1515 SYNOPSIS:
1616 Under existing law, the Alabama Athletic
1717 Commission is responsible for regulating boxing,
1818 wrestling, and mixed martial arts pursuant to the
1919 Alabama Unarmed Combat Act.
2020 This bill would authorize the Attorney General
2121 to bring an action for certain violations of the act
2222 and would provide criminal penalties for certain
2323 violations
2424 Section 111.05 of the Constitution of Alabama of
2525 2022, prohibits a general law whose purpose or effect
2626 would be to require a new or increased expenditure of
2727 local funds from becoming effective with regard to a
2828 local governmental entity without enactment by a 2/3
2929 vote unless: it comes within one of a number of
3030 specified exceptions; it is approved by the affected
3131 entity; or the Legislature appropriates funds, or
3232 provides a local source of revenue, to the entity for
3333 the purpose.
3434 The purpose or effect of this bill would be to
3535 require a new or increased expenditure of local funds
3636 within the meaning of the section. However, the bill
3737 does not require approval of a local governmental
3838 entity or enactment by a 2/3 vote to become effective
3939 because it comes within one of the specified exceptions

7373 AN ACT
7474 Relating to the Alabama Athletic Commission; to amend
7575 Section 41-9-1038, Code of Alabama 1975, to authorize the
7676 Attorney General to bring a civil action for certain
7777 violations of the Alabama Unarmed Combat Act; to provide civil
7878 fines and criminal penalties for violations; and in connection
7979 therewith would have as its purpose or effect the requirement
8080 of a new or increased expenditure of local funds within the
8181 meaning of Section 111.05 of the Constitution of Alabama of
8282 2022.
8383 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
8484 Section 1. Section 41-9-1038 of the Code of Alabama
8585 1975, is amended to read as follows:
8686 "ยง41-9-1038
8787 (a)(1) Any person may file a written and signed
8888 complaint with the commission alleging that any other person
8989 has violated any provision of Sections 41-9-1029 to through
9090 41-9-1037, inclusive. A complaint shall be made in the manner
9191 prescribed by the board and shall be referred by the
9292 commission to a standing investigative committee, consisting
9393 of a commission member, the executive director, the attorney
9494 for the commission, and an investigator or the chief inspector

124124 for the commission, and an investigator or the chief inspector
125125 of the commission. If the investigative committee finds that
126126 no probable cause exists, the investigative committee may
127127 dismiss the charges and prepare a statement in writing,
128128 detailing the reasons for the decision.
129129 (b)(1)(2)a. If the investigative committee finds that
130130 probable cause exists, the commission shall initiate an
131131 administrative proceeding. If the commission determines the
132132 person has violated any provision of Sections 41-9-1029 to
133133 through 41-9-1037, inclusive, the commission may do any of the
134134 following:
135135 a.1. Issue a cease and desist order.
136136 b.2. Suspend or revoke a license.
137137 c.3. Impose an administrative fine of not more than ten
138138 thousand dollars ($10,000) per violation.
139139 (2)b. The commission may petition the circuit court of
140140 the county where the violation occurred to enforce a cease and
141141 desist order and to collect any assessed fine.
142142 (b) The Attorney General may bring a civil action
143143 requesting relief, including a permanent or temporary
144144 injunction, restraining order, or other order, against any
145145 person who he or she believes is violating any provision of
146146 Sections 41-9-1029 through 41-9-1037.
147147 (c)(1) Any manager, promoter, matchmaker, or licensee
148148 who knowingly violates or coerces or causes any other person
149149 to violate any provision of Sections 41-9-1029 through
150150 41-9-1037 shall be guilty of a Class C felony.
151151 (2) Any member or employee of the commission or any
152152 person who administers or enforces this article or rules

182182 person who administers or enforces this article or rules
183183 adopted pursuant to this article who knowingly violates
184184 Section 41-9-1033 or Section 41-9-1034 shall be guilty of a
185185 Class C felony.
186186 (d)(1) Any professional boxer, professional bare
187187 knuckle boxer, tough man contestant, professional wrestler,
188188 amateur mixed martial arts competitor, or professional
189189 competitor in mixed martial arts who knowingly violates this
190190 article, except Section 41-9-1034, upon conviction shall be
191191 guilty of a Class B misdemeanor.
192192 (2) In addition to the criminal penalties provided in
193193 subdivision (1), any professional boxer, professional bare
194194 knuckle boxer, tough man contestant, professional wrestler,
195195 amateur mixed martial arts competitor, or professional
196196 competitor in mixed martial arts who violates Section
197197 41-9-1034 may be punished by a civil fine not exceeding
198198 twenty-five thousand dollars ($25,000) together with a
199199 percentage of the purse not exceeding 15 percent for each
200200 violation.
201201 (e) A person who participates in or promotes unarmed
202202 combat without being properly authorized or licensed by the
203203 commission pursuant to this article shall be guilty of a Class
204204 A misdemeanor.
205205 (c)(f) The criminal penalties in this section shall not
206206 be construed to repeal other criminal laws. Whenever conduct
207207 prescribed by this article is also prescribed by other
208208 provision of law, the provision which carries the more serious
209209 penalty shall be applied.
210210 (d)(g) Any person aggrieved by an adverse action of the

240240 (d)(g) Any person aggrieved by an adverse action of the
241241 commission may appeal the action to the Circuit Court of
242242 Montgomery County in accordance with the Alabama
243243 Administrative Procedure Act."
244244 Section 2. Although this bill would have as its purpose
245245 or effect the requirement of a new or increased expenditure of
246246 local funds, the bill is excluded from further requirements
247247 and application under Section 111.05 of the Constitution of
248248 Alabama of 2022, because the bill defines a new crime or
249249 amends the definition of an existing crime.
250250 Section 3. This act shall become effective on October
251251 1, 2024.
