15	15	SYNOPSIS:
16	16	This bill would define man, woman, boy, girl,
17	17	father, mother, male, female, and sex for purposes of
18	18	state law.
19	19	This would provide policy on the differences
20	20	between sexes.
21	21	This bill would provide that state and local
22	22	public entities may establish separate single-sex
23	23	spaces or environments in certain circumstances.
24	24	This bill would also require the state or
25	25	political subdivisions that collect vital statistics
26	26	related to sex as male or female for certain purposes
27	27	to identify each individual as either male or female at
28	28	birth.

31	31	AN ACT
32	32	Relating to sex-based terminology; to amend Section
33	33	1-1-1, Code of Alabama 1975, to define certain sex-based
34	34	terms; to provide policy relating to sex; to allow public
35	35	entities to establish certain single sex spaces or
36	36	environments; and to require public entities that collect

67	67	vital statistics related to sex as male or female to identify
68	68	each individual as male or female as observed at birth.
69	69	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
70	70	Section 1. (a) The purpose of this act is to bring
71	71	clarity, certainty, and uniformity to the laws of Alabama
72	72	regarding sex discrimination, equality of the sexes, and
73	73	benefits or services specifically provided to males and men
74	74	and to females and women.
75	75	(b) This act applies wherever state law classifies
76	76	individuals on the basis of sex or otherwise mentions
77	77	individuals as being male or female, men or women, or boys or
78	78	girls.
79	79	Section 2. The Legislature finds and declares all of
80	80	the following:
81	81	(1) Men and women are legally equal but are not
82	82	physically the same.
83	83	(2) The State of Alabama has an important interest in
84	84	preventing unjust sex discrimination and in maintaining
85	85	safety, privacy, and fairness for both sexes.
86	86	(3) Inconsistencies in court rulings and policy
87	87	initiatives regarding sex discrimination and common sex-based
88	88	words have endangered women's rights and resources and have
89	89	put the existence of private, single-sex spaces in jeopardy.
90	90	(4) There are only two sexes, and every individual is
91	91	either male or female. The term "sex" is objective and fixed.
92	92	Individuals with differences in sex development, also known as
93	93	"DSDs" or "intersex conditions," are not a third sex.
94	94	Individuals with a congenital or medically verifiable DSD

125	125	diagnosis must be accommodated consistent with state and
126	126	federal law.
127	127	(5) With respect to equality of the sexes, the term
128	128	"equal" does not mean "same" or "identical."
129	129	Section 3. Section 1-1-1, Code of Alabama 1975, is
130	130	amended to read as follows:
131	131	"§1-1-1
132	132	The following words, whenever they appear in this Code,
133	133	shall have the signification attached to them in this
134	134	sectioncode, have the following meanings unless otherwise
135	135	apparent from the context or otherwise explicitly defined :
136	136	(1) BOY. A human male who has not yet reached
137	137	adulthood.
138	138	(2) FATHER. The male parent of a child or children.
139	139	(3) FEMALE. When used in reference to a natural person,
140	140	an individual who has, had, will have, or would have, but for
141	141	a developmental anomaly, genetic anomaly, or accident, the
142	142	reproductive system that at some point produces ova.
143	143	(4) GIRL. A human female who has not yet reached
144	144	adulthood.
145	145	(6) MALE. When used in reference to a natural person,
146	146	an individual who has, had, will have, or would have, but for
147	147	a developmental anomaly, genetic anomaly, or accident, the
148	148	reproductive system that at some point produces sperm.
149	149	(7) MAN. An adult human of the male sex.
150	150	(9) MOTHER. The female parent of a child or children.
151	151	(1)(10) PERSON. The word "person" includes a
152	152	corporation as well as a natural person Includes an individual,

184	184	(2) WRITING. The word "writing" includes typewriting
185	185	and printing on paper.
186	186	(3) OATH. The word "oath" includes affirmation.
187	187	(14) SEX. When the term is used to classify or describe
188	188	a natural person, the state of being male or female as
189	189	observed or clinically verified at birth.
190	190	(4)(15) SIGNATURE or SUBSCRIPTION . The words
191	191	"signature" or "subscription" include Includes a mark when the
192	192	person an individual cannot write, if his or her name is
193	193	written near the mark , and witnessed by a person an individual
194	194	who writes his or her own name as a witness , and include with
195	195	respect to corporate securities facsimile signature placed
196	196	upon any instrument or writing with intent to execute or
197	197	authenticate such instrument or writing .
198	198	(5) LUNATIC, INSANE or NON COMPOS MENTIS. The words
199	199	"lunatic" or "insane" or the term "non compos mentis" include
200	200	all persons of unsound mind.
201	201	(6)(12) PROPERTY. The word "property" includes Includes
202	202	both real and personal property.
203	203	(7)(13) REAL PROPERTY. The term "real property"
204	204	includes Includes lands, tenements , and hereditaments.
205	205	(8)(11) PERSONAL PROPERTY. The term "personal property"
206	206	includes Includes money, goods, chattels, things in action and
207	207	evidence of debt, deeds , and conveyances.
208	208	(9) CIRCUIT. The word "circuit" means judicial circuit.
209	209	(10) PRECEDING. The word "preceding" means next before.

257	257	reference to any appropriations for the payment of money out
258	258	of the treasury, it shall mean the term shall mean a fiscal

260	260	Section 4. (a) Any state law that prohibits
261	261	discrimination on the basis of sex thereby forbids unfair
262	262	treatment of females or males.
263	263	(b) Neither the state nor any political subdivision of
264	264	the state shall be prohibited from establishing separate
265	265	single-sex spaces or environments for males and females when
266	266	biology, privacy, safety, or fairness are implicated.
267	267	Section 5. (a) Any school district or public school,
268	268	and any state agency, department, bureau, or commission, or

298	298	and any state agency, department, bureau, or commission, or
299	299	political subdivision that collects vital statistics related
300	300	to sex as male or female for the purpose of complying with
301	301	anti-discrimination laws or for the purpose of gathering
302	302	accurate public health, crime, economic, or other data shall
303	303	identify each individual who is part of the collected data set
304	304	as either male or female.
305	305	(b) Compliance with subsection (a) shall not require
306	306	the collection of data regarding sex unless otherwise required
307	307	by law, and the requirements of subsection (a) shall not
308	308	prevent the collection of additional data points besides
309	309	biological sex.
310	310	Section 6. The provisions of this act are severable.
311	311	If any part of this act is declared invalid or
312	312	unconstitutional, that declaration shall not affect the part
313	313	which remains.
314	314	Section 7. This act shall become effective October 1,
315	315	2024.
