1515 SYNOPSIS:
1616 Existing law provides the Home Builders
1717 Licensure Board with authority to adopt residential
1818 building codes and standards of practices for
1919 residential home builders within this state and allows
2020 county commissions and municipalities to adopt building
2121 laws and codes within their respective jurisdictions.
2222 This bill would create the Alabama Residential
2323 Building Code Advisory Council to recommend an Alabama
2424 Residential Building Code, to be based upon the
2525 International Residential Code and the residential
2626 chapters of the International Energy Conservation Code,
2727 to be adopted by the Home Builders Licensure Board.
2828 This bill would require counties and
2929 municipalities that enforce residential building laws
3030 or codes, when adopting new codes or amending existing
3131 codes, to adopt or amend the codes in accordance with
3232 the minimum standards set by the Alabama Residential
3333 Building Code.
3434 This bill would require residential home
3535 builders in this state to build, renovate, and repair
3636 residences in accordance with the minimum standards set
3737 by the Alabama Residential Building Code.
3838 This bill would establish the Alabama

144144 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
145145 Section 1. Sections 34-14A-1 through 34-14A-20 are
146146 designated as Article 1 of Chapter 14A, Title 34, Code of
147147 Alabama 1975.

182182 (a) In the interest of the public health, safety,
183183 welfare, and consumer protection , and to regulate the home
184184 building and private residence construction industry, the
185185 purpose of this chapter , and the intent of the Legislature in
186186 passing it, is to:
187187 (1) To provide for the licensure of those persons who
188188 engage in home building, private residence construction, and
189189 home improvement industries, including remodeling , and to.
190190 provide home building standards
191191 (2) To establish an Alabama Residential Building Code.
192192 (3) To provide guidance, assistance, promotion, and
193193 support for code inspections of residential construction. and
194194 to
195195 (4) To support education within the construction trades
196196 and construction inspections in the State of Alabama.
197197 (b) The Legislature recognizes that the home building
198198 and home improvement construction industries are significant
199199 industries. Home builders may pose significant and that
200200 significant harm to the public may result from the provision
201201 of when unqualified, incompetent, or dishonest home builders
202202 and remodelers provide inadequate, unsafe, or inferior
203203 building services by unqualified, incompetent, or dishonest
204204 home builders and remodelers . The Legislature finds it
205205 necessary to regulate the residential home building and home
206206 improvement industries."

208208 As used in this chapter, the following terms shall have
209209 the following meanings, respectively, unless the context
210210 clearly indicates otherwise:

241241 (1) ADVERTISING. Engaging or offering to engage in any
242242 acts or services as a residential home builder by the act or
243243 practice of offering for sale professional services by
244244 promoting those services through print, radio or television
245245 media, on billboards, through social media, through
246246 promotional sponsorships, on vehicles, by the placement of
247247 signs in front of ongoing or completed worksites, or by
248248 displaying credentials, including licensure, to perform
249249 residential home building.
250250 (2) ALABAMA RESIDENTIAL BUILDING CODE. The code adopted
251251 by the board, as amended by the board, and based on a
252252 published edition of the International Residential Code, and
253253 the residential chapters of a published edition of the
254254 International Energy Conservation Code.
255255 (3) APPLICABLE RESIDENTIAL BUILDING CODE. The Alabama
256256 Residential Building Code or a local residential building code
257257 adopted by a county or municipality, pursuant to this chapter,
258258 where the construction, renovation, or repairs will take
259259 place.
260260 (1) ADVISORY COUNCIL. The Alabama Construction Trade
261261 Advisory Council.
262262 (2)(4) BOARD. The Home Builders Licensure Board.
263263 (3)(5) COST OF THE UNDERTAKING. The total cost of the
264264 materials, labor, supervision, overhead, and profit.
265265 (6) COUNCIL. The Alabama Residential Building Code
266266 Advisory Council.
267267 (7) DIVISION. The Alabama Residential Building Code
268268 Division.

299299 (4)(8) HOMEOWNER. A person who owns and resides in or
300300 intends to reside in a structure constructed or remodeled by a
301301 licensee of the board, or who contracts with a licensee for
302302 the purchase, construction, repair, improvement, or
303303 reimprovement of a structure to be used as a residence.
304304 (5)(9) IMPROVEMENT. Any site-built addition or
305305 enhancement attached to or detached from a residence or
306306 structure for use and enjoyment by the homeowner.
307307 (6)(10) INACTIVE LICENSE. A license issued at the
308308 request of a licensee, or a building official or a building
309309 inspector, that is renewable, but that is not currently valid.
310310 (7)(11) LICENSE. Any license issued by the board
311311 pursuant to this chapter.
312312 (8)(12) LICENSEE. A holder of any license issued
313313 pursuant to this chapter.
314314 (9)(13) PERSON. Any natural person individual, limited
315315 or general partnership, corporation, association, limited
316316 liability company, or other legal entity, or any combination
317317 thereof.
318318 (10)(14) QUALIFYING REPRESENTATIVE. The individual
319319 designated by a general partnership, limited partnership,
320320 corporation, limited liability company, or not-for-profit
321321 organization applying for a license who either holds a license
322322 individually or meets the experience and ability requirements
323323 for licensure, and who is one of the following:
324324 a. A general partner in the case of any partnership.
325325 b. An officer in the case of a corporation.
326326 c. A member in the case of a member-managed limited

356356 c. A member in the case of a member-managed limited
357357 liability company.
358358 d. A manager in the case of a manager-managed limited
359359 liability company.
360360 e. An individual who is affiliated with one of the
361361 member entities of a limited liability company and who has
362362 been identified and authorized through the operating agreement
363363 to manage day-to-day operations as it relates to operations of
364364 the limited liability company for purposes of licensure.
365365 (11)(15) RESIDENCE. A single unit providing complete
366366 independent residential living facilities for one or more
367367 persons, including permanent provisions for living, sleeping,
368368 eating, cooking, and sanitation.
369369 (12)(16) RESIDENTIAL HOME BUILDER. A person who
370370 constructs a residence or structure for sale or who, for a
371371 fixed price, commission, fee, or wage, undertakes or offers to
372372 undertake the construction or superintending of the
373373 construction, or who manages, supervises, assists, or provides
374374 consultation to a homeowner regarding the construction or
375375 superintending of the construction, of any residence or
376376 structure that is not over three floors in height and that
377377 does not have more than four residential units, or the repair,
378378 improvement, or reimprovement thereof, to be used by another
379379 as a residence when the cost of the undertaking exceeds ten
380380 thousand dollars ($10,000). Notwithstanding the foregoing, the
381381 term includes a residential roofer when the cost of the
382382 undertaking exceeds two thousand five hundred dollars
383383 ($2,500). Nothing herein shall prevent any person from
384384 performing these acts on his or her own residence or on his or

414414 performing these acts on his or her own residence or on his or
415415 her other real estate holdings. Anyone who engages or offers
416416 to engage in any acts described in this subdivision, through
417417 advertising or otherwise, shall be deemed to have engaged in
418418 the business of residential home building.
419419 (13)(17) RESIDENTIAL ROOFER. A person who installs
420420 products or repairs surfaces on the external upper covering of
421421 a residence or structure that seals, waterproofs, or
422422 weatherproofs the residence or structure.
423423 (14)(18) STRUCTURE. A residence on a single lot,
424424 including a site-built home, a condominium, a duplex or
425425 multi-unit residential building consisting of not more than
426426 four residential units, or any improvement thereto.
427427 (15)(19) TRANSACTION. The act of entering into a
428428 contract with a licensee to engage in the business of
429429 residential home building."

431431 (a) Any residential home builder who desires to receive
432432 a new or renewal license under this chapter shall make and
433433 file with the board 30 days prior to the next meeting of the
434434 board a written application on a form prescribed by the board.
435435 Each applicant shall be a citizen of the United States or, if
436436 not a citizen of the United States, a person who is legally
437437 present in the United States with appropriate documentation
438438 from the federal government. Such The application shall be
439439 accompanied by the payment of the annual license fee required
440440 by the board. After the board accepts the application, the
441441 applicant may be examined by the board at its next meeting.
442442 The board, in examining the applicant, shall consider the

472472 The board, in examining the applicant, shall consider the
473473 following qualifications of the applicant:
474474 (1) Experience.
475475 (2) Ability.
476476 (3) Character.
477477 (4) Business-related financial condition.
478478 a. The board may require a financial statement on a
479479 form prescribed by the board and a public records search
480480 directly from a credit reporting agency.
481481 b. The board may require a positive net worth or other
482482 evidence of business-related financial condition sufficient to
483483 reasonably satisfy the board of the applicant's financial
484484 responsibility.
485485 c. The board may require that business-related
486486 judgments, judgment liens, and other perfected liens must be
487487 satisfied and released.
488488 d. Any information obtained by the board pursuant to
489489 this subsection relating to the financial condition of an
490490 applicant shall not be public information.
491491 (5) Ability and willingness to serve the public and
492492 conserve the public health and safety.
493493 (6) Any other pertinent information the board may
494494 require.
495495 (b)(1) If the board finds the applicant qualified to
496496 engage in residential home building in Alabama, the applicant
497497 shall be issued a license. An applicant rejected by the board
498498 shall be given an opportunity to be reexamined after a new
499499 application has been filed and an additional application fee
500500 paid.

531531 (2) A record shall be made and preserved by the board
532532 of each examination and the findings of the board pertaining
533533 to the examination. A copy of the record shall be made
534534 available to any applicant requesting it upon the payment of a
535535 reasonable fee to the board.
536536 (c) The board, by rule, may require proof of and
537537 maintenance of insurance as a qualification for licensure.
538538 (d) The board, by rule, may establish or adopt, or
539539 both, education requirements and may approve, administer, or
540540 financially support the program or programs providing
541541 residential construction education.
542542 (e)(1) Each licensee shall notify the board within 10
543543 days after notice of the institution of any criminal
544544 prosecution against him or her. The notification shall be in
545545 writing, by certified mail, and shall include a copy of the
546546 specific charge made together with a copy of the indictment,
547547 information, or complaint, affidavit, and warrant making the
548548 charges.
549549 (2) Each licensee shall notify the board in writing by
550550 certified mail within 10 days after he or she receives the
551551 notice that any criminal verdict has been rendered against him
552552 or her, or that a criminal action pending against him or her
553553 has been dismissed.
554554 (f) Each licensee shall utilize use a valid written
555555 contract when engaging in the business of residential home
556556 building. In addition to any other requirements provided by
557557 law, the contract shall contain the licensee's license number
558558 issued by the board.

589589 (g) Whenever a licensee engages in advertising, the
590590 licensee shall ensure that the licensee's valid license number
591591 issued by the board is displayed.
592592 (g)(h) When any residential home building to be
593593 performed will comply with a program designed to enhance the
594594 resiliency of the structure beyond the requirements of the
595595 applicable building codes, the licensee shall disclose this
596596 compliance to the homeowner in writing prior to the
597597 commencement of the residential home building.
598598 (h)(1)(i)(1) Any licensee who desires to receive an
599599 inactive license shall make and file with the board a written
600600 application for an inactive license on a form prescribed by
601601 the board prior to the expiration of his or her current
602602 license. The application shall be accompanied by the payment
603603 of the annual inactive license fee required by the board. No
604604 act for which a license is required may be performed under an
605605 inactive license. In the event a person holding a current
606606 inactive license applies for a license, he or she may rely
607607 upon his or her inactive license as evidence of the experience
608608 and ability requirements for licensure under subdivisions (1)
609609 and (2) of subsection (a).
610610 (2) A person holding an expired license who seeks to
611611 reactivate his or her license within three years of the date
612612 of expiration shall be deemed to have satisfied the experience
613613 and ability requirements for licensure if application is made
614614 within the three-year time period and all other licensing
615615 requirements pursuant to subsection (a) have been met.

646646 (3) Any building official or building inspector who
647647 desires to receive an inactive license shall make and file
648648 with the board 30 days prior to the next meeting of the board
649649 a written application for an inactive license on a form
650650 prescribed by the board. After the board accepts the
651651 application, the applicant may be examined by the board at its
652652 next board meeting. The board, in examining the applicant,
653653 shall consider the following qualifications of the applicant
654654 as satisfying the experience and ability requirements for
655655 licensure:
656656 a. That the building inspector is an employee of the
657657 United States, the State of Alabama, or any municipality,
658658 county, or other political subdivision and, by virtue of that
659659 employment, is exempted or prohibited by law from holding a
660660 license; and
661661 b. That the building inspector does any of the
662662 following:
663663 1. Maintains current certification from the Southern
664664 Building Code Congress International as one of the following:
665665 (i) Chief building official.
666666 (ii) Deputy building official.
667667 (iii) Building inspector.
668668 (iv) Housing inspector.
669669 (v) Design professional.
670670 (vi) Plan reviewer.
671671 2. Maintains current certification from the
672672 International Code Council as one of the following:
673673 (i) Certified building official.
674674 (ii) Building inspector.

709709 3. Possesses sufficient building qualifications and
710710 experience to receive a license, as demonstrated by
711711 satisfactory evidence presented to the board.
712712 (4) In the event a building official or building
713713 inspector holding a current inactive license applies for a
714714 license, he or she may rely upon his or her inactive license
715715 as evidence of the experience and ability requirements for
716716 licensure under subdivisions (1) and (2) of subsection (a)."

718718 (a) The board may establish or adopt residential
719719 building codes and standards of practice for residential home
720720 builders within the state. A residential building code or
721721 standard of practice adopted or established by the board does
722722 not supersede or otherwise exempt residential home builders
723723 from a local building law or code adopted by the governing
724724 body of a county or municipality or from a local or general
725725 law.
726726 (a) The board shall have the sole authority to adopt
727727 the following codes:
728728 (1) The Alabama Residential Building Code, which shall
729729 apply to all construction and improvement governed by this
730730 chapter.
731731 (2) The Alabama Residential Energy Code, which shall
732732 apply to all residential construction and improvements.

763763 (b)(1) The Alabama Residential Building Code shall be
764764 enforced by local jurisdictions that have permitting and
765765 inspection programs for residential construction and
766766 improvements that are adhered to by residential home builders.
767767 The Alabama Residential Building Code does shall not supersede
768768 any local residential building code adopted by any county or
769769 municipality in effect on October 1, 2024.
770770 (2) The Alabama Residential Energy Code shall be
771771 enforced by local jurisdictions that have adopted energy code
772772 provisions for residential and commercial construction and
773773 improvements. Provided however, such provisions shall not
774774 exceed those contained within the Alabama Residential Energy
775775 Code.
776776 (3) A local building code adopted or amended by any
777777 county or municipality after October 1, 2024, shall meet the
778778 minimum standards of the Alabama Residential Building Code in
779779 effect at the time of the local building code adoption or
780780 amendment and shall not exceed the Alabama Residential Energy
781781 Code, unless compliance with any federal mandate requires such
782782 adoption or amendment.
783783 (4) Notwithstanding any other provision of law to the
784784 contrary, the Alabama Residential Building Code does not apply
785785 to any agricultural building except for any residence
786786 contained therein.
787787 (b)(c)(1) The county commissions of the several
788788 counties A county commission, by resolution, may adopt
789789 building laws and codes by ordinance which that shall apply in

820820 the unincorporated areas of the county. The county commission
821821 shall provide a copy of any resolution adopted pursuant to
822822 this subsection to the board within 10 business days of
823823 adopting the resolution.
824824 (2) A local building law or code adopted pursuant to
825825 this subsection may not take effect until 120 days after the
826826 resolution was adopted; provided, in the case of an insurance
827827 claim requiring work and activities for which a license is
828828 required by this chapter, the effective date for the building
829829 law or code shall be the date of adoption by the local
830830 jurisdiction.

832832 the building laws and codes of the county commission shall not
833833 apply within any municipal police jurisdiction outside of the
834834 corporate limits of the municipality , in which that
835835 municipality is exercising its building laws or codes, without
836836 the express consent of the governing body of that
837837 municipality. The building laws and codes of the county
838838 commission may apply within the corporate limits of any
839839 municipality only with the express consent of the governing
840840 body of the municipality.
841841 (4) The county commission may employ building
842842 inspectors to see that its laws or codes are not violated and
843843 that the plans and specifications for buildings are not in
844844 conflict with the ordinanceslaws and codes of the county and
845845 may exact fees to be paid by the owners of the property
846846 inspected.
847847 (5) The county commission, by resolution, may
848848 discontinue its administration and enforcement of the building

879879 laws and codes. However, the discontinuation shall not take
880880 effect until 120 days after the resolution was adopted. The
881881 county commission shall provide a copy of the resolution to
882882 the board within 10 business days of adopting the resolution.
883883 (c)(d) Utilizing the same authority and procedures as
884884 municipalities pursuant to Sections 11-53A-20 to 11-53A-26,
885885 inclusive, the county commission may condemn buildings, parts
886886 of buildings, or structures dangerous to the public and
887887 prohibit the use thereof and abate the same as a nuisance.
888888 (d)(e) The county commissions, municipalities, and
889889 other public entities may enter into mutual agreements,
890890 compacts, and contracts for the administration and enforcement
891891 of their respective building laws and codes. A county
892892 commission or municipality shall provide a copy of the mutual
893893 agreement, compact, or contract to the board within 10
894894 business days of its execution.
895895 (f) A county commission or municipality shall provide
896896 to the board a copy of any resolution, ordinance, or agreement
897897 adopted pursuant to Section 11-40-10(b)(2) within 10 business
898898 days of its adoption.
899899 (g) Nothing in this section shall be construed to
900900 restrict the power of any county or municipality to adopt and
901901 enforce local building laws or codes that either comply with
902902 or exceed the minimum standards of the Alabama Residential
903903 Building Code; provided the local laws or codes are adopted or
904904 amended in accordance with this chapter. "

936936 (a) The Alabama Construction Trade Academy Fund is
937937 established in the State Treasury. The fund shall be comprised
938938 of federal, state, and private funding through direct
939939 budgetary funding and grants for the expansion of construction
940940 trade education. To the extent practicable, monies in the fund
941941 shall be used to leverage other forms of funding from private
942942 sources. A percentage of matching funds, as established by the
943943 advisory council, must come from private, non-governmental
944944 sources. The board may not use more than 15 percent of the
945945 monies in the fund for administrative and operational costs
946946 incurred in the implementation and administration of this
947947 section. The board's statutory obligations pursuant to this
948948 chapter shall be contingent upon the appropriation of funding.
949949 (b) The board, in cooperation with public and private
950950 sector partners, shall establish a program to provide funding
951951 mechanisms for tool grants, program incentives, supplies,
952952 mobile facilities, and other programs to support the
953953 development and continuation of construction trade education
954954 programs in the state.
955955 (c) The board shall administer the program and shallmay
956956 apply for funds from federal grant programs and other
957957 applicable funding sources authorized by law.
958958 (d)(1) The Alabama Construction Trade Advisory Council
959959 is established. The advisory council shall consist of the
960960 following members:
961961 a. One member appointed by and currently serving on the
962962 Home Builders Licensure Board.
963963 b. One member appointed by and currently serving on the

10151015 promote the program statewide, evaluate applications for
10161016 funds, distribute funds, and monitor and report the effect of
10171017 the funding on the availability of construction trade
10181018 education. The board may adopt rules to implement and
10191019 administer this section.
10201020 (f) The advisory council shall recommend and the board
10211021 shall establish monitoring and accountability mechanisms for

10531053 legislative day of each regular legislative session, the board
10541054 shall file a report to the Legislature on the projects funded,
10551055 the geographic distribution of projects funded, the private
10561056 sector participation rates in funded projects, the
10571057 administrative costs of the program, and the outcomes of the
10581058 program, including the number of students and adult learners
10591059 trained by each project funded through the program.
10601060 (g) The advisory council shall recommend and the board
10611061 shall create eligibility guidelines and provide project
10621062 funding through an application process. Projects eligible for
10631063 funding include the following:
10641064 (1) Mobile demonstration units that show the various
10651065 systems of a structure and how they interconnect.
10661066 (2) Tool and supply grants for public and private
10671067 educational providers that provide construction trade
10681068 education.
10691069 (3) Incentives for newly established construction trade
10701070 education courses, with priority given to carpentry courses.
10711071 (4) Adult education initiatives that provide continued
10721072 learning opportunities through mobile training facilities or
10731073 distance learning opportunities with priority focus on those
10741074 serving underserved areas and widely offered trainings.
10751075 (5) Any other proposal that in the opinion of the board
10761076 would address the need for construction trade education in the
10771077 state.
10781078 (h) An applicant may be a nonprofit organization,
10791079 not-for-profit entity, public school system, two-year college,

11141114 (2) Demonstrate how the proposal shall positively
11151115 impact construction trade education in the state.
11161116 (3) Demonstrate private sector support through matching
11171117 funding.
11181118 (4) Establish an advisory council consisting of at
11191119 least three active trade representatives from the construction
11201120 trade being funded.
11211121 (5) For a period of not less than five years, agree to
11221122 comply with the following conditions:
11231123 a. Offer the courses funded through this section for a
11241124 period of not less than five years.
11251125 b. Comply with all data collection and reporting
11261126 requirements established by the board.
11271127 (i) In determining which qualified projects to fund,
11281128 the board shall consider all of the following factors:
11291129 (1) The level of private sector support for the
11301130 project.
11311131 (2) The level of need in the area in which the funding
11321132 is directed.
11331133 (3) The projected number of students that will be
11341134 served.
11351135 (4) The degree to which the project will have a
11361136 positive impact on the availability of construction trade
11371137 education in the area to be served.

11711171 require matching funds on all funded projects. A minimum of 10
11721172 percent of matching funds shall be provided by private,

11741174 not be required to exceed 25 percent of awarded state funds,
11751175 although additional consideration may be provided to projects
11761176 that exceed this amount.
11771177 (k) In the event that a recipient of funding provided
11781178 by this section fails to provide the proposed project in
11791179 accordance with the guidelines set forth by the board, any
11801180 equipment, supplies, or materials acquired with the funding
11811181 shall be transferred to the Alabama Home Builders Foundation
11821182 for redistribution to public or private programs that provide
11831183 construction trade education to high school, postsecondary, or
11841184 adult learners supported by this section.
11851185 (l) Any and all proceeds from the sale of equipment,
11861186 supplies, or materials acquired through academy funding shall
11871187 go into the fund."

12281228 (a) Beginning on October 1, 2024, the Home Builders
12291229 Licensure Board and any other state, municipal, or county
12301230 governing body may not adopt or amend a building code,
12311231 ordinance, resolution, or rule that would restrict a
12321232 consumer's ability to elect to install, by the consumer's
12331233 choice and for a fee, or require the installation of, a
12341234 residential fire sprinkler system in any residence or
12351235 structure as defined by this chapter.
12361236 (b) Notwithstanding subsection (a), a county commission
12371237 or municipal governing body that adopted any ordinance,
12381238 resolution, or other building code on or before March 9, 2010,
12391239 relating to the installation of a residential fire sprinkler
12401240 system, may continue to enforce or amend the ordinance,
12411241 resolution, or building code.

13501350 (c) No funds shall be withdrawn or expended except as
13511351 budgeted and allotted according to Sections 41-4-80 to
13521352 41-4-96, inclusive, and 41-19-1 to 41-19-12, inclusive, and
13531353 only in amounts as stipulated in the general appropriations
13541354 act, other appropriation acts, or this section.
13551355 (d) At the end of each fiscal year, any unencumbered
13561356 balance of up to 25 percent of the amount appropriated for
13571357 that fiscal year shall not revert to the State General Fund
13581358 under Section 41-4-93, but shall carry over to the next fiscal

15231523 majority of all the members of the council. An agenda for the

15771577 published edition of the Alabama Energy and Residential Code
15781578 as adopted and amended from the International Residential Code
15791579 (IRC) and the International Energy Conservation Code (IECC).
15801580 Subsequent recommendations for adoptions or amendments to the
15811581 Alabama Residential Building Code shall be based upon
15821582 published editions of the IRC and IECC. In addition, the
15831583 council shall take into consideration provisions for sealed
15841584 roof decks and related roof construction standards contained
15851585 in either the Coastal Construction Code Supplement or the

15891589 (c) The council shall make recommendations with respect
15901590 to all matters pertaining to the implementation of the Alabama

16551655 this nation. It is also important to ensure the protection of

16571657 citizensresidents. It is the intent of the Legislature to do
16581658 each of the following pursuant to this article:
16591659 (1) Encourage the conservation and efficient use of
16601660 residential energy resources within this state's counties and

16971697 adopting the Alabama Energy and Residential Codes Alabama
16981698 Commercial Energy Code and implementing those code provisions
16991699 within their boundaries.
17001700 (4) Promote the identification of energy management
17011701 technologies available for residentialcommercial uses, and to
17021702 disseminate information to the units of local government about
17031703 such technologies and their uses.
17041704 (5) Promote the acceptance and adoption of those energy
17051705 management technologies for use in all energy-consuming
17061706 residentialcommercial facilities throughout this state.
17071707 (6) Provide a process for the adoption of modern
17081708 building and energy codes by the State of Alabama.
17091709 (7) Provide a process by which the State of Alabama
17101710 shall adopt required commercial codes in compliance with
17111711 federal law."

17641764 (a) The Alabama Energy and Residential Codes Commercial
17651765 Energy Code Board is established.
17661766 (b) The board shall consist of 1513 members appointed
17671767 by the Governor and two additional members, numbered 1614 and
17681768 1715, appointed by the Chair of the Permanent Joint
17691769 Legislative Committee on Energy Policy. The members appointed
17701770 by the Governor shall be legal residents of the state, and
17711771 shall be selected on the basis of their representation of the

18691869 (c) Each member appointed by the Governor shall be
18701870 selected from a list of three candidates provided to the
18711871 Governor by the division from each entity listed above. Board
18721872 appointees shall be selected on the basis of their interest in
18731873 problems concerning residentialcommercial energy resources,
18741874 consumption, and conservation, and without regard to political
18751875 affiliation. Appointments shall be of such a nature as to aid
18761876 the work of the board and to inspire the highest degree of
18771877 coordination and cooperation. All members of the board shall
18781878 be deemed members at-large charged with the responsibility of
18791879 serving the best interests of the board, the division, the
18801880 units of local government, and the state. No member shall act
18811881 as the representative of any particular region, United States
18821882 congressional district in Alabama, or state Senate or
18831883 legislative district in Alabama.
18841884 (d) The board shall exercise authority with respect to
18851885 all matters pertaining to the acceptance, adoption, and
18861886 implementation of the Alabama Energy and Residential
18871887 CodesCommercial Energy Code by the State of Alabama. Decisions
18881888 of the board shall be administered by the chief of the
18891889 division with the assistance of such other officers and
18901890 department employees as are deemed necessary to carry out the
18911891 purpose, functions, duties, and activities of the board.
18921892 (e) The membership of the board shall be inclusive and

19221922 (e) The membership of the board shall be inclusive and
19231923 should reflect the racial, gender, geographic,
19241924 urban/ruralurban, rural, and economic diversity of the state.
19251925 (f) This article shall not apply to the erection or
19261926 construction of a farm structure. The term farm structure, for
19271927 the purposes of this actsubsection, means a structure that is
19281928 constructed on a farm, other than a residence or a structure
19291929 attached to it, for use on the farm including, but not limited
19301930 to, barns, sheds, and poultry houses. A farm structure does
19311931 not include a structure originally qualifying as a farm
19321932 structure but later converted to another use."
19331933 "§41-23-84
19341934 (a) The first meeting of the board shall be called by
19351935 the chief of the division as soon as is practicable after July
19361936 31, 1995. The division chief shall preside until a chair and a
19371937 vice chair are selected by the board. The board shall elect
19381938 annually from its own members a chair, a vice chair, and such
19391939 other officers as it may deem desirable, and shall adopt rules
19401940 for its organization in the conduct of its business.
19411941 (b) The board shall hold a regular meeting at least
19421942 once during each calendar year at a time and place as
19431943 designated or specified in its rules. Special or additional
19441944 meetings may be held on a call of the chair, upon a call
19451945 signed by at least seven members, or upon a call by the
19461946 division chief.
19471947 (c) A majority of the members of the board shall
19481948 constitute a quorum at all its meetings, and adoption or
19491949 resolution of any business shall require the concurrence of a

19811981 meetings in sufficient detail to indicate the terms on which
19821982 final action is contemplated shall be mailedprovided by the
19831983 division chief to the chair, vice chair, and board members at
19841984 least 30 days prior to the meeting.
19851985 (d) The division chief shall serve as ex officio
19861986 secretary of the board, and shall keep a record of the
19871987 proceedings of all board meetings , and perform such other
19881988 duties as may be delegated by the board. The division chief
19891989 shall not receive any additional compensation for the
19901990 performance of those duties on the board or pursuant to this
19911991 article.
19921992 (e) The board may establish committees among its
19931993 membership, as it deems necessary, to assist in the conduct of
19941994 its business. Subcommittees shall include representation from
19951995 suppliers or others interested in the subject matter assigned
19961996 to the subcommittees, or both.
19971997 (f) All meetings of the board shall be held in
19981998 accordance with the Alabama Open Meetings Act, Chapter 25A of
19991999 Title 36."

20012001 (a) The board shall exercise authority with respect to

20522052 adopting, and implementing the Alabama Energy and Residential
20532053 CodesCommercial Energy Code , and in meeting the need for
20542054 increasing residential energy resources and conservation due
20552055 to trends in residential population and the change in
20562056 technical requirements of the economy.
20572057 (5) Make continuing studies, on its own initiative or
20582058 upon the request of the division, of the residential energy
20592059 resources, conservation, and consumption needs throughout the
20602060 state, and issue those reports to the division and to the
20612061 units of local government as may result from its studies.
20622062 (6) Submit to the chief of the division, on an annual
20632063 basis, a written report covering the activities of the board.
20642064 (7) Make rules and regulations for the conduct of its
20652065 board meetings, procedures, and execution of the purpose,
20662066 functions, powers, and duties delegated to it by this article.

21042104 (b) The division shall be responsible for taking action
21052105 upon any and all recommendations to which the board may from
21062106 time to time submit.
21072107 (c)(1) Except as provided in this section, any code
21082108 adopted by any state or county entity or agency after March 9,
21092109 2010, shall not conflict with the codes adopted by the board.
21102110 A county entity or agency may elect to amend the Alabama
21112111 Energy and Residential Codes Commercial Energy Code as local
21122112 conditions require, but shall not make any amendment to
21132113 mandate residential fire sprinklers or to provisions which are
21142114 mandated or required by any federal law or federal regulation.
21152115 (2) As of March 9, 2010, any municipality which that
21162116 does not have a code in effect adopted pursuant to Section
21172117 11-45-8 shall not adopt any energy or residential code other
21182118 than the Alabama Commercial Energy and Residential Codes
21192119 adopted by the board or any newer versions thereof. Provided,
21202120 however, a municipality may elect to amend the Alabama Energy
21212121 and Residential Codes Commercial Energy Code as local
21222122 conditions require, but shall not make any amendment to
21232123 mandate residential fire sprinklers or to provisions which are
21242124 mandated or required by any federal law or federal regulation.

21552155 (3) Except as provided in subsection (d), nothing

21572157 municipality with a code adopted pursuant to Section 11-45-8
21582158 in effect as of March 9, 2010, nor shall it anything in this
21592159 article prevent any such municipality from making any changes
21602160 or amendments to existing codes after March 9, 2010. Provided,
21612161 however, that a municipality shall not make any amendment to
21622162 provisions which are mandated by any federal law or federal
21632163 regulation.
21642164 (d) A municipal, county, or state governing entity or
21652165 agency may not enact an ordinance, rule, bylaw, order,
21662166 building code, or other legal device that would restrict a
21672167 consumer's ability to elect to install, by the consumer's
21682168 choice and for a fee, a residential fire sprinkler system in
21692169 any new or existing one-family or two-family dwelling. A
21702170 municipal, county, or state governing entity or agency may not
21712171 enact an ordinance, rule, bylaw, order, building code, or
21722172 other legal device that would require the installation of a
21732173 residential fire sprinkler system in any new or existing
21742174 one-family or two-family dwelling. Provided, however, all
21752175 municipalities governed by subdivision (3) of subsection (c)
21762176 which have enacted any ordinance, rule, bylaw, order, building
21772177 code, or other legal device as of March 9, 2010, relating to
21782178 the installation of a residential fire sprinkler system may
21792179 continue to enforce or amend such ordinance, rule, bylaw,
21802180 order, building code, or other legal device. "
21812181 Section 7. (a) A local building code adopted or
21822182 amended by any county or municipality after October 1, 2024,

22192219 (b) A county commission or municipality shall provide
22202220 to the board a copy of any resolution, ordinance, or agreement
22212221 adopted pursuant to Section 11-40-10(b)(2), Code of Alabama
22222222 1975, within 10 business days of its adoption.
22232223 Section 8. This act shall become effective on October
22242224 1, 2024.
