15	15	SR____ ESTABLISHING A LEGISLATIVE STUDY COMMISSION TO STUDY
16	16	K-12 SCHOOL EDUCATION FUNDING.
17	17	WHEREAS, On April 30, 2024, the Governor signed
18	18	SJR61, enacted as Act 2024-128, requiring the Legislature of
19	19	Alabama to conduct a study on modernizing K-12 education
20	20	funding; and
21	21	WHEREAS, Act 2024-128 provides compelling reasons
22	22	that justify the need for a legislative study on modernizing
23	23	K-12 education funding, including a need for greater
24	24	flexibility in the coordination of state education funding
25	25	priorities with the local needs of students, teachers, and
26	26	administrators, and whether this need could be better served
27	27	by transitioning from a resource-based funding model to one
28	28	that is student-based and provides greater flexibility; and
29	29	WHEREAS, this body finds that the members of the
30	30	Finance and Taxation Education Standing Committee of the
31	31	Senate, along with members of the Ways and Means Education
32	32	Standing Committee of the House of Representatives, are in
33	33	the best position to undertake this study; now therefore,
34	34	BE IT RESOLVED BY THE SENATE OF THE LEGISLATURE OF
35	35	ALABAMA, That the Legislative Study Commission on
36	36	Modernizing K-12 School Education Funding is created to
37	37	study modernizing the current K-12 school funding model.

67	67	(a) The Legislative Study Commission on Modernizing
68	68	K-12 School Education Funding shall be comprised of all
69	69	members of the Senate Finance and Taxation Education
70	70	Standing Committee, along with all members of the House of
71	71	Representatives Ways and Means Education Standing Committee.
72	72	(b) The legislative study commission shall focus on
73	73	the possibility of transitioning from a resource-based model
74	74	of education funding to a model that provides greater
75	75	flexibility and is based on the specific needs of students.
76	76	The work of the legislative study commission may include,
77	77	but not be limited to:
78	78	(1) Studying the projected costs and budget impact of
79	79	a transition.
80	80	(2) Studying the associated changes in the tax and
81	81	revenue framework that may be required to fund and maintain
82	82	a transition.
83	83	(3) Studying the changes in law required to adopt a
84	84	model of student-based education funding.
85	85	(4) If a specific pathway to modernize education
86	86	school funding is endorsed by the legislative study
87	87	commission, developing proposed legislation to effect the
88	88	transition.
89	89	(c) The chair of the Senate Finance and Taxation
90	90	Education Standing Committee shall serve as a cochair along
91	91	with the chair of the House of Representatives Ways and
92	92	Means Education Standing Committee. Meetings shall be held
93	93	at the call of either cochair as necessary to conduct
94	94	business.

125	125	(d) The Fiscal Division of the Legislative Services
126	126	Agency, the Clerk of the House of Representatives, and the
127	127	Secretary of the Senate shall provide administrative and
128	128	other assistance for the work of the legislative study
129	129	commission as necessary.
130	130	(e) Pursuant to Section 36-14-17.1, Code of Alabama
131	131	1975, the Legislative Study Commission on Modernizing K-12
132	132	School Education Funding shall provide to the Secretary of
133	133	State a notice of all meetings, the name of each member
134	134	serving on the legislative study commission, and a copy of
135	135	all reports and written recommendations produced throughout
136	136	the duration of the legislative study commission.
137	137	(f) Members of the legislative study commission shall
138	138	be entitled to their legislative compensation, per diem, and
139	139	travel expenses for each day they attend a meeting of the
140	140	legislative study commission pursuant to Section 49 of the
141	141	Constitution of Alabama of 2022.
142	142	(g) The Legislative Study Commission on Modernizing
143	143	K-12 School Education Funding shall prepare a report of its
144	144	findings, conclusions, and recommendations for any proposed
145	145	legislation, as it deems appropriate, to the Legislature no
146	146	later than February 1, 2025, at which time the legislative
147	147	study commission shall stand dissolved and discharged of any
148	148	future duties.
