1616 This bill makes appropriations for the support,

2727 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2828 Section 1. There is hereby appropriated for the support
2929 of public education in Alabama for the fiscal year ending
3030 September 30, 2025, for debt service, and for capital outlay
3131 to be paid out of funds specified in subsection (a) of Section
3232 2 of this act and the amounts specified in subsections (a),
3333 (b), (c), (d), and (e) of Section 3 of this act. For the
3434 purpose specified in subsection (b) of Section 2 of this act,
3535 amounts are shown by programmatic area and the total for all

6868 Education Trust Fund and "Federal and Local Funds" shall mean

7272 Section 2. (a) The appropriations provided for in this
7373 act shall be paid from funds in the State Treasury to the
7474 credit of the Education Trust Fund, Alabama Peace Officers'
7575 Standards and Training Fund, Impaired Drivers Trust Fund,
7676 Driver Education and Training Fund, Special Education
7777 Catastrophic Fund, Public School Fund and other listed funds
7878 and are hereby made for the support of public education in
7979 Alabama for the fiscal year ending September 30, 2025, and the
8080 appropriations herein made shall be subject to the provisions,
8181 terms, conditions and limitations of the Budget and Financial
8282 Control Act (Code of Alabama 1975, Sections 41-4-80 et seq.),
8383 the provisions of the Budget Management Act of 1976 (Code of
8484 Alabama 1975, Sections 41-19-1 et seq.), and shall be in the
8585 amounts hereinafter specified.

369369 Of this appropriation, $2,400,000 shall be expended for the Teacher Registered Apprenticeship
370370 Pilot Program. Pilot program funds shall be allocated to local education agencies based on
371371 contracts established with the Alabama Office of Apprenticeship for each apprentice and shall
372372 be used for the reimburesment of wages, the costs of related technical instruction for
373373 registered apprentices, and the costs of stipends for journeyworker teachers supervising
374374 registered apprentices. The maximum allowable reimbursement to a local agency will be $60,000
375375 per apprentice. The Secretary of the Department of Commerce shall report semi-annually to the
376376 Chairs of the Senate Committee on Finance and Taxation-Education, the House Ways and
377377 Means-Education Committee and the Legislative Fiscal Officer any funds allocated for the
378378 Teacher Registered Apprenticeship Pilot Program.

430430 The funds appropriated for Workforce Development are to be expended for those costs
431431 incurred by the State in honoring commitments to pay workforce development costs,
432432 including services and other assistance and expenses of recruitment and training of
433433 a company's workforce, that are undertaken to induce companies to locate and expand
434434 their operations in Alabama (described hereinafter as a "Project") and to develop
435435 and implement training, placement and recruitment programs that will improve
436436 development and expand the State's workforce. Such costs include, but are not
437437 limited to: (i) AIDT operating costs directly related to a Project; (ii) wages and
438438 benefits for trainers engaged by AIDT for the purpose of a Project; (iii) costs
439439 which the State has agreed to pay under the terms of a Project Agreement with a
440440 company that are necessary and reasonable charges incurred by the company or its
441441 affiliates for personnel providing training to the company's employees, whether
442442 those trainers are employees of the company or its vendors or suppliers, including
443443 wages, benefits and travel (domestic and, when necessary, international); (iv) any
444444 necessary materials, equipment, manuals, or other relevant training materials; (v)
445445 the costs incurred for purchasing or repairing or replacing training tools and
446446 equipment; (vi) costs incurred for the purchase or construction and maintenance of
447447 training facilities; (vii) travel expenses for prospective and current employees and
448448 trainees, including travel, food, lodging, relocation, and other costs necessary and
449449 reasonable to enable the company to secure a qualified workforce; and (viii) outside
450450 training fees. The above funds appropriated for Workforce Development shall be
451451 expended primarily for the training of Alabama residents. It is further the intent
452452 that contracts with vendors to provide workforce training shall be inclusive and
453453 reflect the racial and gender diversity of the State. The Secretary of the
454454 Department of Commerce shall report semi-annually to the Chairs of the Senate
455455 Committee on Finance and Taxation-Education, the House Ways and Means-Education
456456 Committee, the Finanace Director, and the Legislative Fiscal Officer any funds
457457 allocated for workforce training. Such report shall include a summary of the persons
458458 trained and the vendors providing the training. The report shall contain information
459459 including the residence, race and gender of the persons trained and of the principal
460460 or majority owner of the firm or business contracted with to provide the training

768768 certifications and post-secondary degrees, to aid in scholarships, support

17981798 instruction that leads to student development and academic growth. The State
17991799 Superintendent shall establish an approval system, including, but not limited to a
18001800 menu of micro credentials, that relates directly to any valid teaching certificate
18011801 holders’ responsibilities as an educator. The State Board of Education may adopt
18021802 rules, as necessary, for initial or recertification criteria. The State
18031803 Superintendent shall provide a status report on the approval system status and
18041804 budgetary needs to the Chairs of the House Ways and Means-Education and Senate
18051805 Finance and Taxation-Education Committees on a semi-annual basis.
18061806 Notwithstanding Section 16-13-231.1(d), Code of Alabama 1975, there shall not be an
18071807 appropriation for the 1% over the total cost of instructional salaries for the
18081808 Foundation Program as calculated by the State Minimum Salary Schedule for the fiscal
18091809 year beginning October 1, 2024. For "Fringe Benefits" the rate per day for two
18101810 personal days and five sick days (for units earned in the Foundation Program) shall
18111811 be $120. The Teachers' Retirement System employer rate shall be 13.57% of salaries
18121812 for Tier I members and 12.60% of salaries for Tier II members. The Public Education
18131813 Employees' Health Insurance Program (PEEHIP) rate shall be $800 per month for each
18141814 full-time employee. As funds are appropriated, the appropriation herein shall

18171817 For "Classroom Instructional Support," the uniform amounts used in determining the
18181818 Foundation Program allowance for classroom instructional support shall be: (1)
18191819 textbooks or digital resources at $100.00 per pupil in average daily membership
18201820 during the first 20 scholastic days after Labor Day of the preceding school year;
18211821 (2) classroom materials and supplies at $1,000.00 per unit earned in the Foundation

23132313 education and peers working to support and identify at-risk students. Additionally, the program
23142314 may focus to increase school safety through early identification of at-risk students,
23152315 minimizing disciplinary infractions including school suspensions and expulsions. The program
23162316 may provide grade level prevention curriculum for all students and, in that case, the
23172317 curriculum must be updated annually to remain current and relevant to current trends that youth
23182318 face in their lives. Any applicable prevention curriculum must be comprehensive and satisfy the
23192319 following state mandates: Erin's Law, Jamari Terrell Williams Student Bullying Prevention Act,
23202320 Jason Flatt Act, and Drugs and Alcohol. In addition, any program related to mental health
23212321 should be flexible enough to focus on the greatest mental health needs for each individual
23222322 school. For accountability purposes, reporting data must include the number of students engaged

53385338 Local Education Agencies to use federal stimulus funds
53395339 provided by the Congress of the United States through the
53405340 Elementary and Secondary School Emergency Relief Fund for
53415341 one-time, non-recurring allowable expenses to address the
53425342 coronavirus pandemic in Alabama public schools. The
53435343 Superintendent shall periodically report to the Finance
53445344 Director, Chairs of the Senate Finance and Taxation-Education
53455345 Committee, the House Ways and Means-Education Committee, and
53465346 the Legislative Fiscal Officer, regarding the planned and
53475347 actual expenditures of these funds by the Local Education
53485348 Agencies.
53495349 (c) The Local Education Agencies shall expend no less than
53505350 $100,000,000 of all federal stimulus funds provided by the
53515351 Congress of the United States to address the coronavirus
53525352 pandemic in Alabama public schools to implement the safely
53535353 opening schools program, to include, but not limited to:
53545354 screening, testing, isolation, and quarantine of students and
53555355 school personnel with symptoms, in order to protect students,
53565356 teachers, and support personnel for schools to return to
53575357 full-time in-person education. Local school boards shall have

54145414 the transfer of funds to the State Personnel Department in the

54515451 Section 8. All encumbered balances of a previous

55625562 At-Risk Students shall be defined as students who have not met
55635563 proficiency standards for state accountability assessments and
55645564 one or more of the following apply: the student attends a
55655565 Title I school; qualifies for free or reduced lunch; qualifies
55665566 for special education or Tier III intervention; or is an
55675567 English language learner. In the awarding of grants,
55685568 preference will be given to undertakings that will directly
55695569 impact student achievement and improve performance on state
55705570 assessments to include remediation for students, after-school
55715571 and tutorial programs, career/technical programs, character
55725572 education, enrichment activities, programs that enhance
55735573 reading and mathematics abilities in students, activities that

55815581 (b) In an effort to provide the best and most efficient
55825582 implementation for intervention and innovation in schools,
55835583 administration of the grant awards shall be assigned to the
55845584 Alabama State Department of Education's Division of
55855585 Administrative and Financial Support with evaluative input
55865586 from other Alabama State Department of Education advisory
55875587 personnel, including the State Superintendent of Education, as
55885588 appropriate. The grant application process must require

56185618 districts to submit plans to the Alabama State Department of
56195619 Education detailing their intended use of the grant funds with
56205620 regard to student proficiency and growth. Grants may be
56215621 awarded any time after July 1st so schools can prepare for the
56225622 new school year. Notwithstanding the foregoing, the Alabama
56235623 State Department of Education's Division of Administrative and
56245624 Financial Support shall make every reasonable effort to notify
56255625 grant recipients of awards by August 1, 2024. No funding will
56265626 be available until October 1, 2024. Grantees will have no
56275627 guarantee of funding until October 1, 2024.
56285628 (c) Upon the awarding of any grant funds, the Alabama State
56295629 Department of Education must submit a report to the Chairs of
56305630 the House Ways and Means-Education Committee, the Senate
56315631 Committee on Finance and Taxation-Education, the Finance
56325632 Director, and the Legislative Fiscal Officer that shall
56335633 indicate the grant-recipient districts and each district’s
56345634 plan for those funds. Those districts shall submit follow-up
56355635 reports indicating the results of those plans from the
56365636 previous school year by July 31, 2025.
56375637 Section 15. (a) All nongovernmental entities,
56385638 identified by the Legislative Services Agency, which are
56395639 allocated funds in Section 3 of this act shall file a report
56405640 with the Chairs of the House Ways and Means-Education
56415641 Committee, the Senate Committee on Finance and
56425642 Taxation-Education, Finance Director, and the Legislative
56435643 Fiscal Officer prior to the start of the 2025 Regular Session,
56445644 regarding the proposed expenditures and usage of the funds
56455645 appropriated in the fiscal year ending September 30, 2025. The

56755675 Legislative Services Agency shall provide notice to the
56765676 identified nongovernmental entities within 60 days following
56775677 enactment of this act regarding the reporting requirements and
56785678 the methodology to submit reports and format to be used, which
56795679 may include an online platform.
56805680 (b) In the event an entity was appropriated funds from the
56815681 Education Trust Fund in the fiscal year ending September 30,
56825682 2024, the entity shall also include in its report a detailed
56835683 breakdown of the expenditure and use of those funds, including
56845684 an inventory of the services delivered and number of clients
56855685 served, pursuant to guidelines established by the Legislative
56865686 Services Agency.
56875687 Section 16. The State Superintendent of Education
56885688 shall notify each local superintendent and finance officer of
56895689 each local education agency by email regarding the
56905690 availability and application process, including any required
56915691 forms, for any available grant opportunities during FY 2025.
56925692 The State Superintendent shall notify all members of the local
56935693 legislative delegation five days prior to the announcement of
56945694 any grant made to any entity located in the legislative
56955695 jurisdiction. The five days prior notice requirement shall be
56965696 waived in the event of a declared emergency. The Governor
56975697 shall encourage the Department to disburse the funds provided
56985698 herein on a nondiscriminatory basis.
56995699 Section 17. Each college or university receiving
57005700 appropriations from the Education Trust Fund in Section 3C
57015701 shall not use any appropriations to reduce or eliminate

57305730 shall not use any appropriations to reduce or eliminate
57315731 tuition rates for high school students enrolled in dual
57325732 enrollment or early college programs with the college or
57335733 university unless specifically appropriated for that purpose.
57345734 Section 18. If any section, paragraph, sentence,
57355735 clause, provision, or portion of this act or all or any
57365736 portion of the appropriations herein made is held
57375737 unconstitutional or invalid, it shall not affect any other
57385738 section, paragraph, sentence, clause, provision, or portion of
57395739 this act or any other appropriation or appropriations or
57405740 portion thereof hereby made not in and of itself
57415741 unconstitutional or invalid.
57425742 Section 19. All laws or parts of laws, general,
57435743 special, private, or local in conflict with or inconsistent
57445744 with the provisions of this act are hereby expressly repealed.
57455745 Section 20. This act shall become effective on October
57465746 1, 2024.
