4345 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
44-Section 1. This act shall be known and may be cited as
45-the Alabama Workforce Transformation Act.
46-Section 2. The Alabama Department of Labor is hereby
47-renamed the Alabama Department of Workforce, and the head of
48-the department shall be known and designated as the Secretary
49-of Workforce. Any reference in Alabama law or in any contract,

75+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
76+Section 1. This act shall be known and may be cited as
77+the Alabama Workforce Transformation Act.
78+Section 2. The Alabama Department of Labor is hereby
79+renamed the Alabama Department of Workforce, and the head of
80+the department shall be known and designated as the Secretary
7981 of Workforce. Any reference in Alabama law or in any contract,
8082 deed, financial instrument or other legal document to the
8183 Alabama Department of Labor or Secretary of Labor shall be
8284 interpreted to mean the Alabama Department of Workforce or the
8385 Secretary of Workforce as necessary to accomplish the purposes
8486 of this act. The Code Commissioner shall conform references in
8587 the Code of Alabama 1975, to existing departments, offices,
8688 officers, and other state entities or positions to reflect the
8789 changes required by this act. Code changes shall be made at a
8890 time determined to be appropriate by the Code Commissioner.
8991 Section 3. Section 25-2-2, Code of Alabama 1975, is
9092 amended to read as follows:
9193 "§25-2-2
9294 (a) The general functions and duties of the Department
9395 of LaborWorkforce shall be as follows:
9496 (1) To administer all labor laws and all laws relating
9597 to the relationship between employer and employee, including
9698 laws relating to hours of work, and working conditions in
9799 places of employment.
98100 (2) To make or cause to be made all necessary
99101 inspections to determine whether or not the laws, the
100102 administration of which is delegated to the Department of
101103 LaborWorkforce, and rules and regulations issued pursuant
102-thereto, are being complied with by employers and employees,
103-and to take such action as may be necessary to enforce
104-compliance; provided, however, that there shall be no
105-inspection of boilers which have been inspected, approved, and
106-insured by an insurance company authorized to do business in
107-the State of Alabama. Provided, however, that this provision

134+thereto, are being complied with by employers and employees,
135+and to take such action as may be necessary to enforce
136+compliance; provided, however, that there shall be no
137+inspection of boilers which have been inspected, approved, and
138+insured by an insurance company authorized to do business in
137139 the State of Alabama. Provided, however, that this provision
138140 may not prevent compliance verification by the department.
139141 (3) To propose to the board of appeals, provided for in
140142 this chapter, such rules and regulations, or amendments as may
141143 be deemed advisable for the prevention of accidents or the
142144 prevention of sickness and diseases in mines. The Secretary of
143145 LaborWorkforce may appoint committees composed of employers,
144146 employees, and experts to suggest and assist in the
145147 preparation of rules and regulations or amendments.
146148 (4) To administer and perform, by and under the
147149 direction of the Secretary of LaborWorkforce, all functions
148150 and duties of Chapter 4 of this title, and it shall have power
149151 and authority to adopt and enforce all reasonable rules and
150152 orders necessary or suitable to that end, and to require any
151153 reports, and to take any other action, consistent with Chapter
152154 4 of this title, necessary or suitable to that end.
153155 (5) To cooperate with all authorities of the United
154156 States having powers and duties under the Wagner-Peyser Act,
155157 approved June 6, 1933 (48 Stat. 113, United States Code, Title
156158 29, Section 49) entitled "An Act to provide for the
157159 establishment of a national employment system and for
158160 cooperation with the states in the promotion of such system
159161 and for other purposes," and to do and perform all things
160-necessary to secure for the State of Alabama the benefits of
161-such act and the promotion and maintenance of a system of
162-public employment offices. The Department of LaborWorkforce is
163-hereby designated as the state agency and vested with all
164-powers necessary to cooperate with the United States
165-Employment Service or its successor.

194+public employment offices. The Department of LaborWorkforce is
195+hereby designated as the state agency and vested with all

195197 Employment Service or its successor.
196198 (6) To administer and perform, by and under the
197199 direction of the Secretary of LaborWorkforce, all functions
198200 and duties of Chapter 5 of this title, and it shall have power
199201 and authority to adopt and enforce all reasonable rules and
200202 orders necessary or suitable to that end, and to require any
201203 reports, and to take any other action, consistent with Chapter
202204 5 of this title, necessary or suitable to that end.
203205 (7) To make investigations and studies and to collect,
204206 collate, and compile statistical information and to make and
205207 publish reports concerning the state’s labor force
206208 participation rate, unemployment rate, barriers to employment,
207209 conditions of labor generally, including living conditions,
208210 hours of work, wages paid, and all matters relating to the
209211 enforcement and effect of the provisions of this title coming
210212 under the jurisdiction of the Department of LaborWorkforce and
211213 the rules and regulations issued pursuant thereto and other
212214 laws relating to the Department of LaborWorkforce. The
213215 Secretary of LaborWorkforce shall deliver a copy of each such
214216 report to every person making application therefor.
215217 (8) To make an annual report to the Governor covering
216218 the activities and accomplishments of the Department of
217219 LaborWorkforce during the preceding fiscal year, accompanied
218-by the recommendations of the Secretary of LaborWorkforce. The
219-report shall be printed and the Secretary of LaborWorkforce
220-shall deliver a copy to every person making application
221-therefor.
222-(9) To make recommendations to the Legislature for the

253255 enactment of laws which, on the basis of information and
254256 statistics compiled by the Department of LaborWorkforce,
255257 appear to be desirable for the development and training of the
256258 state’s labor force, protection of laborers , and for promoting
257259 and fostering amicable relations between employers and
258260 employees.
259261 (10) To administer and perform, by and under the
260262 direction of the Secretary of LaborWorkforce, all functions
261263 and duties of Section 25-2-7, and it shall have power and
262264 authority to adopt and enforce all reasonable rules and orders
263265 necessary or suitable to that end, and to require any reports,
264266 and to take any other action, consistent with Section 25-2-7,
265267 necessary or suitable to that end.
266268 (11) To administer and perform, by and under the
267269 direction of the Secretary of LaborWorkforce, all functions
268270 and duties of Chapter 7 of this title and such other statutes
269271 as may be provided by law and to advise the Governor with
270272 respect to the provisions thereof, and it shall have power and
271273 authority to adopt and enforce all reasonable rules and orders
272274 necessary or suitable to that end, and to require any reports,
273275 and to take any other action, consistent with Chapter 7 of
274276 this title, necessary or suitable to that end.
275277 (12) To administer and perform, by and under the
276-direction of the Secretary of LaborWorkforce, all functions
277-and duties of Chapter 8 of this title, and it shall have the
278-power and authority to adopt and enforce all reasonable rules
279-and orders necessary or suitable to that end, and to require
280-any reports, and to take any other action, consistent with
281-Chapter 8 of this title, necessary or suitable to that end.

309+and duties of Chapter 8 of this title, and it shall have the
310+power and authority to adopt and enforce all reasonable rules
311+and orders necessary or suitable to that end, and to require
312+any reports, and to take any other action, consistent with

312314 (13) To administer and perform, by and under the
313315 direction of the Secretary of LaborWorkforce, all functions
314316 and duties of Chapter 9 of this title, and it shall have power
315317 and authority to adopt and enforce all reasonable rules and
316318 orders necessary or suitable to that end, and to require any
317319 reports, and to take any other action, consistent with Chapter
318320 9 of this title, necessary or suitable to that end.
319321 (14) To administer and perform, by and under the
320322 direction of the Secretary of LaborWorkforce, all functions
321323 and duties of Chapter 10 of this title, and it shall have
322324 power and authority to adopt and enforce all reasonable rules
323325 and orders necessary or suitable to that end, and to require
324326 any reports, and to take any other action, consistent with
325327 Chapter 10 of this title, necessary or suitable to that end.
326328 (15) To administer and perform, by and under the
327329 direction of the Secretary of LaborWorkforce, all functions
328330 and duties of Chapter 11 of this title, and it shall have
329331 power and authority to adopt and enforce all reasonable rules
330332 and orders necessary or suitable to that end, and to require
331333 any reports, and to take any other action, consistent with
332334 Chapter 11 of this title, necessary or suitable to that end.
333335 (16) To administer and perform, by and under the
334-direction of the Secretary of LaborWorkforce, all functions
335-and duties of Chapter 12 of this title, and it shall have
336-power and authority to adopt and enforce all reasonable rules
337-and orders necessary or suitable to that end, and to require
338-any reports, and to take any other action, consistent with

365+(16) To administer and perform, by and under the
366+direction of the Secretary of LaborWorkforce, all functions
367+and duties of Chapter 12 of this title, and it shall have
368+power and authority to adopt and enforce all reasonable rules
369+and orders necessary or suitable to that end, and to require
370+any reports, and to take any other action, consistent with
369371 Chapter 12 of this title, necessary or suitable to that end.
370372 (17) To administer and perform, by and under the
371373 direction of the Secretary of LaborWorkforce, all functions
372374 and duties of Chapter 13 of this title, and to require any
373375 reports, and to take any other action, consistent with Chapter
374376 13 of this title, necessary or suitable to that end.
375377 (18) To administer and perform, by and under the
376378 direction of the Secretary of LaborWorkforce, all functions
377379 and duties of Chapter 14 of this title, and it shall have
378380 power and authority to adopt and enforce all reasonable rules
379381 and orders necessary or suitable to that end, and to require
380382 any reports, and to take any other action, consistent with
381383 Chapter 14 of this title, necessary or suitable to that end.
382384 (19) To perform the duties set forth in subsection
383385 (a)(5) of this chapter related to the administration of Title
384386 III of the Wagner-Peyser Act and the Employment Service and
385387 the Alabama Career Center Systems within the State.
386388 (20) To cooperate with all authorities of the United
387389 States concerning the development, management, and delivery of
388390 workforce and labor market information funded through the
389391 Workforce and Labor Market Information Grants to States (WIGS)
390392 implementation of the federal Workforce Information Grant.
391393 (21) To cooperate with all authorities of the United
392-States concerning the management and delivery of the Jobs for
393-Veterans State Grants Program.
394-(22) To cooperate with all authorities of the United
395-States concerning the management and delivery of the federal
396-Work Opportunity Tax Credit.
397-(23) To cooperate with all authorities of the United

424+States concerning the management and delivery of the Jobs for
425+Veterans State Grants Program.
426+(22) To cooperate with all authorities of the United
427+States concerning the management and delivery of the federal
428+Work Opportunity Tax Credit.
427429 (23) To cooperate with all authorities of the United
428430 States concerning the management and delivery of the Federal
429431 Bonding Program.
430432 (24) To administer the Alabama Workforce Board, its
431433 Executive Committee, and the Regional Workforce Boards.
432434 (25) To collaborate with the Alabama Workforce Board,
433435 its Executive Committee, and other state agencies,
434436 departments, boards, and commissions to develop cohesive and
435437 coordinated workforce development strategies, programs, and
436438 budget recommendations.
437439 (26) To administer all workforce development programs
438440 currently administered by the Department of Commerce, except
439441 for the Alabama Industrial Development Training Institute,
440442 including, but not limited to:
441443 a. Programs funded by Title I of the federal Workforce
442444 Innovation and Opportunity Act.
443445 b. The Alabama Office of Apprenticeship.
444446 c. The Alabama Committee on Credentialing and Career
445447 Pathways established by Act 2019-506.
446448 d. The Alabama Committee on Credential Quality and
447449 Transparency established by Act 2023-365.
448450 e. The Alabama STEM Council.
449451 f. The Office of Education and Workforce Statistics.
450-(b) The combining of the functions of the Department of
451-Industrial Relations and Department of Labor made by Act
452-2012-496 shall reduce administrative costs and expenses paid
453-from the State General Fund by an amount equal to at least 20
454-percent of the amount appropriated from the State General Fund

482+(b) The combining of the functions of the Department of
483+Industrial Relations and Department of Labor made by Act
484+2012-496 shall reduce administrative costs and expenses paid
485+from the State General Fund by an amount equal to at least 20
486+percent of the amount appropriated from the State General Fund
485487 to the Department of Labor for the fiscal year ending
486488 September 30, 2012.
487489 (b) All state-level staff and state-owned assets
488490 assigned to Regional Workforce Councils at the Department of
489491 Commerce shall be transferred to the Department of Workforce.
490492 (c) Any employee who is not subject to the Merit System
491493 and who is transferred to the Department of Workforce to work
492494 for the programs and councils referenced in Section
493495 25-2-2(a)(26) and Section 25-2-2(b) shall serve in the exempt
494496 service of the Merit System and maintain his or her salary,
495497 benefits, and years of service upon the transfer. All other
496498 employees shall remain subject to the Merit System.
497499 (d) Any Merit System employee who is transferred to the
498500 Department of Workforce to work for the programs and councils
499501 referenced in Section 25-2-2(a)(26) and Section 25-2-2(b)
500502 shall be transferred with no decrease in compensation or
501503 benefits."
502504 Section 4. Section 25-2-3, Code of Alabama 1975, is
503505 amended to read as follows:
504506 "§25-2-3
505507 (a) The Secretary of LaborWorkforce, with the approval
506508 of the Governor, may establish such division or divisions as
507509 may, in his discretion, be necessary or desirable for the
508-administration or enforcement of any law or any rule or
509-regulations with which the Department of LaborWorkforce is
510-charged or the performance of any of its functions or duties.
511-Each division in the Department of LaborWorkforce shall be
512-headed by and be under the direction, supervision and control
513-of an officer who shall be designated as the chief of such

539+may, in his discretion, be necessary or desirable for the
540+administration or enforcement of any law or any rule or
541+regulations with which the Department of LaborWorkforce is
542+charged or the performance of any of its functions or duties.
543+Each division in the Department of LaborWorkforce shall be
544+headed by and be under the direction, supervision and control
543545 of an officer who shall be designated as the chief of such
544546 division. All chiefs of divisions shall be appointed by the
545547 Secretary of Labor Workforce, subject to the provisions of the
546548 Merit System. Before entering upon the discharge of their
547549 duties, such chiefs of divisions shall take the constitutional
548550 oath of office. Each of such officers shall devote his full
549551 time to his official duties and shall hold no other lucrative
550552 position while serving as such.
551553 (b) In addition to any other exempt positions allowed
552554 by law, the department shall have three additional exempt
553555 positions. The division employees serving in the exempt
554556 service shall not be subject to the provisions of the Merit
555557 System or receive Merit System benefits, and their
556558 compensation shall be determined by the Secretary.
557559 (c) It is one of the purposes of this chapter to
558560 coordinatein a single Unemployment Compensation Division , in
559561 one division of the Department of Labor, all of the state's
560562 unemployment compensation services and employment service .
561563 Unemployment compensation services and employment service
562564 shall be in one division of the Department of LaborWorkforce
563565 under the direction of the chief of said division. Within said
564566 division, but subordinate to the chief thereof, there shall be
565567 a full-time salaried director of unemployment compensation and
566-a full-time salaried director of employment service. The
567-salariessalary of said the division chief and directors
568-shallmay be paid solely from federal grants and shall be
569-comparable to those paid similar officers in comparable
570-states, notwithstanding any limitation or maximum in any other
571-law.The Secretary may employ personnel who shall serve in the

604606 (d) It is another purpose of this chapter to coordinate
605607 in a single Workforce Pathways Division, all of the
606608 department’s workforce development functions and workforce
607609 funding mechanisms, including the Alabama Workforce Board; the
608610 regional workforce boards; the employment service and Alabama
609611 Career Center System; the Alabama Office of Apprenticeship;
610612 the Alabama STEM Council; the Office of Education and
611613 Workforce Statistics; programs funded by Title I of the
612614 federal Workforce Innovation and Opportunity Act; the Alabama
613615 Committee on Credentialing and Career Pathways; the Alabama
614616 Committee on Credential Quality and Transparency; the
615617 Workforce and Labor Market Information Grants for States Grant
616618 program and the Labor Market Division; the Federal Bonding
617619 Program; the federal Jobs for Veterans State Grants Program;
618620 and the federal Work Opportunity Tax Credit. The Secretary may
619621 employ a division chief of the Workforce Pathways Division who
620622 shall serve in the exempt service. The Secretary may employ
621623 personnel who shall serve in the classified service of the
622624 Merit System to carry out the duties of this division. It is
623625 the intent of the Legislature that the Workforce Pathways
624-Division of the Department of Workforce serve as the
625-centralized data and information repository for the workforce
626-development activities of the state. "

659661 § 25-15-1. Alabama Workforce Board; creation; purpose.
660662 (a) The Governor shall establish the Alabama Workforce
661663 Board as the State Workforce Development Board for purposes of
662664 Section 101 of the Workforce Innovation and Opportunity Act of
663665 2014 (P.L. 113-128), as amended, and to carry out its purposes
664666 pursuant to state law; provided, that in the event of a
665667 conflict between state law and WIOA, WIOA shall prevail.
666668 (b) It is the intent of the Legislature that all state
667669 and local entities that receive state-appropriated funding and
668670 are engaged in workforce development activities will fully
669671 participate in and cooperate with the activities and
670672 recommendations of the Board, but the Board shall not directly
671673 exercise governing control of state and local agencies,
672674 departments, educational institutions, boards, commissions,
673675 and other workforce development entities except as otherwise
674676 prescribed by federal law or regulation.
675677 (c) For purposes of this chapter, “WIOA” means the
676678 Workforce Innovation and Opportunity Act of 2014 (P.L.
677679 113-128), as amended.
678680 § 25-15-2. Duties of the Board.
679681 The duties of the Alabama Workforce Board include:
680682 (1) Advising and supporting the Governor, Legislature,

728730 (6) Consulting with officials, leaders, and experts in
729731 workforce development including, but not limited to, federal,
730732 state, and local agencies, departments, educational
731733 institutions, boards, commissions, the private sector, and
732734 other leaders and experts.
733735 § 25-15-3. Composition of the Board; chair; bylaws.
734736 (a) The Alabama Workforce Board shall consist of no
735737 more than forty (40) members, or their designees, and meet the
736738 membership criteria established by WIOA. All members, unless
737739 otherwise provided in this subsection, shall be appointed by
738740 the Governor, subject to confirmation by the Senate. A
739741 majority of members shall be representatives of business and
740-industry, at least one of which shall represent small
741-business. Twenty percent of the members shall be
742-representatives of workforce, including two (2) labor
743-representatives and one (1) apprenticeship program

786788 inclusive and reflect the racial, gender, geographic,
787789 urban/rural, and economic diversity of the state.
788790 (b) The Governor shall appoint a chairperson from the
789791 business representatives on the Board as set forth in WIOA. In
790792 addition, the Governor shall appoint a vice chairperson from
791793 the business representatives on the Board.
792794 (c) The Governor shall establish bylaws governing the
793795 membership and activities of the board as required by WIOA and
794796 its implementing regulations, including 20 C.F.R. §679.110(d).
795797 (d) Members may serve no more than two four-year terms
796798 as provided in the bylaws established pursuant to subsection
797799 (c) of this section.

840842 § 25-15-5. Alabama Workforce Board Executive Committee;
841843 creation; purpose.
842844 (a) There is hereby established the Executive Committee
843845 of the Alabama Workforce Board that shall be comprised of
844846 seven (7) members, including the Governor or the Governor’s
845847 designee, the Chair of the Alabama Workforce Board, and five
846848 (5) executive level business leaders who shall be appointed by
847849 the Governor, and who may or may not be members of the Alabama
848850 Workforce Board. The Secretary of Workforce shall serve as a
849851 non-voting ex officio member of the Executive Committee.
850852 (b)(1) The appointed members of the Executive
851853 Committee shall be appointed to serve a five-year term,
852854 provided that the initial appointees' terms shall be
853855 designated by the Governor as follows: one member shall serve
854856 a term of one year, one member shall serve a term of two
855857 years, one member shall serve a term of three years, one
856-member shall serve a term of four years, and one member shall
857-serve a term of five years.
858-(2) Any appointed member may be re-appointed, but no
859-appointed member may serve on the Executive Committee for more

899901 (c) The Governor shall appoint a chairperson and vice
900902 chairperson of the Executive Committee.
901903 (d) The Executive Committee shall meet at least two
902904 times per year but may meet more frequently at the call of the
903905 chairperson or the Governor.
904906 (e) The Executive Committee shall be responsible for
905907 reviewing budget requests, making recommendations for the
906908 expenditure of state and federal funds for workforce
907909 development activities, assisting the Secretary of Workforce
908910 in preparing the consolidated workforce development budget
909911 recommendation, working with the Secretary of Workforce to
910912 prepare the Strategic Workforce Plan, developing recommended
911913 performance goals and evaluation metrics related to the
912914 expenditure of state and federal funds for workforce
913915 development activities, and working with the Secretary of
914-Workforce to provide oversight of the Alabama Workforce Board.
915-(f) Meetings of the Executive Committee shall be
916-subject to the Open Meetings Act.

949+§ 25-15-6. Strategic Workforce Plan and WIOA State
950+Plan.
949951 (a) It is the intent of the Legislature that a single,
950952 unified Strategic Workforce Plan should guide state and
951953 federal workforce development policies and budget priorities
952954 that are administered by the State. The Strategic Workforce
953955 Plan shall be prepared by the Executive Committee, with
954956 support from the Secretary of Workforce, and published by the
955957 Department.
956958 (b) The Secretary of Workforce shall submit the
957959 Strategic Workforce Plan to the Governor and the Legislature
958960 on or before February 1 of the first year of each legislative
959961 quadrennium. The four-year Strategic Workforce Plan shall
960962 include, among other things, statewide labor market
961963 projections for the quadrennium and recommendations for
962964 meeting labor market demand. The Plan should also include
963965 recommendations for expenditure of state and federal funds for
964966 workforce development activities; analyze previous
965967 expenditures for workforce development activities and
966968 programs; make recommendations for sunsetting existing
967969 programs and developing new programs; and provide
968970 recommendations for performance and accountability metrics for
969971 all state and federal workforce programs.
970972 (c) The Plan may be updated through an annual addendum,
971973 which shall be submitted to the Governor on or before November
972-1 of each year. The annual addendum to the four-year Strategic
973-Workforce Plan should include recommendations for the next
974-fiscal year, including the expenditure of state and federal
975-funds for workforce development activities, and should make
976-recommendations for sunsetting existing programs and
977-developing new programs.

10091011 Secretary of Workforce in preparing the WIOA State plan, as
10101012 required by federal law. The WIOA State Plan shall demonstrate
10111013 that the membership of the Alabama Workforce Board satisfies
10121014 the WIOA state workforce development board membership
10131015 requirements, including the requirements set forth in 20
10141016 C.F.R. §679.110(b). The Executive Committee may approve the
10151017 WIOA State Plan. The WIOA State Plan shall be included as an
10161018 addendum to the four-year Strategic Workforce Plan.
10171019 (e) When submitting a budget pursuant to section
10181020 41-4-82, the Governor shall certify that he or she has
10191021 reviewed and considered the WIOA State Plan, the Strategic
10201022 Workforce Plan, and the annual addendum to the Strategic
10211023 Workforce Plan as approved by the Executive Committee.
10221024 § 25-15-7. Regional Workforce Boards; establishment;
10231025 duties; meetings; objectives.
10241026 (a) At the direction of the Governor, the Secretary of
10251027 Workforce shall establish seven regional workforce boards to
10261028 serve as Alabama’s local workforce development boards for
10271029 purposes of Section 107 of the Workforce Innovation and
10281030 Opportunity Act of 2014 (P.L. 113-128), as amended. The
10291031 Department of Workforce shall establish bylaws governing the
1030-membership and activities of the regional workforce boards in
1031-compliance with WIOA. Such local workforce development boards
1032-shall be certified by the Governor pursuant to 29 U.S.C.
1033-§3122(a).

10661068 criteria for the appointment of members to the regional
10671069 workforce boards consistent with WIOA, including 29 U.S.C.
10681070 §3122 and 20 C.F.R. §679.110. One such criterion shall be a
10691071 duty for an appointing official to consult with the Secretary
10701072 of Workforce before making an appointment to a regional
10711073 workforce board.
10721074 (c) The Department of Workforce may adopt rules
10731075 pursuant to the Alabama Administrative Procedure Act to carry
10741076 out this section.
10751077 (d) A regional workforce board shall perform the
10761078 functions set forth in WIOA, including each of the following:
10771079 (1) Develop a local plan as provided in WIOA,
10781080 consistent with the WIOA State Plan and the Strategic
10791081 Workforce Plan.
10801082 (2) Publish, for core and partner agency and public
10811083 use, workforce research and regional labor market analysis
10821084 using primary state labor market information provided by the
10831085 department.
10841086 (3) Convene local workforce development system
10851087 stakeholders to assist in the development of the local plan.
10861088 (4) Lead local efforts to engage with a diverse range
10871089 of employers.
1088-(5) Lead local efforts to develop and implement career
1089-pathways.
1090-(6) Lead local efforts to identify and promote
1091-promising workforce development strategies.
1092-(7) Lead local efforts to integrate data and technology

11281130 shall demonstrate that the membership of the board satisfies
11291131 the relevant WIOA state workforce development board membership
11301132 requirements, including the requirements set forth in 29
11311133 U.S.C. § 3122 and 20 C.F.R. § 679.320. The membership of any
11321134 regional workforce board may not exceed twenty (20) members. A
11331135 regional workforce development board may not expend state or
11341136 federal workforce development funds except pursuant to a
11351137 categorical annual budget approved by the Secretary of
11361138 Workforce.
11371139 § 25-15-8. Reimbursement for expenses.
11381140 The members of the Alabama Workforce Board, including
11391141 members of the Executive Committee, and members of the
11401142 regional workforce boards shall not receive a salary or per
11411143 diem allowance but shall be entitled to reimbursement for
11421144 reasonable expenses incurred in the performance of the duties
11431145 of the office at the same rate allowed state employees.

11981200 in an amount to be fixed by the Governor, but not less than
11991201 $10,000.00, for the faithful performance of the duties of the
12001202 office. The annual salary of the Secretary of LaborWorkforce
12011203 shall be fixed by the Governor at a sum comparable to salaries
12021204 paid similar officers in other states, notwithstanding any

13021304 (g) The Secretary of Workforce shall solicit annual
13031305 funding and programmatic recommendations and updates from the
13041306 Department of Commerce, Alabama Industrial Development
13051307 Training (AIDT), the Alabama State Department of Education
13061308 Career and Technical Education (CTE) program, the Alabama
13071309 Community College System (ACCS), and any other departments or
13081310 agencies that the Secretary requests to submit information.
13091311 (h) When submitting a budget request pursuant to
13101312 section 41-4-84, the departments and agencies referenced in
13111313 subsection (g) of this section and any other departments or
13121314 agencies that request funding for workforce development
13131315 activities or programs must certify to the Director of Finance
13141316 that any funding requested for workforce development
13151317 activities or programs is consistent with the Strategic
13161318 Workforce Plan.
13171319 (i) Within five (5) days of receiving all budget
13181320 requests required to be submitted pursuant to section 41-4-84,
13191321 the Director of Finance shall forward to the Secretary of
1320-Workforce and the Executive Committee all budget requests
1321-submitted by the departments and agencies referenced in
1322-subsection (g) of this section, along with any other budget
1323-requests that include funding for workforce development
1324-activities or programs. "

13551357 Section 7. The Alabama Department of Commerce Workforce
13561358 Development Division, as established by Section 41-29-5, Code
13571359 of Alabama 1975, is hereby renamed the Alabama Industrial
13581360 Development and Training Institute. The Code Commissioner
13591361 shall conform references to the “Workforce Development
13601362 Division” in Chapter 29 of Title 41 in the Code of Alabama
13611363 1975, accordingly. The Code Commissioner shall also change
13621364 references to the Deputy Secretary of Commerce of the
13631365 Workforce Development Division in Chapter 29 of Title 41 in
13641366 the Code of Alabama 1975, to the Secretary of Commerce. These
13651367 Code changes shall be made at a time determined to be
13661368 appropriate by the Code Commissioner.
13671369 Section 8. Section 41-29-5, Code of Alabama 1975, is
13681370 amended to read as follows:
13691371 "§41-29-5
13701372 On the date determined pursuant to Section 41-29-6,
13711373 tThe Department of Commerce shall be reorganized into two
13721374 divisions that shall have the functions prescribed as follows:
13731375 (1) The Business Development Division shall be
13741376 responsible for all of the functions of the Department of
13751377 Commerce as it existed before date determined pursuant to
13761378 Section 41-29-6, including, but not limited to, small business
13771379 advocacy; the functions performed by the Alabama Small
1378-Business Commission, created and functioning pursuant to

14191421 23 of Title 41, the Alabama Industrial Development and
14201422 Training Institute, formerly functioning pursuant to Sections
14211423 41-9-1080 to 41-9-1086, inclusive, and the Alabama Workforce
14221424 Council and the regional workforce councils of the Department
14231425 of Postsecondary Education, formerly functioning pursuant to
14241426 Sections 16-66-1 to 16-66-8, inclusive, and the Legislative
14251427 Oversight Commission of the Alabama Department of Economic and
14261428 Community Affairs, formerly functioning pursuant to Section
14271429 41-23-7.
14281430 Any transfer of personnel, appropriations, funds, or
14291431 property, real or personal from the Alabama Community College
14301432 System to the Department of Commerce pursuant to this
14311433 subdivision, shall be made with the cooperation and approval
14321434 of the Chancellor and the Board of Trustees of the Alabama
14331435 Community College System. "
