19+AN ACT
1820 Relating to food products; to prohibit the manufacture,
1921 sale, or distribution of food products made from cultured
2022 animal cells in this state; to provide penalties for
2123 violations; and in connection therewith would have as its
2224 purpose or effect the requirement of a new or increased
2325 expenditure of local funds within the meaning of Section
2426 111.05 of the Constitution of Alabama of 2022.
2527 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2628 Section 1. (a) For the purposes of this section, the
2729 term "cultivated food product" means any food product produced
2830 from cultured animal cells.
2931 (b)(1) It shall be unlawful for any person to
3032 manufacture, sell, hold or offer for sale, or distribute any
3133 cultivated food product in this state.
3234 (2) A violation of this subsection is a Class C
3335 misdemeanor.
3436 (c)(1) A food sales establishment, as defined in
3537 Section 20-1-20, Code of Alabama 1975, that sells or
3638 distributes cultivated food products in violation of
37-subsection (b) shall be subject to disciplinary action
38-pursuant to Section 20-1-34, Code of Alabama 1975.
39-(2) The food safety permit of a food sales
40-establishment may be suspended or revoked as provided in
41-Section 20-1-33, Code of Alabama 1975, upon the conviction of

68+distributes cultivated food products in violation of
69+subsection (b) shall be subject to disciplinary action
70+pursuant to Section 20-1-34, Code of Alabama 1975.
71+(2) The food safety permit of a food sales
72+establishment may be suspended or revoked as provided in
7173 Section 20-1-33, Code of Alabama 1975, upon the conviction of
7274 an owner or an employee of the establishment for a violation
7375 of subsection (b) in connection with the establishment.
7476 (d)(1) A food establishment, as defined by rule of the
7577 Department of Public Health, that sells or distributes
7678 cultivated food products in violation of subsection (b) shall
7779 be subject to all enforcement measures as provided by rule of
7880 the Department of Public Health.
7981 (2) The permit of a food establishment may be suspended
8082 or revoked as provided by rule of the Department of Public
8183 Health upon the conviction of an owner or an employee of the
8284 establishment for a violation of subsection (b) in connection
8385 with the establishment.
8486 (e) The Department of Agriculture and Industries and
8587 the Department of Public Health may adopt rules as necessary
8688 to implement this section.
87-(f) Nothing in this section shall be construed as
88-preventing any federal, state, or local governmental entity or
89-institution of higher education, or a person that is partnered
90-with a governmental entity or institution of higher education
91-as evidenced by a formal agreement, from conducting research
92-in this state regarding the production of cultivated food
93-products.
9489 Section 2. Although this bill would have as its purpose
9590 or effect the requirement of a new or increased expenditure of
9691 local funds, the bill is excluded from further requirements
9792 and application under Section 111.05 of the Constitution of
9893 Alabama of 2022, because the bill defines a new crime or
9994 amends the definition of an existing crime.
95+Section 3. This act shall become effective on October
96+1, 2024.
