69 | 69 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
70 | 70 | | Section 1. (a) The purpose of this act is to bring |
---|
71 | 71 | | clarity, certainty, and uniformity to the laws of Alabama |
---|
72 | 72 | | regarding sex discrimination, equality of the sexes, and |
---|
73 | 73 | | benefits or services specifically provided to males and men |
---|
74 | 74 | | and to females and women. |
---|
75 | 75 | | (b) This act applies wherever state law classifies |
---|
76 | 76 | | individuals on the basis of sex or otherwise mentions |
---|
77 | 77 | | individuals as being male or female, men or women, or boys or |
---|
78 | 78 | | girls. |
---|
79 | 79 | | Section 2. The Legislature finds and declares all of |
---|
80 | 80 | | the following: |
---|
81 | 81 | | (1) Men and women are legally equal but are not |
---|
82 | 82 | | physically the same. |
---|
83 | 83 | | (2) The State of Alabama has an important interest in |
---|
84 | 84 | | preventing unjust sex discrimination and in maintaining |
---|
85 | 85 | | safety, privacy, and fairness for both sexes. |
---|
86 | 86 | | (3) Inconsistencies in court rulings and policy |
---|
87 | 87 | | initiatives regarding sex discrimination and common sex-based |
---|
88 | 88 | | words have endangered women's rights and resources and have |
---|
89 | 89 | | put the existence of private, single-sex spaces in jeopardy. |
---|
90 | 90 | | (4) There are only two sexes, and every individual is |
---|
91 | 91 | | either male or female. The term "sex" is objective and fixed. |
---|
92 | 92 | | Individuals with differences in sex development, also known as |
---|
93 | 93 | | "DSDs" or "intersex conditions," are not a third sex. |
---|
94 | 94 | | Individuals with a congenital or medically verifiable DSD |
---|
