18	18	Relating to the Town of White Hall in Lowndes County;
19	19	to allow the authorization of pari-mutuel wagering on
20	20	simulcast past events and live horse and dog races under
21	21	certain conditions.
22	22	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	23	Section 1. As used in this act, the following words
24	24	have the following meanings:
25	25	(1) COUNCIL. The Town Council of the Town of White Hall
26	26	in Lowndes County.
27	27	(2) LICENSEE. A person or entity licensed by the
28	28	council to conduct charitable bingo pursuant to Sections
29	29	43A-2.00 or 43A-2.01 of the Constitution of Alabama of 2022,
30	30	with the mailing address of 6999 Highway 80 West, Hayneville,
31	31	Alabama 36040.
32	32	(3) SIMULCAST. Televised or broadcast by other
33	33	electronic means.
34	34	Section 2. The council may authorize the licensee to
35	35	conduct pari-mutuel wagering on simulcast past events and live
36	36	horse and greyhound races.
37	37	Section 3. (a) The council shall adopt rules specifying

67	67	Section 3. (a) The council shall adopt rules specifying
68	68	the conditions under which the licensee, as part of its
69	69	licensed activity, may cause simulcast programming of
70	70	pari-mutuel events, including both past events and live horse
71	71	racing and greyhound racing, held at racetracks located
72	72	outside the state to be transmitted for public viewing to the
73	73	licensee and there made the subject of pari-mutuel wagering.
74	74	(b) Subject to the exceptions as the council may
75	75	approve by rule in order to satisfy applicable requirements of
76	76	federal law, all pari-mutuel wagering with respect to racing
77	77	events that are the subject of simulcast programming shall be
78	78	subject to the rules of the council governing pari-mutuel
79	79	wagering.
80	80	(c) The council shall be entitled to no revenues from
81	81	the simulcast programming of racing events other than the
82	82	following:
83	83	(1) The commission horse wagering fee due with respect
84	84	to that part of the horse racing handle wagered in simulcast
85	85	horse racing events by bettors placing bets at the facility in
86	86	the jurisdiction of the council.
87	87	(2) The commission greyhound wagering fee due with
88	88	respect to that part of the greyhound wagering handle wagered
89	89	on simulcast greyhound racing events by bettors placing bets
90	90	at the facility in the jurisdiction of the council.
91	91	(d)(1) If permitted by federal law and made possible by
92	92	contractual arrangements with the operator of the racetrack
93	93	that originates the simulcast programming, the licensee may
94	94	conduct pari-mutuel wagering on past events and live horse
95	95	racing or greyhound racing events simulcast to the facility in

125	125	racing or greyhound racing events simulcast to the facility in
126	126	the municipal jurisdiction of the council from locations
127	127	outside the state.
128	128	(2) When conducting pari-mutuel wagering under
129	129	subdivision (1), the pari-mutuel pools for the wagering may be
130	130	limited to bets made by bettors placing bets at the facility
131	131	located in the jurisdiction of the council or, alternatively,
132	132	the pari-mutuel pools may include bets made by bettors placing
133	133	bets at the facility that conducts the simulcast event, as
134	134	well as bets made by bettors placing bets at one or more
135	135	locations outside the state; provided that to the extent
136	136	bettors placing bets at the facility located in the
137	137	jurisdiction of the council participate in the pari-mutuel
138	138	pools, the total amount wagered by the bettors shall be
139	139	administered in accordance with the rules of the council.
140	140	Section 4. Nothing contained in this act shall be
141	141	construed to authorize or make lawful "off-track betting" or
142	142	wagering or gambling of any kind at any location in the state
143	143	other than at the facility licensed by the council. All laws
144	144	of the state, whether local or general, and all ordinances of
145	145	any political subdivision thereof, that prohibit, restrict, or
146	146	regulate wagering or gambling of any kind outside the
147	147	jurisdiction of the council shall not be affected by this act,
148	148	and shall remain in full force and effect.
149	149	Section 5. This act shall become effective on the first
150	150	day of the third month following its passage and approval by
151	151	the Governor, or its otherwise becoming law.
