1515 SYNOPSIS:
1616 Under existing law, a person commits the crime
1717 of possession of obscene matter if he or she knowingly
1818 possesses any obscene matter that contains a visual
1919 depiction of a person under the age of 17 years engaged
2020 in any act of sado-masochistic abuse, sexual
2121 intercourse, sexual excitement, masturbation, breast
2222 nudity, genital nudity, or other sexual conduct.
2323 This bill would provide that a person commits
2424 the crime of trafficking in obscene matter if he or she
2525 possesses 25 or more items of obscene matter that
2626 contains a visual depiction of an individual under 17
2727 years of age engaged in any act of sado-masochistic
2828 abuse, sexual intercourse, sexual excitement,
2929 masturbation, breast nudity, genital nudity, or other
3030 sexual conduct.
3131 This bill would also provide penalties for
3232 violations.

6666 Relating to crimes and offenses; to amend Section
6767 13A-12-192, Code of Alabama 1975; to provide for the offense
6868 of trafficking in obscene material; and to provide penalties
6969 for violations.
7070 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7171 Section 1. Section 13A-12-192, Code of Alabama 1975, is
7272 amended to read as follows:
7373 "ยง13A-12-192
7474 (a) Any person who knowingly possesses with intent to
7575 disseminate any obscene matter that contains a visual
7676 depiction of a person under the age of 17 years engaged in any
7777 act of sado-masochistic abuse, sexual intercourse, sexual
7878 excitement, masturbation, breast nudity, genital nudity, or
7979 other sexual conduct shall be guilty of a Class B felony. Any
8080 transfer of the visual depiction from any electronic device to
8181 any other device, program, application, or any other place
8282 with storage capability which can be made available or is
8383 accessible by other users, is prima facie evidence of
8484 possession with intent to disseminate.
8585 (b) Any person who knowingly possesses any obscene
8686 matter that contains a visual depiction of a person under the
8787 age of 17 years engaged in any act of sado-masochistic abuse,
8888 sexual intercourse, sexual excitement, masturbation, breast
8989 nudity, genital nudity, or other sexual conduct shall be
9090 guilty of a Class C felony.
9191 (c) Any person who knowingly possesses 25 or more items
9292 of obscene matter that contain a visual depiction of an
9393 individual under 17 years of age engaged in any act of
9494 sado-masochistic abuse, sexual intercourse, sexual excitement,

127127 Trafficking in obscene material is a Class B felony. "
128128 Section 2. This act shall become effective on October
