16	16	This bill would prohibit public K-12 schools
17	17	from being members of certain athletic associations.
18	18	This bill would also prohibit public K-12
19	19	schools from competing in athletic events against
20	20	certain other schools.
21	21	A BILL
22	22	TO BE ENTITLED
23	23	AN ACT
24	24	Relating to public K-12 schools; to prohibit membership
25	25	in certain athletic associations; and to prohibit athletic
26	26	competition against certain schools.
27	27	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
28	28	Section 1. (a) For the purposes of this section, the
29	29	term "athletic association" means any association of public or
30	30	nonpublic K-12 schools that acts as an organizing,
31	31	sanctioning, scheduling, or rulemaking body for
32	32	interscholastic athletic events in which students in this
33	33	state participate.
34	34	(b) No public K-12 school that benefits from state
35	35	funding may be a member of an athletic association that
36	36	prohibits, or discourages through the use of a communication,

66	66	prohibits, or discourages through the use of a communication,
67	67	policy, procedure, ranking, or other instrument designed to
68	68	discourage, its member schools from competing or participating
69	69	in a contest against or otherwise engaging in an athletic
70	70	event with a non-member school, including, but not limited to,
71	71	a scrimmage game, jamboree, or match.
72	72	(c) No public K-12 school may be a member of an
73	73	athletic association that unreasonably withholds its approval
74	74	or support of another athletic association's application to
75	75	become an affiliate member of the National Federation of State
76	76	High School Associations within this state.
77	77	(d) No public K-12 school that benefits from state
78	78	funding may compete or participate in a contest against or
79	79	otherwise engage in an athletic event with a school that is
80	80	not a member of the athletic association in which the public
81	81	K-12 school is a member if the non-member school is a member
82	82	of an athletic association that does not do all of the
83	83	following:
84	84	(1) Mandate a preparticipation physical examination for
85	85	all students before they may participate in tryouts,
86	86	practices, or interscholastic athletic events.
87	87	(2) Implement a comprehensive concussion management and
88	88	return-to-play protocol that includes all of the following:
89	89	a. The dissemination of an informational sheet on the
90	90	risks of concussions to a parent or legal guardian of a
91	91	student participating in an athletic event before the program
92	92	starts.
93	93	b. The immediate removal and evaluation of a student
94	94	who shows symptoms of a concussion during an athletic event by

124	124	who shows symptoms of a concussion during an athletic event by
125	125	a qualified health care provider.
126	126	c. A prohibition against a student participating in an
127	127	athletic event after being diagnosed with a concussion until a
128	128	qualified health care provider medically clears the student to
129	129	return to participation.
130	130	(3) Comply with rules established by the National
131	131	Federation of State High School Associations.
132	132	(4) Comply with the competition rules set by the
133	133	athletic association that governs the public K-12 school.
134	134	(5) Restrict participation in competition to
135	135	high-school athletes who are under 19 years of age on August 1
136	136	of that school year.
137	137	(6) Use only game officials who are certified through
138	138	assessments conducted in accordance with the National
139	139	Federation of State High School Associations' rules and
140	140	procedures.
141	141	(7) Comply with all other requirements under state
142	142	laws, including, but not limited to, Chapter 30D of Title 16,
143	143	Code of Alabama 1975.
144	144	(e) Nothing in this section shall be construed to do
145	145	either of the following:
146	146	(1) Influence the membership status or governance of
147	147	nonpublic schools that are members of an athletic association
148	148	that is primarily composed of public K-12 schools.
149	149	(2) Affect the autonomy granted to nonpublic K-12
150	150	schools under the laws of this state.
151	151	Section 2. This act shall become effective on July 1,
152	152	2024.
