1515 SYNOPSIS:
1616 This bill would prohibit public K-12 schools
1717 from being members of certain athletic associations.
1818 This bill would also prohibit public K-12
1919 schools from competing in athletic events against
2020 certain other schools.

2323 AN ACT
2424 Relating to public K-12 schools; to prohibit membership
2525 in certain athletic associations; and to prohibit athletic
2626 competition against certain schools.
2727 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2828 Section 1. (a) For the purposes of this section, the
2929 term "athletic association" means any association of public or
3030 nonpublic K-12 schools that acts as an organizing,
3131 sanctioning, scheduling, or rulemaking body for
3232 interscholastic athletic events in which students in this
3333 state participate.
3434 (b) No public K-12 school that benefits from state
3535 funding may be a member of an athletic association that
3636 prohibits, or discourages through the use of a communication,

6666 prohibits, or discourages through the use of a communication,
6767 policy, procedure, ranking, or other instrument designed to
6868 discourage, its member schools from competing or participating
6969 in a contest against or otherwise engaging in an athletic
7070 event with a non-member school, including, but not limited to,
7171 a scrimmage game, jamboree, or match.
7272 (c) No public K-12 school may be a member of an
7373 athletic association that unreasonably withholds its approval
7474 or support of another athletic association's application to
7575 become an affiliate member of the National Federation of State
7676 High School Associations within this state.
7777 (d) No public K-12 school that benefits from state
7878 funding may compete or participate in a contest against or
7979 otherwise engage in an athletic event with a school that is
8080 not a member of the athletic association in which the public
8181 K-12 school is a member if the non-member school is a member
8282 of an athletic association that does not do all of the
8383 following:
8484 (1) Mandate a preparticipation physical examination for
8585 all students before they may participate in tryouts,
8686 practices, or interscholastic athletic events.
8787 (2) Implement a comprehensive concussion management and
8888 return-to-play protocol that includes all of the following:
8989 a. The dissemination of an informational sheet on the
9090 risks of concussions to a parent or legal guardian of a
9191 student participating in an athletic event before the program
9292 starts.
9393 b. The immediate removal and evaluation of a student
9494 who shows symptoms of a concussion during an athletic event by

124124 who shows symptoms of a concussion during an athletic event by
125125 a qualified health care provider.
126126 c. A prohibition against a student participating in an
127127 athletic event after being diagnosed with a concussion until a
128128 qualified health care provider medically clears the student to
129129 return to participation.
130130 (3) Comply with rules established by the National
131131 Federation of State High School Associations.
132132 (4) Comply with the competition rules set by the
133133 athletic association that governs the public K-12 school.
134134 (5) Restrict participation in competition to
135135 high-school athletes who are under 19 years of age on August 1
136136 of that school year.
137137 (6) Use only game officials who are certified through
138138 assessments conducted in accordance with the National
139139 Federation of State High School Associations' rules and
140140 procedures.
141141 (7) Comply with all other requirements under state
142142 laws, including, but not limited to, Chapter 30D of Title 16,
143143 Code of Alabama 1975.
144144 (e) Nothing in this section shall be construed to do
145145 either of the following:
146146 (1) Influence the membership status or governance of
147147 nonpublic schools that are members of an athletic association
148148 that is primarily composed of public K-12 schools.
149149 (2) Affect the autonomy granted to nonpublic K-12
150150 schools under the laws of this state.
151151 Section 2. This act shall become effective on July 1,
152152 2024.
