member or his or her spouse for a compact
724724 privilege.
725725 §34-9-105. State Actions.
726726 (a) A participating state in which a licensee is
727727 licensed shall have exclusive authority to impose state action
728728 against the qualifying license issued by that participating
729729 state.
730730 (b) A participating state may take state action based
731731 on the significant investigative information of a remote
732732 state, so long as the participating state follows its own
733733 procedures for imposing state action.
734734 (c) Nothing in this compact shall override a
735735 participating state's decision that participation in an
736736 alternative program may be used in lieu of state action and
737737 that such participation shall remain non-public if required by
738738 the participating state's laws. Participating states must
739739 require licensees who enter any alternative program in lieu of

770770 discipline to agree not to practice pursuant to a compact
771771 privilege in any other participating state during the term of
772772 the alternative program without prior authorization from the
773773 other participating state.
774774 (d) Any participating state in which a licensee is
775775 applying to practice or is practicing pursuant to a compact
776776 privilege may investigate actual or alleged violations of the
777777 statutes and rules authorizing the practice of dentistry or
778778 dental hygiene in any other participating state in which the
779779 dentist or dental hygienist holds a license or compact
780780 privilege.
781781 (e) A remote state shall have the authority to do all
782782 of the following:
783783 (1) Take state actions as set forth in Section
784784 34-9-103(d) against a licensee's compact privilege in the
785785 state.
786786 (2) In furtherance of its rights and responsibilities
787787 under the compact and the commission's rules, the remote state
788788 may issue subpoenas for both hearings and investigations that
789789 require the attendance and testimony of witnesses, and the
790790 production of evidence. Subpoenas issued by a state licensing
791791 authority in a participating state for the attendance and
792792 testimony of witnesses, or the production of evidence from
793793 another participating state, shall be enforced in the latter
794794 state by any court of competent jurisdiction, according to the
795795 practice and procedure of that court applicable to subpoenas
796796 issued in proceedings pending before it. The issuing authority
797797 shall pay any witness fees, travel expenses, mileage, and
798798 other fees required by the service statutes of the state where

830830 (3) If otherwise permitted by state law, the remote
831831 state may recover from the licensee the costs of
832832 investigations and disposition of cases resulting from any
833833 state action taken against that licensee.
834834 (f) Joint investigations.
835835 (1) In addition to the authority granted to a
836836 participating state by its dentist or dental hygienist
837837 licensure act or other applicable state law, a participating
838838 state may jointly investigate licensees with other
839839 participating states.
840840 (2) Participating states shall share any significant
841841 investigative information, litigation, or compliance materials
842842 in furtherance of any joint or individual investigation
843843 initiated under the compact.
844844 (g) Authority to continue investigation.
845845 (1) After a licensee's compact privilege in a remote
846846 state is terminated, the remote state may continue an
847847 investigation of the licensee that began when the licensee had
848848 a compact privilege in that remote state.
849849 (2) If the investigation yields what would be
850850 significant investigative information had the licensee
851851 continued to have a compact privilege in that remote state,
852852 the remote state shall report the presence of such information
853853 to the data system as required by Section 34-9-107(b)(6) as if
854854 it was significant investigative information.
855855 §34-9-106. Establishment and Operation of the

887887 (a) The compact participating states hereby create and
888888 establish a joint government agency whose membership consists
889889 of all participating states that have enacted the compact. The
890890 commission is an instrumentality of the participating states
891891 acting jointly and not an instrumentality of any one state.
892892 The commission shall come into existence on or after the
893893 effective date of the compact as set forth in Section
894894 34-9-110(a).
895895 (b) Participation, voting, and meetings.
896896 (1) Each participating state shall have and be limited
897897 to one commissioner selected by that participating state's
898898 state licensing authority or, if the state has more than one
899899 state licensing authority, selected collectively by the state
900900 licensing authorities.
901901 (2) The commissioner shall be a member or designee of
902902 the authority or authorities.
903903 (3) The commission may by rule or bylaw establish a
904904 term of office for commissioners and may by rule or bylaw
905905 establish term limits.
906906 (4) The commission may recommend to a state licensing
907907 authority or authorities, as applicable, removal or suspension
908908 of an individual as the state's commissioner.
909909 (5) A participating state's state licensing authority
910910 or authorities, as applicable, shall fill any vacancy of its
911911 commissioner on the commission within 60 days of the vacancy.
912912 (6) Each commissioner shall be entitled to one vote on
913913 all matters that are voted upon by the commission.
914914 (7) The commission shall meet at least once during each

944944 (7) The commission shall meet at least once during each

946946 the bylaws. The commission may meet by telecommunication,
947947 video conference, or other similar electronic means.
948948 (c) The commission shall have the power to do all of
949949 the following:
950950 (1) Establish the fiscal year of the commission.
951951 (2) Establish a code of conduct and conflict of
952952 interest policies.
953953 (3) Adopt rules and bylaws.
954954 (4) Maintain its financial records in accordance with
955955 the bylaws.
956956 (5) Meet and take actions as are consistent with the
957957 provisions of this compact, the commission's rules, and the
958958 bylaws.
959959 (6) Initiate and conclude legal proceedings or actions
960960 in the name of the commission, provided that the standing of
961961 any state licensing authority to sue or be sued under
962962 applicable law shall not be affected.
963963 (7) Maintain and certify records and information
964964 provided to a participating state as the authenticated
965965 business records of the commission, and designate a person to
966966 do so on the commission's behalf.
967967 (8) Purchase and maintain insurance and bonds.
968968 (9) Borrow, accept, or contract for services of
969969 personnel, including, but not limited to, employees of a
970970 participating state.
971971 (10) Conduct an annual financial review.
972972 (11) Hire employees, elect or appoint officers, fix

10021002 (11) Hire employees, elect or appoint officers, fix

10061006 programs relating to conflicts of interest, qualifications of
10071007 personnel, and other related personnel matters.
10081008 (12) As set forth in the commission rules, charge a fee
10091009 to a licensee for the grant of a compact privilege in a remote
10101010 state and thereafter, as may be established by commission
10111011 rule, charge the licensee a compact privilege renewal fee for
10121012 each renewal period in which that licensee exercises or
10131013 intends to exercise the compact privilege in that remote
10141014 state. Nothing in this subdivision shall be construed to
10151015 prevent a remote state from charging a licensee a fee for a
10161016 compact privilege or renewals of a compact privilege, or a fee
10171017 for the jurisprudence requirement if the remote state imposes
10181018 such a requirement for the grant of a compact privilege.
10191019 (13) Accept any and all appropriate gifts, donations,
10201020 grants of money, other sources of revenue, equipment,
10211021 supplies, materials, and services, and receive, utilize, and
10221022 dispose of the same; provided that at all times the commission
10231023 shall avoid any appearance of impropriety conflict of
10241024 interest.
10251025 (14) Lease, purchase, retain, own, hold, improve, or
10261026 use any property, real, personal, or mixed, or any undivided
10271027 interest therein.
10281028 (15) Sell, convey, mortgage, pledge, lease, exchange,
10291029 abandon, or otherwise dispose of any property real, personal,
10301030 or mixed.

10791079 (24) Perform any other functions that may be necessary
10801080 or appropriate to achieve the purposes of this compact.
10811081 (d) Meetings of the commission.
10821082 (1) All meetings of the commission that are not closed
10831083 pursuant to this subsection shall be open to the public.
10841084 Notice of public meetings shall be posted on the commission's
10851085 website at least 30 days prior to the public meeting.
10861086 (2) Notwithstanding subsection (d)(1), the commission
10871087 may convene an emergency public meeting by providing at least
10881088 24-hour prior notice on the commission's website, and any

11241124 (3) Notice of all commission meetings shall provide the

11301130 (4) The commission may convene in a closed, non-public

11331133 a. Non-compliance of a participating state with its
11341134 obligations under the compact.
11351135 b. The employment, compensation, discipline, or other
11361136 matters, practices, or procedures related to specific
11371137 employees or other matters related to the commission's
11381138 internal personnel practices and procedures.
11391139 c. Current or threatened discipline of a licensee or
11401140 compact privilege holder by the commission or by a
11411141 participating state's licensing authority.
11421142 d. Current, threatened, or reasonably anticipated
11431143 litigation.
11441144 e. Negotiation of contracts for the purchase, lease, or
11451145 sale of goods, services, or real estate.

11941194 the presiding officer shall state that the meeting will be
11951195 closed and reference each relevant exempting provision, and
11961196 that reference shall be recorded in the minutes.
11971197 (6) The commission shall keep minutes that fully and
11981198 clearly describe all matters discussed in a meeting and shall
11991199 provide a full and accurate summary of actions taken, and the
12001200 reasons supporting the actions taken, including a description
12011201 of the views expressed. All documents considered in connection
12021202 with an action shall be identified in the minutes. All minutes
12031203 and documents of a closed meeting shall remain under seal,

12361236 (e) Financing of the commission.
12371237 (1) The commission shall pay, or provide for the
12381238 payment of, the reasonable expenses of its establishment,
12391239 organization, and ongoing activities.
12401240 (2) The commission may accept all appropriate sources
12411241 of revenue, donations, grants of money, equipment, supplies,
12421242 materials, and services.
12431243 (3) The commission may levy on and collect an annual
12441244 assessment from each participating state and impose fees on
12451245 licensees of participating states when a compact privilege is
12461246 granted, to cover the cost of the operations and activities of
12471247 the commission and its staff, which must be in a total amount
12481248 sufficient to cover its annual budget as approved each fiscal
12491249 year for which sufficient revenue is not provided by other
12501250 sources. The aggregate annual assessment amount for
12511251 participating states shall be allocated based upon a formula
12521252 that the commission shall adopt by rule.
12531253 (4) The commission shall not incur obligations of any
12541254 kind prior to securing the funds adequate to meet those
12551255 obligations; nor shall the commission pledge the credit of any
12561256 participating state, except by and with the authority of the
12571257 participating state.
12581258 (5) The commission shall keep accurate accounts of all
12591259 receipts and disbursements. The receipts and disbursements of
12601260 the commission shall be subject to the financial review and
12611261 accounting procedures established under its bylaws. All

12971297 (f) The executive board.
12981298 (1) The executive board shall have the power to act on
12991299 behalf of the commission according to the terms of this
13001300 compact. The powers, duties, and responsibilities of the
13011301 executive board shall include all of the following:
13021302 a. Overseeing the day-to-day activities of the
13031303 administration of the compact, including compliance with the
13041304 provisions of the compact and the commission's rules and
13051305 bylaws.
13061306 b. Recommending to the commission changes to the rules
13071307 or bylaws, changes to this compact legislation, fees charged
13081308 to compact participating states, fees charged to licensees,
13091309 and other fees.
13101310 c. Ensuring compact administration services are
13111311 appropriately provided, including by contract.
13121312 d. Preparing and recommending the budget.
13131313 e. Maintaining financial records on behalf of the
13141314 commission.
13151315 f. Monitoring compact compliance of participating
13161316 states and providing compliance reports to the commission.
13171317 g. Establishing additional committees as necessary.
13181318 h. Exercising the powers and duties of the commission
13191319 during the interim between commission meetings, except for
13201320 adopting or amending rules, adopting or amending bylaws, and

13611361 b. Other than the chair, vice chair, secretary, and
13621362 treasurer, the commission may elect up to three voting members
13631363 from the current membership of the commission.
13641364 (3) The commission may remove any member of the
13651365 executive board as provided in the commission's bylaws.
13661366 (4) The executive board shall meet at least annually.
13671367 a. An executive board meeting at which it takes or
13681368 intends to take formal action on a matter shall be open to the
13691369 public, except that the executive board may meet in a closed,
13701370 non-public session of a public meeting when dealing with any
13711371 of the matters covered under subdivision (d)(4).
13721372 b. The executive board shall give five business days'
13731373 notice of its public meetings, posted on its website and as it
13741374 may otherwise determine to provide notice to persons with an
13751375 interest in the public matters the executive board intends to
13761376 address at those meetings.
13771377 (5) The executive board may hold an emergency meeting

14151415 (g) Qualified immunity, defense, and indemnification.
14161416 (1) The members, officers, executive director,
14171417 employees, and representatives of the commission shall be
14181418 immune from suit and liability, both personally and in their
14191419 official capacity, for any claim for damage to or loss of
14201420 property or personal injury or other civil liability caused by
14211421 or arising out of any actual or alleged act, error, or
14221422 omission that occurred, or that the individual against whom
14231423 the claim is made had a reasonable basis for believing
14241424 occurred within the scope of commission employment, duties, or
14251425 responsibilities; provided that nothing in this subdivision
14261426 shall be construed to protect any individual from suit or
14271427 liability for any damage, loss, injury, or liability caused by
14281428 the intentional, willful, or wanton misconduct of that
14291429 individual. The procurement of insurance of any type by the
14301430 commission shall not in any way compromise or limit the
14311431 immunity granted under this subdivision.
14321432 (2) The commission shall defend any member, officer,
14331433 executive director, employee, and representative of the
14341434 commission in any civil action seeking to impose liability
14351435 arising out of any actual or alleged act, error, or omission

14761476 (3) Notwithstanding subdivision (1), should any member,
14771477 officer, executive director, employee, or representative of
14781478 the commission be held liable for the amount of any settlement
14791479 or judgment arising out of any actual or alleged act, error,
14801480 or omission that occurred within the scope of that
14811481 individual's employment, duties, or responsibilities for the
14821482 commission, or that the individual to whom that individual is
14831483 liable had a reasonable basis for believing occurred within
14841484 the scope of the individual's employment, duties, or
14851485 responsibilities for the commission, the commission shall
14861486 indemnify and hold harmless the individual, provided that the
14871487 actual or alleged act, error, or omission did not result from
14881488 the intentional, willful, or wanton misconduct of the
14891489 individual.
14901490 (4) Nothing in this subdivision shall be construed as a
14911491 limitation on the liability of any licensee for professional
14921492 malpractice or misconduct, which shall be governed solely by
14931493 any other applicable state laws.

15271527 respect to antitrust claims under the Sherman Act, Clayton

15291529 anticompetitive law or regulation.
15301530 (6) Nothing in this compact shall be construed to be a
15311531 waiver of sovereign immunity by the participating states or by
15321532 the commission.
15331533 §34-9-107. Data System.
15341534 (a) The commission shall provide for the development,
15351535 maintenance, operation, and utilization of a coordinated
15361536 database and reporting system containing licensure, state
15371537 action, and the presence of significant investigative
15381538 information on all licensees and applicants for a license in
15391539 participating states.
15401540 (b) Notwithstanding any other provision of state law to
15411541 the contrary, a participating state shall submit a uniform
15421542 data set to the data system on all individuals to whom this
15431543 compact is applicable as required by the rules of the
15441544 commission, including all of the following:
15451545 (1) Identifying information.
15461546 (2) Licensure data.
15471547 (3) State actions against a licensee, license
15481548 applicant, or compact privilege and information related
15491549 thereto.
15501550 (4) Non-confidential information related to alternative
15511551 program participation, the beginning and ending dates of
15521552 participation in the program, and other information related to

15911591 public, as determined by the rules of the commission.
15921592 (c) The records and information provided to a
15931593 participating state pursuant to this compact or through the
15941594 data system, when certified by the commission or an agent of
15951595 the commission shall constitute the authenticated business
15961596 records of the commission, and shall be entitled to any
15971597 associated hearsay exception in any relevant judicial,
15981598 quasi-judicial, or administrative proceedings in a
15991599 participating state.
16001600 (d) Significant investigative information pertaining to
16011601 a licensee in any participating state will only be available
16021602 to other participating states.
16031603 (e) It is the responsibility of the participating
16041604 states to monitor the database to determine whether state
16051605 action has been taken against a licensee or license applicant.
16061606 State action information pertaining to a licensee or license
16071607 applicant in any participating state will be available to any
16081608 other participating state.
16091609 (f) Participating states contributing information to
16101610 the data system may designate information that may not be

16431643 (g) Any information submitted to the data system that
16441644 is subsequently expunged pursuant to federal law or the laws
16451645 of the participating state contributing the information shall
16461646 be removed from the data system.
16471647 §34-9-108. Rulemaking.
16481648 (a) The commission shall adopt reasonable rules in
16491649 order to effectively and efficiently implement and administer
16501650 the purposes and provisions of the compact. A commission rule
16511651 shall be invalid and have no force or effect only if a court
16521652 of competent jurisdiction holds that the rule is invalid
16531653 because the commission exercised its rulemaking authority in a
16541654 manner that is beyond the scope and purposes of the compact,
16551655 or the powers granted hereunder, or based upon another
16561656 applicable standard of review.
16571657 (b) The rules of the commission shall have the force of
16581658 law in each participating state; provided, however, that where
16591659 the rules of the commission conflict with the laws of the
16601660 participating state that establish the participating state's
16611661 scope of practice as held by a court of competent
16621662 jurisdiction, the rules of the commission shall be ineffective
16631663 in that state to the extent of the conflict.
16641664 (c) The commission shall exercise its rulemaking powers
16651665 pursuant to the criteria set forth in this section and the
16661666 rules adopted thereunder. Rules shall become binding as of the
16671667 date specified by the commission for each rule.

16981698 (d) If a majority of the Legislatures of the
16991699 participating states rejects a commission rule or portion of a
17001700 commission rule, by enactment of a statute or resolution in
17011701 the same manner used to adopt the compact, within four years
17021702 of the date of adoption of the rule, then the rule shall have
17031703 no further force and effect in any participating state or to
17041704 any state applying to participate in the compact.
17051705 (e) Rules shall be adopted at a regular or special
17061706 meeting of the commission.
17071707 (f) Prior to adoption of a proposed rule, the
17081708 commission shall hold a public hearing and allow persons to
17091709 provide oral and written comments, data, facts, opinions, and
17101710 arguments.
17111711 (g) Prior to adoption of a proposed rule by the
17121712 commission, and at least 30 days in advance of the meeting at
17131713 which the commission will hold a public hearing on the
17141714 proposed rule, the commission shall provide a notice of
17151715 proposed rulemaking by all of the following:
17161716 (1) On the website of the commission or other publicly
17171717 accessible platform.
17181718 (2) To persons who have requested notice of the
17191719 commission's notices of proposed rulemaking.
17201720 (3) In other ways as the commission may by rule
17211721 specify.
17221722 (h) The notice of proposed rulemaking shall include all
17231723 of the following:
17241724 (1) The time, date, and location of the public hearing
17251725 at which the commission will hear public comments on the
17261726 proposed rule and, if different, the time, date, and location

17591759 (2) If the hearing is held via telecommunication, video
17601760 conference, or other electronic means, the commission shall
17611761 include the mechanism for access to the hearing in the notice
17621762 of proposed rulemaking.
17631763 (3) The text of the proposed rule and the reason for
17641764 its proposal.
17651765 (4) A request for comments on the proposed rule from
17661766 any interested person.
17671767 (5) The manner in which interested persons may submit
17681768 written comments.
17691769 (i) All hearings will be recorded. A copy of the
17701770 recording and all written comments and documents received by
17711771 the commission in response to the proposed rule shall be
17721772 available to the public.
17731773 (j) Nothing in this section shall be construed as
17741774 requiring a separate hearing on each commission rule. Rules
17751775 may be grouped for the convenience of the commission at
17761776 hearings required by this section.
17771777 (k) The commission, by majority vote of all
17781778 commissioners, shall take final action on the proposed rule
17791779 based on the rulemaking record.
17801780 (1) The commission may adopt changes to the proposed
17811781 rule provided the changes do not enlarge the original purpose
17821782 of the proposed rule.
17831783 (2) The commission shall provide an explanation of the
17841784 reasons for substantive changes made to the proposed rule as

18141814 reasons for substantive changes made to the proposed rule as
18151815 well as reasons for substantive changes not made that were
18161816 recommended by commenters.
18171817 (3) The commission shall determine a reasonable
18181818 effective date for the rule. Except for an emergency as
18191819 provided in subsection (l), the effective date of the rule
18201820 shall be no sooner than 30 days after the commission issuing
18211821 the notice that it adopted or amended the rule.
18221822 (l) Upon determination that an emergency exists, the
18231823 commission may consider and adopt an emergency rule with 24-
18241824 hours' notice, with opportunity to comment, provided that the
18251825 usual rulemaking procedures provided in the compact and in
18261826 this section shall be retroactively applied to the rule as
18271827 soon as reasonably possible, in no event later than 90 days
18281828 after the effective date of the rule. For the purposes of this
18291829 provision, an emergency rule is one that must be adopted
18301830 immediately in order to do any of the following:
18311831 (1) Meet an imminent threat to public health, safety,
18321832 or welfare.
18331833 (2) Prevent a loss of commission or participating state
18341834 funds.
18351835 (3) Meet a deadline for the adoption of a rule that is
18361836 established by federal law or rule.
18371837 (4) Protect public health and safety.
18381838 (m) The commission or an authorized committee of the
18391839 commission may direct revisions to a previously adopted rule
18401840 for purposes of correcting typographical errors, errors in
18411841 format, errors in consistency, or grammatical errors. Public
18421842 notice of any revisions shall be posted on the website of the

18721872 notice of any revisions shall be posted on the website of the
18731873 commission. The revision shall be subject to challenge by any
18741874 individual for a period of 30 days after posting. The revision
18751875 may be challenged only on grounds that the revision results in
18761876 a material change to a rule. A challenge shall be made in
18771877 writing and delivered to the commission prior to the end of
18781878 the notice period. If no challenge is made, the revision will
18791879 take effect without further action. If the revision is
18801880 challenged, the revision may not take effect without the
18811881 approval of the commission.
18821882 (n) No participating state's rulemaking requirements
18831883 shall apply under this compact.
18841884 §34-9-109. Oversight, Dispute Resolution, and
18851885 Enforcement.
18861886 (a) Oversight.
18871887 (1) The executive and judicial branches of state
18881888 government in each participating state shall enforce this
18891889 compact and take all actions necessary and appropriate to
18901890 implement the compact.
18911891 (2) Venue is proper and judicial proceedings by or
18921892 against the commission shall be brought solely and exclusively
18931893 in a court of competent jurisdiction where the principal
18941894 office of the commission is located. The commission may waive
18951895 venue and jurisdictional defenses to the extent it adopts or
18961896 consents to participate in alternative dispute resolution
18971897 proceedings. Nothing in this subdivision shall affect or limit
18981898 the selection or propriety of venue in any action against a
18991899 licensee for professional malpractice, misconduct, or any
19001900 similar matter.

19311931 (3) The commission shall be entitled to receive service
19321932 of process in any proceeding regarding the enforcement or
19331933 interpretation of the compact or commission rule and shall
19341934 have standing to intervene in a proceeding for all purposes.
19351935 Failure to provide the commission service of process shall
19361936 render a judgment or order void as to the commission, this
19371937 compact, or adopted rules.
19381938 (b) Default, technical assistance, and termination.
19391939 (1) If the commission determines that a participating
19401940 state has defaulted in the performance of its obligations or
19411941 responsibilities under this compact or the adopted rules, the
19421942 commission shall provide written notice to the defaulting
19431943 state. The notice of default shall describe the default, the
19441944 proposed means of curing the default, and any other action
19451945 that the commission may take, and shall offer training and
19461946 specific technical assistance regarding the default.
19471947 (2) The commission shall provide a copy of the notice
19481948 of default to the other participating states.
19491949 (c) If a state in default fails to cure the default,
19501950 the defaulting state may be terminated from the compact upon
19511951 an affirmative vote of a majority of the commissioners, and
19521952 all rights, privileges, and benefits conferred on that state
19531953 by this compact may be terminated on the effective date of
19541954 termination. A cure of the default does not relieve the
19551955 offending state of obligations or liabilities incurred during
19561956 the period of default.
19571957 (d) Termination of participation in the compact shall
19581958 be imposed only after all other means of securing compliance

19891989 have been exhausted. Notice of intent to suspend or terminate
19901990 shall be given by the commission to the Governor, the majority
19911991 and minority leaders of the defaulting state's Legislature,
19921992 the defaulting state's state licensing authority or
19931993 authorities, as applicable, and each of the participating
19941994 states' state licensing authority or authorities, as
19951995 applicable.
19961996 (e) A state that has been terminated is responsible for
19971997 all assessments, obligations, and liabilities incurred through
19981998 the effective date of termination, including obligations that
19991999 extend beyond the effective date of termination.
20002000 (f) Upon the termination of a state's participation in
20012001 this compact, that state shall immediately provide notice to
20022002 all licensees of the state, including licensees of other
20032003 participating states issued a compact privilege to practice
20042004 within that state, of such termination. The terminated state
20052005 shall continue to recognize all compact privileges then in
20062006 effect in that state for a minimum of 180 days after the date
20072007 of said notice of termination.
20082008 (g) The commission shall not bear any costs related to
20092009 a state that is found to be in default or that has been
20102010 terminated from the compact, unless agreed upon in writing
20112011 between the commission and the defaulting state.
20122012 (h) The defaulting state may appeal the action of the
20132013 commission by petitioning the U.S. District Court for the
20142014 District of Columbia or the federal district where the
20152015 commission has its principal offices. The prevailing party
20162016 shall be awarded all costs of such litigation, including

20482048 (i) Dispute resolution.
20492049 (1) Upon request by a participating state, the
20502050 commission shall attempt to resolve disputes related to the
20512051 compact that arise among participating states and between
20522052 participating states and non-participating states.
20532053 (2) The commission shall adopt a rule providing for
20542054 both mediation and binding dispute resolution for disputes as
20552055 appropriate.
20562056 (j) Enforcement.
20572057 (1) The commission, in the reasonable exercise of its
20582058 discretion, shall enforce the provisions of this compact and
20592059 the commission's rules.
20602060 (2) By majority vote, the commission may initiate legal
20612061 action against a participating state in default in the U.S.
20622062 District Court for the District of Columbia or the federal
20632063 district where the commission has its principal offices to
20642064 enforce compliance with the provisions of the compact and its
20652065 adopted rules. The relief sought may include both injunctive
20662066 relief and damages. In the event judicial enforcement is
20672067 necessary, the prevailing party shall be awarded all costs of
20682068 such litigation, including reasonable attorney fees. The
20692069 remedies in this subdivision shall not be the exclusive

21142114 §34-9-110. Effective Date, Withdrawal, and Amendment.
21152115 (a) The compact shall come into effect on the date on
21162116 which the compact statute is enacted into law in the seventh
21172117 participating state.
21182118 (1) On or after the effective date of the compact, the
21192119 commission shall convene and review the enactment of each of
21202120 the states that enacted the compact prior to the commission
21212121 convening, the charter participating states, to determine if
21222122 the statute enacted by each charter participating state is
21232123 materially different than the model compact.
21242124 a. A charter participating state whose enactment is
21252125 found to be materially different from the model compact shall
21262126 be entitled to the default process set forth in Section
21272127 34-9-109.
21282128 b. If any participating state is later found to be in
21292129 default, or is terminated or withdraws from the compact, the
21302130 commission shall remain in existence and the compact shall
21312131 remain in effect even if the number of participating states
21322132 should be less than seven.

21632163 (2) Participating states enacting the compact
21642164 subsequent to the charter participating states shall be
21652165 subject to the process set forth in Section 34-9-106(c)(23) to
21662166 determine if their enactments are materially different from
21672167 the model compact and whether they qualify for participation
21682168 in the compact.
21692169 (3) All actions taken for the benefit of the commission
21702170 or in furtherance of the purposes of the administration of the
21712171 compact prior to the effective date of the compact or the
21722172 commission coming into existence shall be considered to be
21732173 actions of the commission unless specifically repudiated by
21742174 the commission.
21752175 (4) Any state that joins the compact subsequent to the
21762176 commission's initial adoption of the rules and bylaws shall be
21772177 subject to the commission's rules and bylaws as they exist on
21782178 the date on which the compact becomes law in that state. Any
21792179 rule that has been previously adopted by the commission shall
21802180 have the full force and effect of law on the day the compact
21812181 becomes law in that state.
21822182 (b) Any participating state may withdraw from this
21832183 compact by enacting a statute repealing that state's enactment
21842184 of the compact.
21852185 (1) A participating state's withdrawal shall not take
21862186 effect until 180 days after enactment of the repealing
21872187 statute.
21882188 (2) Withdrawal shall not affect the continuing
21892189 requirement of the withdrawing state's licensing authority or
21902190 authorities to comply with the investigative and state action

22212221 reporting requirements of this compact prior to the effective
22222222 date of withdrawal.
22232223 (3) Upon the enactment of a statute withdrawing from
22242224 this compact, the state shall immediately provide notice of
22252225 the withdrawal to all licensees within that state.
22262226 Notwithstanding any subsequent statutory enactment to the
22272227 contrary, the withdrawing state shall continue to recognize
22282228 all compact privileges to practice within that state granted
22292229 pursuant to this compact for a minimum of 180 days after the
22302230 date of such notice of withdrawal.
22312231 (c) Nothing contained in this compact shall be
22322232 construed to invalidate or prevent any licensure agreement or
22332233 other cooperative arrangement between a participating state
22342234 and a non-participating state that does not conflict with the
22352235 provisions of this compact.
22362236 (d) This compact may be amended by the participating
22372237 states. No amendment to this compact shall become effective
22382238 and binding upon any participating state until it is enacted
22392239 into the laws of all participating states.
22402240 §34-9-111. Construction and Severability.
22412241 (a) This compact and the commission's rulemaking
22422242 authority shall be liberally construed so as to effectuate the
22432243 purposes and the implementation and administration of the
22442244 compact. Provisions of the compact expressly authorizing or
22452245 requiring the adoption of rules shall not be construed to
22462246 limit the commission's rulemaking authority solely for those
22472247 purposes.
22482248 (b) The provisions of this compact shall be severable,

22782278 (b) The provisions of this compact shall be severable,
22792279 and if any phrase, clause, sentence, or provision of this
22802280 compact is held by a court of competent jurisdiction to be
22812281 contrary to the constitution of any participating state, a
22822282 state seeking participation in the compact, or of the United
22832283 States, or the applicability thereof to any government,
22842284 agency, person, or circumstance is held to be unconstitutional
22852285 by a court of competent jurisdiction, the validity of the
22862286 remainder of this compact and the applicability thereof to any
22872287 other government, agency, person, or circumstance shall not be
22882288 affected thereby.
22892289 (c) Notwithstanding subsection b, the commission may
22902290 deny a state's participation in the compact or, in accordance
22912291 with the requirements of Section 34-9-109(b) , terminate a
22922292 participating state's participation in the compact, if it
22932293 determines that a constitutional requirement of a
22942294 participating state is a material departure from the compact.
22952295 Otherwise, if this compact shall be held to be contrary to the
22962296 constitution of any participating state, the compact shall
22972297 remain in full force and effect as to the remaining
22982298 participating states and in full force and effect as to the
22992299 participating state affected as to all severable matters.
23002300 §34-9-112. Consistent Effect and Conflict With Other
23012301 State Laws.
23022302 (a) Nothing in this compact shall prevent or inhibit
23032303 the enforcement of any other law of a participating state that
23042304 is not inconsistent with the compact.
23052305 (b) Any laws, statutes, rules, or other legal

23382338 (c) All permissible agreements between the commission
23392339 and the participating states are binding in accordance with
23402340 their terms.
23412341 §34-9-113. Judicial Proceedings by Individuals.
23422342 Except as to judicial proceedings for the enforcement
23432343 of this compact among member states, individuals may pursue
23442344 judicial proceedings related to this compact in any Alabama
23452345 state or federal court that would otherwise have competent
23462346 jurisdiction.
23472347 Section 2. This act shall become effective on October
