1717 AN ACT
1818 Relating to the Town of White Hall in Lowndes County;
1919 to allow the authorization of pari-mutuel wagering on
2020 simulcast past events and live horse and dog races under
2121 certain conditions.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. As used in this act, the following words
2424 have the following meanings:
2525 (1) COUNCIL. The Town Council of the Town of White Hall
2626 in Lowndes County.
2727 (2) LICENSEE. A person or entity licensed by the
2828 council to conduct charitable bingo pursuant to Sections
2929 43A-2.00 or 43A-2.01 of the Constitution of Alabama of 2022,
3030 with the mailing address of 6999 Highway 80 West, Hayneville,
3131 Alabama 36040.
3232 (3) SIMULCAST. Televised or broadcast by other
3333 electronic means.
3434 Section 2. The council may authorize the licensee to
3535 conduct pari-mutuel wagering on simulcast past events and live
3636 horse and greyhound races.
3737 Section 3. (a) The council shall adopt rules specifying

6767 Section 3. (a) The council shall adopt rules specifying
6868 the conditions under which the licensee, as part of its
6969 licensed activity, may cause simulcast programming of
7070 pari-mutuel events, including both past events and live horse
7171 racing and greyhound racing, held at racetracks located
7272 outside the state to be transmitted for public viewing to the
7373 licensee and there made the subject of pari-mutuel wagering.
7474 (b) Subject to the exceptions as the council may
7575 approve by rule in order to satisfy applicable requirements of
7676 federal law, all pari-mutuel wagering with respect to racing
7777 events that are the subject of simulcast programming shall be
7878 subject to the rules of the council governing pari-mutuel
7979 wagering.
8080 (c) The council shall be entitled to no revenues from
8181 the simulcast programming of racing events other than the
8282 following:
8383 (1) The commission horse wagering fee due with respect
8484 to that part of the horse racing handle wagered in simulcast
8585 horse racing events by bettors placing bets at the facility in
8686 the jurisdiction of the council.
8787 (2) The commission greyhound wagering fee due with
8888 respect to that part of the greyhound wagering handle wagered
8989 on simulcast greyhound racing events by bettors placing bets
9090 at the facility in the jurisdiction of the council.
9191 (d)(1) If permitted by federal law and made possible by
9292 contractual arrangements with the operator of the racetrack
9393 that originates the simulcast programming, the licensee may
9494 conduct pari-mutuel wagering on past events and live horse
9595 racing or greyhound racing events simulcast to the facility in

125125 racing or greyhound racing events simulcast to the facility in
126126 the municipal jurisdiction of the council from locations
127127 outside the state.
128128 (2) When conducting pari-mutuel wagering under
129129 subdivision (1), the pari-mutuel pools for the wagering may be
130130 limited to bets made by bettors placing bets at the facility
131131 located in the jurisdiction of the council or, alternatively,
132132 the pari-mutuel pools may include bets made by bettors placing
133133 bets at the facility that conducts the simulcast event, as
134134 well as bets made by bettors placing bets at one or more
135135 locations outside the state; provided that to the extent
136136 bettors placing bets at the facility located in the
137137 jurisdiction of the council participate in the pari-mutuel
138138 pools, the total amount wagered by the bettors shall be
139139 administered in accordance with the rules of the council.
140140 Section 4. Nothing contained in this act shall be
141141 construed to authorize or make lawful "off-track betting" or
142142 wagering or gambling of any kind at any location in the state
143143 other than at the facility licensed by the council. All laws
144144 of the state, whether local or general, and all ordinances of
145145 any political subdivision thereof, that prohibit, restrict, or
146146 regulate wagering or gambling of any kind outside the
147147 jurisdiction of the council shall not be affected by this act,
148148 and shall remain in full force and effect.
149149 Section 5. This act shall become effective on the first
150150 day of the third month following its passage and approval by
151151 the Governor, or its otherwise becoming law.
