15+SYNOPSIS:
16+Under existing law, the Board of Trustees of the
17+Department of Archives and History is composed of two
18+members from each congressional district and two
19+at-large members.
20+This bill would revise the composition of the
21+board to the Governor and eight at-large members
22+appointed by the Governor, Lieutenant Governor, Speaker
23+of the House of Representatives, and Speaker Pro
24+Tempore of the Senate.
25+Under existing law, vacancies on the board are
26+filled by the board.
27+This bill would authorize the respective
28+appointing authorities to fill vacancies on the board.
29+This bill would also make nonsubstantive,
30+technical revisions to update the existing code
31+language to current style.

1835 Relating to the Department of Archives and History; to
1936 amend Sections 41-6-3 and 41-6-4, Code of Alabama 1975; to
20-further provide for the composition of the Board of Trustees
21-of the Department of Archives and History; to further provide
22-for the filling of vacancies on the board; and to make
23-nonsubstantive, technical revisions to update the existing
24-code language to current style.
25-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
26-Section 1. Sections 41-6-3 and 41-6-4, Code of Alabama
27-1975, are amended to read as follows:
28-"§41-6-3
29-(a) The department shall be under the control of the
30-Board of Trustees of the Department of Archives and History,
31-which shall consist of one member from each congressional
32-district and the additional members selected pursuant to
33-subsection (b)18 at-large members and the Governor or his or
34-her designee.
35-(b) Two additional at-large members shall be selected
36-and an additional member shall be selected from each U.S.
37-Congressional District. The additional members shall be

72+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
73+Section 1. Sections 41-6-3 and 41-6-4, Code of Alabama
74+1975, are amended to read as follows:
75+"§41-6-3
76+(a) The department shall be under the control of the
77+Board of Trustees of the Department of Archives and History,

6885 selected by the board of trustees and their names shall be
6986 communicated to the Senate not later than the fifth
7087 legislative day of the 2004 Regular Session of the
71-Legislature. Newly selected members shall be confirmed by the
72-Senate in the same manner as vacancies filled pursuant to
73-Section 41-6-4. The board of trustees shall select three of
74-the new members to serve initial terms of two years, three of
75-the new members to serve initial terms of four years, and
76-three of the new members to serve initial terms of six years.
77-All successor members shall serve terms of six years and shall
78-be selected as provided in Section 41-6-4.
79-(c) The membership of the board of trustees appointing
80-authorities shall becoordinate their appointments to assure
81-the board of trustees is inclusive and shall reflect reflects
82-the racial and, gender, geographic, urban, rural, and economic
83-diversity of the state.
84-(d) On August 1, 2024, the Speaker of the House of
85-Representatives and the President Pro Tempore of the Senate
86-shall each select one additional new at-large member to serve
87-a term of six years.
88-(e) Beginning January 1, 2024, each board vacancy, as
89-it arises, shall be filled by an at-large member serving a
90-term of six years appointed by he following appointing
91-authorities in the following order:
92-(1) The Lieutenant Governor.
93-(2) The Governor.
94-(3) The Minority Leader of the House of
95-Representatives.
88+Legislature. On June 1, 2024, all individuals then serving on
89+the board shall be removed and replaced with new members. The
90+Governor, Lieutenant Governor, Speaker of the House of
91+Representatives, and Speaker Pro Tempore of the Senate shall
92+each select one member to serve an initial term of two years
93+and one member to serve an additional term of four years.
94+Newly selected members shall be confirmed by the Senate in the

151147 (b) A trustee appointed to succeed a member whose term
152148 has expired shall serve for a term of six years. A person An

183-individual appointed to fill a vacancy occurring by death or
184-resignation shall only serve out the unexpired term of his or
185-her predecessor. A person An individual whose appointment to
186182 the board has been confirmed by the Senate shall serve beyond
187183 his or her expired term until a successor has been confirmed
188184 by the Senate.
189185 (c) The board shall hold at the State Capital at least
190186 one regular meeting during every year and as many special
191187 meetings as may be necessary, and at any meeting a majority of
192188 the trustees shall constitute a quorum. The Governor of the
193189 state shall be a voting member of the board as authorized by
194190 Section 41-6-3, and he or she shall, as far as possible, shall
195191 lend every encouragement to the success and upbuilding
196192 development of the department. The director shall be the
197193 secretary of the board. The trustees shall receive no
198194 compensation for their services. Each member of the board of
199195 trustees shall be reimbursed at the same per diem and travel
200196 allowance amounts paid by law to state employees for each day
201197 of attendance of the business of the board.
202198 (d) The board may do all of the following :
203199 (1) Adopt rules for its own government and also for the
204200 government of the department.
205201 (2) Elect a director and provide for the selection or
206202 appointment of other officials or employees as may be
207203 authorized.
208204 (3) Provide for the publication of historical material
209205 pertaining to the state under the supervision of the director.
210206 (4) Control and expend such appropriations as may be
211207 made for the maintenance of the department.
208+(5) Perform such other acts as may be necessary to
209+carry out the intent and purposes of this article."
210+Section 2. This act shall become effective on June 1,
