1515 SYNOPSIS:
1616 This bill would define man, woman, boy, girl,
1717 father, mother, male, female, and sex for purposes of
1818 state law.
1919 This would provide policy on the differences
2020 between sexes.
2121 This bill would provide that state and local
2222 public entities may establish separate single-sex
2323 spaces or environments in certain circumstances.
2424 This bill would also require the state or
2525 political subdivisions that collect vital statistics
2626 related to sex as male or female for certain purposes
2727 to identify each individual as either male or female at
2828 birth.

3232 Relating to sex-based terminology; to amend Section
3333 1-1-1, Code of Alabama 1975, to define certain sex-based
3434 terms; to provide policy relating to sex; to allow public
3535 entities to establish certain single sex spaces or
3636 environments; and to require public entities that collect

6868 each individual as male or female as observed at birth.
6969 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7070 Section 1. (a) The purpose of this act is to bring
7171 clarity, certainty, and uniformity to the laws of Alabama
7272 regarding sex discrimination, equality of the sexes, and
7373 benefits or services specifically provided to males and men
7474 and to females and women.
7575 (b) This act applies wherever state law classifies
7676 individuals on the basis of sex or otherwise mentions
7777 individuals as being male or female, men or women, or boys or
7878 girls.
7979 Section 2. The Legislature finds and declares all of
8080 the following:
8181 (1) Men and women are legally equal but are not
8282 physically the same.
8383 (2) The State of Alabama has an important interest in
8484 preventing unjust sex discrimination and in maintaining
8585 safety, privacy, and fairness for both sexes.
8686 (3) Inconsistencies in court rulings and policy
8787 initiatives regarding sex discrimination and common sex-based
8888 words have endangered women's rights and resources and have
8989 put the existence of private, single-sex spaces in jeopardy.
9090 (4) There are only two sexes, and every individual is
9191 either male or female. The term "sex" is objective and fixed.
9292 Individuals with differences in sex development, also known as
9393 "DSDs" or "intersex conditions," are not a third sex.
9494 Individuals with a congenital or medically verifiable DSD

127127 (5) With respect to equality of the sexes, the term
128128 "equal" does not mean "same" or "identical."
129129 Section 3. Section 1-1-1, Code of Alabama 1975, is
130130 amended to read as follows:

132132 The following words, whenever they appear in this Code,
133133 shall have the signification attached to them in this
134134 sectioncode, have the following meanings unless otherwise
135135 apparent from the context or otherwise explicitly defined :
136136 (1) BOY. A human male who has not yet reached
137137 adulthood.
138138 (2) FATHER. The male parent of a child or children.
139139 (3) FEMALE. When used in reference to a natural person,
140140 an individual who has, had, will have, or would have, but for
141141 a developmental anomaly, genetic anomaly, or accident, the
142142 reproductive system that at some point produces ova.
143143 (4) GIRL. A human female who has not yet reached
144144 adulthood.
145145 (6) MALE. When used in reference to a natural person,
146146 an individual who has, had, will have, or would have, but for
147147 a developmental anomaly, genetic anomaly, or accident, the
148148 reproductive system that at some point produces sperm.
149149 (7) MAN. An adult human of the male sex.
150150 (9) MOTHER. The female parent of a child or children.
151151 (1)(10) PERSON. The word "person" includes a
152152 corporation as well as a natural person Includes an individual,

184184 (2) WRITING. The word "writing" includes typewriting
185185 and printing on paper.
186186 (3) OATH. The word "oath" includes affirmation.
187187 (14) SEX. When the term is used to classify or describe
188188 a natural person, the state of being male or female as
189189 observed or clinically verified at birth.
190190 (4)(15) SIGNATURE or SUBSCRIPTION . The words
191191 "signature" or "subscription" include Includes a mark when the
192192 person an individual cannot write, if his or her name is
193193 written near the mark , and witnessed by a person an individual
194194 who writes his or her own name as a witness , and include with
195195 respect to corporate securities facsimile signature placed
196196 upon any instrument or writing with intent to execute or
197197 authenticate such instrument or writing .
198198 (5) LUNATIC, INSANE or NON COMPOS MENTIS. The words
199199 "lunatic" or "insane" or the term "non compos mentis" include
200200 all persons of unsound mind.
201201 (6)(12) PROPERTY. The word "property" includes Includes
202202 both real and personal property.
203203 (7)(13) REAL PROPERTY. The term "real property"
204204 includes Includes lands, tenements , and hereditaments.
205205 (8)(11) PERSONAL PROPERTY. The term "personal property"
206206 includes Includes money, goods, chattels, things in action and
207207 evidence of debt, deeds , and conveyances.
208208 (9) CIRCUIT. The word "circuit" means judicial circuit.
209209 (10) PRECEDING. The word "preceding" means next before.
210210 (11) FOLLOWING. The word "following" means next after.

240240 (11) FOLLOWING. The word "following" means next after.
241241 (12)(16) STATE. The word "state," when When applied to

254254 (18) WOMAN. An adult human of the female sex.
255255 (16)(19) YEAR. The word "year" means a A calendar
256256 year,; but, except whenever the word "year" is used in
257257 reference to any appropriations for the payment of money out
258258 of the treasury, it shall mean the term shall mean a fiscal
259259 year."
260260 Section 4. (a) Any state law that prohibits
261261 discrimination on the basis of sex thereby forbids unfair
262262 treatment of females or males.
263263 (b) Neither the state nor any political subdivision of
264264 the state shall be prohibited from establishing separate
265265 single-sex spaces or environments for males and females when
266266 biology, privacy, safety, or fairness are implicated.
267267 Section 5. (a) Any school district or public school,
268268 and any state agency, department, bureau, or commission, or

298298 and any state agency, department, bureau, or commission, or
299299 political subdivision that collects vital statistics related
300300 to sex as male or female for the purpose of complying with
301301 anti-discrimination laws or for the purpose of gathering
302302 accurate public health, crime, economic, or other data shall
303303 identify each individual who is part of the collected data set
304304 as either male or female.
305305 (b) Compliance with subsection (a) shall not require
306306 the collection of data regarding sex unless otherwise required
307307 by law, and the requirements of subsection (a) shall not
308308 prevent the collection of additional data points besides
309309 biological sex.
310310 Section 6. The provisions of this act are severable.
311311 If any part of this act is declared invalid or
312312 unconstitutional, that declaration shall not affect the part
313313 which remains.
314314 Section 7. This act shall become effective October 1,
315315 2024.
