	17	+	AN ACT
16	18		To authorize the Sheriff of Montgomery County to
17	19		establish procedures to make limited purchases using a credit
18	20		card provided the proper procedures are followed.
19	21		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20	22		Section 1.(a) For the purposes of this act, the term
21	23		"credit card" means a line of credit issued by a domestic
22	24		lender or credit card bank.
23	25		(b) To provide for convenience in making purchases of
24	26		tangible personal property or services approved by the
25	27		sheriff, the Sheriff of Montgomery County may establish
26	28		procedures to make certain purchases through use of a credit
27	29		card issued to the Montgomery County Sheriff's Office. The
28	30		sheriff may adopt written policy and procedures governing the
29	31		utilization of credit cards which, at a minimum, shall include
30	32		each of the following:
31	33		(1) A monetary limit on the amount of any individual
32	34		purchase which may be made with a credit card.
33	35		(2) A monetary limit on the total monthly amount that
34	36		may be purchased with a credit card taking into consideration
35	37		the monetary limit of the discretionary fund used.
36		-	(3) Procedures to ensure that only the sheriff or his
37		-	or her designee has sole access to any credit card, credit
38		-	card numbers, access codes, or security codes.
39		-	(4) Procedures to keep accurate records of all
40		-	purchases made with a credit card which shall be periodically
41		-	reviewed during required audits.

	68	+	(3) Procedures to ensure that only the sheriff or his
	69	+	or her designee has sole access to any credit card, credit
	70	+	card numbers, access codes, or security codes.
	71	+	(4) Procedures to keep accurate records of all
	72	+	purchases made with a credit card which shall be periodically
71	73		reviewed during required audits.
72	74		(5) Procedures to ensure that all credit card bills are
73	75		carefully reviewed by the sheriff each month to make sure that
74	76		no unauthorized charges appear on the bill.
75	77		(6) Procedures to ensure that all credit card bills are
76	78		paid in full on a timely basis each month to avoid service
77	79		charges, late fees, or interest payments.
78	80		(7) The sheriff shall select the credit card provider
79	81		or providers taking into consideration each of the following:
80	82		a. Whether the credit card issuer requires an annual
81	83		fee for utilizing the card.
82	84		b. Whether the credit card issuer offers rewards or
83	85		rebates based upon purchases made utilizing the account.
84	86		c. What interest rates, service charges, finance
85	87		charges, or late fees will be assessed in the event a bill
86	88		from the credit card issuer is paid late or the balance is not
87	89		paid in full.
88	90		d. Whether penalties or fees will be assessed against
89	91		the sheriff in the event he or she decides to terminate the
90	92		credit card.
91	93		e. Any other consideration deemed relevant by the
92	94		sheriff.
93	95		(c) In the event the credit card provides rewards or
94		-	rebates based upon the use of the card, any rewards or rebates
95		-	earned from the card shall be deposited in the Sheriff's Fund
96		-	of Montgomery County.
97		-	Section 2. This act shall become effective October 1,
98		-	2024.

	125	+	(c) In the event the credit card provides rewards or
	126	+	rebates based upon the use of the card, any rewards or rebates
	127	+	earned from the card shall be deposited in the Sheriff's Fund
	128	+	of Montgomery County.
	129	+	Section 2. This act shall become effective October 1,
