1515 SYNOPSIS:
1616 This bill would propose an amendment to the
1717 Constitution of Alabama of 2022, relating to Cherokee
1818 County, to authorize the Legislature to fix and
1919 regulate court costs by general or local law; and to
2020 ratify all previously collected court costs.

2323 AN ACT
2424 To propose an amendment to the Constitution of Alabama
2525 of 2022, relating to Cherokee County, to authorize the
2626 Legislature to fix and regulate court costs by general or
2727 local law; and to ratify all previously collected court costs.
2828 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2929 Section 1. The following amendment to the Constitution
3030 of Alabama of 2022, is proposed:
3131 PROPOSED AMENDMENT
3232 (a) The Legislature, by general or local law, may fix,
3333 regulate, and alter the costs and charges of courts in
3434 Cherokee County and provide for their distribution.
3535 (b) All court costs and charges collected in Cherokee
3636 County prior to the ratification of this amendment are hereby

6666 County prior to the ratification of this amendment are hereby
6767 ratified, validated, and confirmed.
6868 Upon ratification of this constitutional amendment, the
6969 Code Commissioner shall number and place this amendment as
7070 appropriate in the constitution omitting this instructional
7171 paragraph and may make the following nonsubstantive revisions:
7272 change capitalization, hierarchy, spelling, and punctuation
7373 for purposes of style and uniformity; correct manifest
7474 grammatical, clerical, and typographical errors; revise
7575 internal or external citations and cross-references; and
7676 translate effective dates.
7777 END PROPOSED AMENDMENT
7878 Section 2. An election upon the proposed amendment
7979 shall be held in accordance with Sections 284, 284.01, and 285
8080 of the Constitution of Alabama of 2022, and the election laws
8181 of this state. The appropriate election official shall assign
8282 a ballot number for the proposed constitutional amendment on
8383 the election ballot and shall set forth the following
8484 description of the substance or subject matter of the proposed
8585 constitutional amendment:
8686 "Relating to Cherokee County, proposing an amendment to
8787 the Constitution of Alabama of 2022, to authorize the
8888 Legislature to fix and regulate court costs by general or
8989 local law; and to ratify all previously collected court costs.
9090 Proposed by Act ____."
9191 This description shall be followed by the following
9292 language:
9393 Yes( ) No( )."
9494 Section 3. The proposed amendment shall become valid as

125125 part of the Constitution of Alabama of 2022, when approved by
126126 a majority of the qualified electors voting thereon.
