1515 SYNOPSIS:
1616 This bill would propose an amendment to the
1717 Constitution of Alabama of 2022, relating to public
1818 K-12 schools, to require local boards of education to
1919 adopt policies requiring each K-12 public school to
2020 broadcast or sanction the performance of the first
2121 stanza of The Star-Spangled Banner at least once per
2222 week during school hours.

2626 Proposing an amendment to the Constitution of Alabama
2727 of 2022, to require local boards of education to adopt
2828 policies requiring each K-12 public school to broadcast or
2929 sanction the performance of The Star-Spangled Banner at least
3030 once per week during school hours.
3131 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3232 Section 1. The Legislature finds and declares the
3333 following:
3434 (1) During the Battle of Baltimore of the War of 1812,
3535 Francis Scott Key visited the British fleet in the Chesapeake
3636 Bay on September 7, 1814, to secure the release of Dr. William

6666 Bay on September 7, 1814, to secure the release of Dr. William
6767 Beanes, who had been captured after the British burned
6868 Washington, D.C.
6969 (2) The release of Dr. Beanes was secured, but Key and
7070 Beanes were held by the British during the shelling of Fort
7171 McHenry, one of the forts defending Baltimore.
7272 (3) On the morning of September 14, 1814, after the
7373 25-hour British bombardment of Fort McHenry, Key peered
7474 through the clearing smoke to see a 42-foot by 30-foot
7575 American flag flying proudly atop the Fort.
7676 (4) He was so inspired to see the enormous flag still
7777 flying over the Fort that he began penning a song, which he
7878 named The Defence of Fort McHenry, to commemorate the
7979 occasion, and he included a note that it should be sung to the
8080 tune of the popular British melody To Anacreon in Heaven.
8181 (5) In 1916, President Woodrow Wilson ordered that the
8282 anthem, which had been popularly renamed The Star-Spangled
8383 Banner, be played at military and naval occasions.
8484 (6) On March 3, 1931, President Herbert Hoover signed a
8585 resolution of Congress that officially designated The
8686 Star-Spangled Banner as the National Anthem of the United
8787 States.
8888 (7) For over 100 years, The Star-Spangled Banner has
8989 served to inspire generations of patriotic Americans, and it
9090 is imperative that students have exposure to this history and
9191 inspiration.
9292 Section 2. The following amendment to the Constitution
9393 of Alabama of 2022, is proposed and shall become valid as a
9494 part of the Constitution when approved by a majority of the

124124 part of the Constitution when approved by a majority of the
125125 qualified electors voting thereon and in accordance with
126126 Sections 284, 285, and 287 of the Constitution of Alabama of
127127 2022:
128128 PROPOSED AMENDMENT
129129 (a) Each local board of education shall adopt a policy
130130 requiring each public K-12 school under its jurisdiction to
131131 broadcast The Star-Spangled Banner during school hours, at
132132 least once per week. If not played or broadcast in a given
133133 week from Monday through Thursday, the Star-Spangled Banner
134134 shall be played or broadcast on Friday morning.
135135 (b)(1) A local board of education shall select for
136136 broadcast, pursuant to subsection (a), any recording of the
137137 first stanza of The Star-Spangled Banner that is archived
138138 within the Library of Congress and available on the Library of
139139 Congress website.
140140 (2) A local board of education, alternatively, may
141141 adopt a policy allowing, during school hours, for the
142142 performance of the first stanza of The Star-Spangled Banner
143143 from original sheet music, archived within the Library of
144144 Congress and available on its website, by a school-sanctioned
145145 band program, choral program, vocal group, or vocalist.
146146 Upon ratification of this constitutional amendment, the
147147 Code Commissioner shall number and place this amendment as
148148 appropriate in the constitution omitting this instructional
149149 paragraph and may make the following nonsubstantive revisions:
150150 change capitalization, spelling, and punctuation for purposes
151151 of style and uniformity; correct manifest grammatical,

181181 clerical, and typographical errors; and correct incorrect

183183 Section 3. An election upon the proposed amendment
184184 shall be held in accordance with Sections 284 and 285 of the
185185 Constitution of Alabama of 2022, and the election laws of this
186186 state.
187187 Section 4. The appropriate election official shall
188188 assign a ballot number for the proposed constitutional
189189 amendment on the election ballot and shall set forth the
190190 following description of the substance or subject matter of
191191 the proposed constitutional amendment:
192192 "Proposing an amendment to the Constitution of Alabama
193193 of 2022, to require local boards of education to adopt
194194 policies requiring each K-12 public school to broadcast or
195195 sanction the performance of the first stanza of The
196196 Star-Spangled Banner at least once per week during school
197197 hours.
