1515 SYNOPSIS:
1616 Under existing law, the Board of Nursing is
1717 responsible for the licensing and regulation of the
1818 nursing profession in the state.
1919 This bill would authorize the board to provide
2020 financial assistance to licensees and applicants for
2121 licensing to defray the costs of certain mental and
2222 physical evaluations required by the board.

2525 AN ACT
2626 Relating to the Board of Nursing; to amend Section
2727 34-21-4, Code of Alabama 1975, to authorize the board to
2828 provide financial assistance to licensees and applicants for
2929 licensing to defray the costs of certain mental and physical
3030 evaluations required by the board; and to make nonsubstantive,
3131 technical revisions to update existing code language to
3232 current style.
3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. Section 34-21-4 of the Code of Alabama 1975,
3535 is amended to read as follows:

6767 (a) All funds and revenues of whatever kind authorized
6868 or collected under the provisions of this chapter or the
6969 regulations rules of the board shall be collected by the board
7070 and shall be handled in accordance with existing regulations
7171 rules and accounting procedures of state departments and
7272 deposited in the board's trust fund in the State Treasury.
7373 Disbursements and withdrawals of such the funds by the board
7474 shall be made in accordance with existing regulations rules
7575 and accounting procedures of state departments. The board
7676 shall pay all of its expenses from its own funds, and no
7777 expenses shall be borne by the State of Alabama from general
7878 funds of the state.
7979 All the rights, duties, powers, and authority now or
8080 hereafter vested by law in the Board of Nurses' Examiners and
8181 Registration are hereby transferred to and vested in the Board
8282 of Nursing, and all rights, powers, duties, and authorities,
8383 whether clerical, executive, administrative, judicial, or
8484 quasi-judicial, now vested by law in the Board of Nurses'
8585 Examiners and Registration, shall be vested in the Board of
8686 Nursing hereby created and shall be exercised by it, together
8787 with any additional rights, powers, and authorities herein
8888 given or created by this chapter. The jurisdiction, functions,
8989 funds, effects, and personnel of the Board of Nurses'
9090 Examiners and Registration are hereby transferred to the Board
9191 of Nursing and covered with their current status. No
9292 unexpended funds of the Board of Nurses' Examiners and
9393 Registration or the Board of Nursing shall ever revert to the
9494 State of Alabama but shall remain the property of the Board of

124124 State of Alabama but shall remain the property of the Board of
125125 Nursing.
126126 (b) The board may expend funds received from gifts and
127127 grants to provide financial assistance to defray the cost of
128128 evaluations for substance use disorder or mental or physical
129129 impairment for licensees or applicants for licensing, when an
130130 evaluation is required by a board order or board agreement,
131131 under terms, conditions, and limitations provided by rule, and
132132 may contract for, or otherwise make available, online
133133 counseling resources to licensees and applicants for
134134 licensing, under terms, conditions, and limitations provided
135135 by rule. Counseling and evaluation services provided pursuant
136136 to or funded pursuant to this subsection shall be provided by
137137 licensed practitioners who are approved by the board. The
138138 board may not exercise control over any recommendation made
139139 pursuant to an evaluation or any advice or recommendation
140140 provided pursuant to counseling provided by an approved
141141 licensed practitioner. Nothing in this subsection is intended
142142 to create a right in any licensee or applicant for licensing
143143 to any service or payment for any service. Nothing in this
144144 subdivision shall create a private right of action by a
145145 licensee or applicant for licensing against the board or any
146146 approved licensed practitioner whose services are provided or
147147 funded pursuant to this subsection. "
148148 Section 2. This act shall become effective on October
149149 1, 2024.
