1515 SYNOPSIS:
1616 Under existing law, the Alabama Jobs Act
1717 provides incentives for certain qualifying business
1818 activities to stimulate job creation and capital
1919 investment for new and existing businesses within
2020 Alabama.
2121 This bill would amend the definition of a
2222 "renewable energy generation facility" which is an
2323 activity eligible for incentives under the Alabama Jobs
2424 Act.

2828 Relating to the Alabama Jobs Act; to amend Section
2929 40-18-372, Code of Alabama 1975, to amend the definition of a
3030 renewable energy generation facility.
3131 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3232 Section 1. Section 40-18-372, Code of Alabama 1975, is
3333 amended to read as follows:
3434 "§40-18-372
3535 A qualifying project must be found by the Secretary of
3636 Commerce to conduct an activity specified in subdivision (1)

6666 Commerce to conduct an activity specified in subdivision (1)
6767 and to meet the minimum standard set forth in subdivision (2).
6868 (1) A qualifying project must predominantly conduct an
6969 activity that is any one or more of the following:
7070 a. Described by NAICS Code 1133, 115111, 2121, 22111,
7171 221330, 31 (other than 311811), 32, 33, 423, 424, 482, 4862,
7272 48691, 48699, 48819, 4882, 4883 (other than 48833), 493, 511,
7373 5121 (other than 51213), 51221, 517, 518 (without regard to
7474 the premise that data processing and related services be
7575 performed in conjunction with a third party), 51913, 52232,
7676 54133 (if predominantly in furtherance of another activity
7777 described in this article), 54134 (if predominantly in
7878 furtherance of another activity described in this article),
7979 54138, 5415, 541614, 5417, 55 (if not for the production of
8080 electricity), 561422 (other than establishments that originate
8181 telephone calls), 562213, 56291, 56292, 611512, 927, or 92811.
8282 b. The production of biofuel as such term is defined in
8383 Section 2-2-90(c)(2).
8484 c. A renewable energy generation facility may be one of
8585 the following:
8686 1. A facility that is owned by one or more electric
8787 providers, as the term is defined in Section 37-16-3, for
8888 providing electric service at retail in Alabama .
8989 2. A "qualifying facility" (QF) as defined by the
9090 Energy Information Administration (EIA) as a cogeneration or
9191 small power production facility that meets certain ownership,
9292 operating, and efficiency criteria established by the Federal
9393 Energy Regulatory Commission (FERC) pursuant to the Public

123123 Energy Regulatory Commission (FERC) pursuant to the Public
124124 Utility Regulatory Policies Act (PURPA).
125125 3. An "independent power producer" as defined by EIA as
126126 a corporation, person, agency, authority, or other legal
127127 entity or instrumentality that owns or operates facilities for
128128 the generation of electricity for use primarily by the public .
129129 For purposes of this subdivision, an "electric
130130 provider" shall also include an authority as defined in
131131 Section 11-50A-1. In the case of an electric provider that is
132132 also a tax-exempt organization under the Internal Revenue
133133 Code, notwithstanding Section 40-18-376(b)(3), any investment
134134 credit may be transferred for the entire term of the project
135135 agreement, as approved by the Governor. A "renewable energy
136136 generation facility" as used in this subdivision shall include
137137 any tangible property that is part of renewable energy
138138 generation, including any addition, modification, expansion,
139139 or upgrade to transmission or distribution systems that is
140140 required to accommodate the interconnection of renewable
141141 energy generation.
142142 d. The conduct of original investigations undertaken on
143143 a systematic basis to gain new knowledge or the application of
144144 research findings or other scientific knowledge to create new
145145 or significantly improved products or processes.
146146 e. The national or regional headquarters for a company
147147 that conducts significant business operations outside the
148148 state and that will serve as the principal office of the
149149 company'’s principal operating officer with chief
150150 responsibility for the daily business operations of the
151151 company.

182182 f. A target of the state '’s economic development
183183 efforts pursuant to the Accelerate Alabama Strategic Economic
184184 Development Plan adopted in January 2012 by the Alabama
185185 Economic Development Alliance, created by Executive Order
186186 Number 21 of the Governor on July 18, 2011, or any amended
187187 version or successor document thereto.
188188 g. A type listed in a rule adopted by the Department of
189189 Commerce, other than an emergency rule.
190190 Notwithstanding the foregoing, a qualifying project may
191191 not engage predominantly in farming activities involving
192192 trees, animals, or crops, and a qualifying project may not
193193 engage predominantly in the retail sale of tangible personal
194194 property or services, and may not be a shopping center,
195195 restaurant, movie theater, bowling alley, fitness center,
196196 miniature golf course, nightclub, gaming facility, or
197197 establishment serving the local community. However, if the
198198 excluded activities are not the predominant activity at the
199199 project, and if the project is otherwise a qualifying project,
200200 then the project agreement may provide that the capital
201201 investment may include costs related to excluded activities
202202 that are ancillary to the primary business conducted as part
203203 of the project. This provision shall not be deemed to exclude
204204 customer service centers, call centers or headquarters
205205 otherwise allowed by this subdivision.
206206 (2) A qualifying project shall create a significant
207207 number of new jobs for the area in which the qualifying
208208 project shall be located. Absent a finding of extraordinary
209209 circumstances by the Secretary of Commerce, a qualifying

239239 circumstances by the Secretary of Commerce, a qualifying
240240 project shall employ either of the following number of new
241241 employees:
242242 a. Any number of new employees, for a qualifying
243243 project in which the predominant activity involves chemical
244244 manufacturing, data centers, renewable energy generation,
245245 engineering, design, or research, metal/machining technology
246246 or toolmaking; or
247247 b. At least 50 new employees, for all other qualifying
248248 projects."
249249 Section 2. This act shall become effective on October
250250 1, 2024.
