---|
16 | 16 | | Under existing law, the Alabama Athletic |
---|
17 | 17 | | Commission is responsible for regulating boxing, |
---|
18 | 18 | | wrestling, and mixed martial arts pursuant to the |
---|
19 | 19 | | Alabama Unarmed Combat Act. |
---|
20 | 20 | | This bill would authorize the Attorney General |
---|
21 | 21 | | to bring an action for certain violations of the act |
---|
22 | 22 | | and would provide criminal penalties for certain |
---|
23 | 23 | | violations |
---|
24 | 24 | | Section 111.05 of the Constitution of Alabama of |
---|
25 | 25 | | 2022, prohibits a general law whose purpose or effect |
---|
26 | 26 | | would be to require a new or increased expenditure of |
---|
27 | 27 | | local funds from becoming effective with regard to a |
---|
28 | 28 | | local governmental entity without enactment by a 2/3 |
---|
29 | 29 | | vote unless: it comes within one of a number of |
---|
30 | 30 | | specified exceptions; it is approved by the affected |
---|
31 | 31 | | entity; or the Legislature appropriates funds, or |
---|
32 | 32 | | provides a local source of revenue, to the entity for |

33 | 33 | | the purpose. |

74 | 74 | | Relating to the Alabama Athletic Commission; to amend |

75 | 75 | | Section 41-9-1038, Code of Alabama 1975, to authorize the |
---|
76 | 76 | | Attorney General to bring a civil action for certain |
---|
77 | 77 | | violations of the Alabama Unarmed Combat Act; to provide civil |
---|
78 | 78 | | fines and criminal penalties for violations; and in connection |
---|
79 | 79 | | therewith would have as its purpose or effect the requirement |

80 | 80 | | of a new or increased expenditure of local funds within the |

83 | 83 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
84 | 84 | | Section 1. Section 41-9-1038 of the Code of Alabama |
---|
85 | 85 | | 1975, is amended to read as follows: |
---|

---|
87 | 87 | | (a)(1) Any person may file a written and signed |
---|
88 | 88 | | complaint with the commission alleging that any other person |
---|
89 | 89 | | has violated any provision of Sections 41-9-1029 to through |
---|
90 | 90 | | 41-9-1037, inclusive. A complaint shall be made in the manner |
---|
91 | 91 | | prescribed by the board and shall be referred by the |
---|
92 | 92 | | commission to a standing investigative committee, consisting |
---|
93 | 93 | | of a commission member, the executive director, the attorney |
---|
94 | 94 | | for the commission, and an investigator or the chief inspector |
---|

---|
126 | 126 | | no probable cause exists, the investigative committee may |
---|
127 | 127 | | dismiss the charges and prepare a statement in writing, |
---|
128 | 128 | | detailing the reasons for the decision. |
---|
129 | 129 | | (b)(1)(2)a. If the investigative committee finds that |
---|
130 | 130 | | probable cause exists, the commission shall initiate an |
---|
131 | 131 | | administrative proceeding. If the commission determines the |
---|
132 | 132 | | person has violated any provision of Sections 41-9-1029 to |
---|
133 | 133 | | through 41-9-1037, inclusive, the commission may do any of the |
---|
134 | 134 | | following: |
---|
135 | 135 | | a.1. Issue a cease and desist order. |
---|
136 | 136 | | b.2. Suspend or revoke a license. |
---|
137 | 137 | | c.3. Impose an administrative fine of not more than ten |
---|
138 | 138 | | thousand dollars ($10,000) per violation. |
---|
139 | 139 | | (2)b. The commission may petition the circuit court of |
---|
140 | 140 | | the county where the violation occurred to enforce a cease and |
---|
141 | 141 | | desist order and to collect any assessed fine. |
---|
142 | 142 | | (b) The Attorney General may bring a civil action |
---|
143 | 143 | | requesting relief, including a permanent or temporary |
---|
144 | 144 | | injunction, restraining order, or other order, against any |
---|
145 | 145 | | person who he or she believes is violating any provision of |
---|
146 | 146 | | Sections 41-9-1029 through 41-9-1037. |
---|
147 | 147 | | (c)(1) Any manager, promoter, matchmaker, or licensee |
---|
148 | 148 | | who knowingly violates or coerces or causes any other person |
---|
149 | 149 | | to violate any provision of Sections 41-9-1029 through |
---|
150 | 150 | | 41-9-1037 shall be guilty of a Class C felony. |
---|
151 | 151 | | (2) Any member or employee of the commission or any |
---|
152 | 152 | | person who administers or enforces this article or rules |

190 | 190 | | article, except Section 41-9-1034, upon conviction shall be |
---|
191 | 191 | | guilty of a Class B misdemeanor. |
---|
192 | 192 | | (2) In addition to the criminal penalties provided in |
---|
193 | 193 | | subdivision (1), any professional boxer, professional bare |
---|
194 | 194 | | knuckle boxer, tough man contestant, professional wrestler, |
---|
195 | 195 | | amateur mixed martial arts competitor, or professional |
---|
196 | 196 | | competitor in mixed martial arts who violates Section |
---|
197 | 197 | | 41-9-1034 may be punished by a civil fine not exceeding |
---|
198 | 198 | | twenty-five thousand dollars ($25,000) together with a |
---|
199 | 199 | | percentage of the purse not exceeding 15 percent for each |
---|
200 | 200 | | violation. |
---|
201 | 201 | | (e) A person who participates in or promotes unarmed |
---|
202 | 202 | | combat without being properly authorized or licensed by the |
---|
203 | 203 | | commission pursuant to this article shall be guilty of a Class |
---|

---|
205 | 205 | | (c)(f) The criminal penalties in this section shall not |
---|
206 | 206 | | be construed to repeal other criminal laws. Whenever conduct |
---|
207 | 207 | | prescribed by this article is also prescribed by other |

246 | 246 | | local funds, the bill is excluded from further requirements |
---|
247 | 247 | | and application under Section 111.05 of the Constitution of |
---|
248 | 248 | | Alabama of 2022, because the bill defines a new crime or |
---|
249 | 249 | | amends the definition of an existing crime. |
---|
250 | 250 | | Section 3. This act shall become effective on October |
---|
