15	15	SYNOPSIS:
16	16	Under existing law, a person commits the crime
17	17	of possession of obscene matter if he or she knowingly
18	18	possesses any obscene matter that contains a visual
19	19	depiction of a person under the age of 17 years engaged
20	20	in any act of sado-masochistic abuse, sexual
21	21	intercourse, sexual excitement, masturbation, breast
22	22	nudity, genital nudity, or other sexual conduct.
23	23	This bill would provide that a person commits
24	24	the crime of trafficking in obscene matter if he or she
25	25	possesses 25 or more items of obscene matter that
26	26	contains a visual depiction of an individual under 17
27	27	years of age engaged in any act of sado-masochistic
28	28	abuse, sexual intercourse, sexual excitement,
29	29	masturbation, breast nudity, genital nudity, or other
30	30	sexual conduct.
31	31	This bill would also provide penalties for
32	32	violations.

68	68	of trafficking in obscene material; and to provide penalties
69	69	for violations.
70	70	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
71	71	Section 1. Section 13A-12-192, Code of Alabama 1975, is
72	72	amended to read as follows:
73	73	"§13A-12-192
74	74	(a) Any person who knowingly possesses with intent to
75	75	disseminate any obscene matter that contains a visual
76	76	depiction of a person under the age of 17 years engaged in any
77	77	act of sado-masochistic abuse, sexual intercourse, sexual
78	78	excitement, masturbation, breast nudity, genital nudity, or
79	79	other sexual conduct shall be guilty of a Class B felony. Any
80	80	transfer of the visual depiction from any electronic device to
81	81	any other device, program, application, or any other place
82	82	with storage capability which can be made available or is
83	83	accessible by other users, is prima facie evidence of
84	84	possession with intent to disseminate.
85	85	(b) Any person who knowingly possesses any obscene
86	86	matter that contains a visual depiction of a person under the
87	87	age of 17 years engaged in any act of sado-masochistic abuse,
88	88	sexual intercourse, sexual excitement, masturbation, breast
89	89	nudity, genital nudity, or other sexual conduct shall be
90	90	guilty of a Class C felony.
91	91	(c) Any person who knowingly possesses 25 or more items
92	92	of obscene matter that contain a visual depiction of an
93	93	individual under 17 years of age engaged in any act of
94	94	sado-masochistic abuse, sexual intercourse, sexual excitement,

127	127	Trafficking in obscene material is a Class B felony. "
