15	15	SYNOPSIS:
16	16	Under existing law, the Board of Nursing is
17	17	responsible for the licensing and regulation of the
18	18	nursing profession in the state.
19	19	This bill would authorize the board to provide
20	20	financial assistance to licensees and applicants for
21	21	licensing to defray the costs of certain mental and
22	22	physical evaluations required by the board.
23	23	A BILL
24	24	TO BE ENTITLED
25	25	AN ACT
26	26	Relating to the Board of Nursing; to amend Section
27	27	34-21-4, Code of Alabama 1975, to authorize the board to
28	28	provide financial assistance to licensees and applicants for
29	29	licensing to defray the costs of certain mental and physical
30	30	evaluations required by the board; and to make nonsubstantive,
31	31	technical revisions to update existing code language to
32	32	current style.
33	33	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
34	34	Section 1. Section 34-21-4 of the Code of Alabama 1975,
35	35	is amended to read as follows:

67	67	(a) All funds and revenues of whatever kind authorized
68	68	or collected under the provisions of this chapter or the
69	69	regulations rules of the board shall be collected by the board
70	70	and shall be handled in accordance with existing regulations
71	71	rules and accounting procedures of state departments and
72	72	deposited in the board's trust fund in the State Treasury.
73	73	Disbursements and withdrawals of such the funds by the board
74	74	shall be made in accordance with existing regulations rules
75	75	and accounting procedures of state departments. The board
76	76	shall pay all of its expenses from its own funds, and no
77	77	expenses shall be borne by the State of Alabama from general
78	78	funds of the state.
79	79	All the rights, duties, powers, and authority now or
80	80	hereafter vested by law in the Board of Nurses' Examiners and
81	81	Registration are hereby transferred to and vested in the Board
82	82	of Nursing, and all rights, powers, duties, and authorities,
83	83	whether clerical, executive, administrative, judicial, or
84	84	quasi-judicial, now vested by law in the Board of Nurses'
85	85	Examiners and Registration, shall be vested in the Board of
86	86	Nursing hereby created and shall be exercised by it, together
87	87	with any additional rights, powers, and authorities herein
88	88	given or created by this chapter. The jurisdiction, functions,
89	89	funds, effects, and personnel of the Board of Nurses'
90	90	Examiners and Registration are hereby transferred to the Board
91	91	of Nursing and covered with their current status. No
92	92	unexpended funds of the Board of Nurses' Examiners and
93	93	Registration or the Board of Nursing shall ever revert to the
94	94	State of Alabama but shall remain the property of the Board of

124	124	State of Alabama but shall remain the property of the Board of
125	125	Nursing.
126	126	(b) The board may expend funds received from gifts and
127	127	grants to provide financial assistance to defray the cost of
128	128	evaluations for substance use disorder or mental or physical
129	129	impairment for licensees or applicants for licensing, when an
130	130	evaluation is required by a board order or board agreement,
131	131	under terms, conditions, and limitations provided by rule, and
132	132	may contract for, or otherwise make available, online
133	133	counseling resources to licensees and applicants for
134	134	licensing, under terms, conditions, and limitations provided
135	135	by rule. Counseling and evaluation services provided pursuant
136	136	to or funded pursuant to this subsection shall be provided by
137	137	licensed practitioners who are approved by the board. The
138	138	board may not exercise control over any recommendation made
139	139	pursuant to an evaluation or any advice or recommendation
140	140	provided pursuant to counseling provided by an approved
141	141	licensed practitioner. Nothing in this subsection is intended
142	142	to create a right in any licensee or applicant for licensing
143	143	to any service or payment for any service. Nothing in this
144	144	subdivision shall create a private right of action by a
145	145	licensee or applicant for licensing against the board or any
146	146	approved licensed practitioner whose services are provided or
147	147	funded pursuant to this subsection. "
148	148	Section 2. This act shall become effective on October
149	149	1, 2024.
