17+SYNOPSIS:
18+Under existing law, termination dates are
19+established for enumerated state agencies. The agencies
20+are periodically reviewed by the Alabama Sunset
21+Committee. After the review process is completed, the
22+committee prepares its recommendation for the agencies
23+to the Legislature in the form of sunset bills which
24+either continue, terminate, or continue with
25+modification each agency reviewed.
26+This bill would provide for the continuance of
27+the Home Builders Licensure Board until October 1,
28+2029.

1931 AN ACT
2032 Relating to the Alabama Sunset Law; to continue the
2133 existence and functioning of the Home Builders Licensure Board
22-until October 1, 2029, with certain modifications; to amend
23-Section 34-14A-3, Code of Alabama 1975, to require that a
24-board member resides in and be appointed from each
25-congressional district in this state and that any remaining
26-members be appointed from the state at-large.

2735 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2836 Section 1. Pursuant to the Alabama Sunset Law, the
2937 Sunset Committee recommends the continuance of the Home
30-Builders Licensure Board until October 1, 2029, with
31-additional recommendation for statutory change as set out in
32-Section 3.
33-Section 2. The existence and functioning of the Home
34-Builders Licensure Board, created and functioning pursuant to
35-Sections 34-14A-1 to 34-14A-83, inclusive, Code of Alabama
36-1975, is continued until October 1, 2029, and those code
37-sections are expressly preserved.
38-Section 3. Section 34-14A-3, Code of Alabama 1975, is

68-Section 3. Section 34-14A-3, Code of Alabama 1975, is
69-amended to read as follows:
70-"ยง34-14A-3
71-(a) There is established the Home Builders Licensure
72-Board to regulate the residential home building and
73-residential construction industry and to promote and expend
74-funds for the education and support of associated construction
75-trades.
76-(b) The board shall have nine members who shall be
77-appointed as follows: Three by the Governor, three by the
78-Lieutenant Governor, and three by the Speaker of the House of
79-Representatives, from a list of three qualified individuals
80-for each position , provided by the governing body of the Home
81-Builders Association of Alabama.
82-(c) Seven of the members shall be residential home
83-builders, as defined in this chapter, with at least five
84-years' experience as a residential home builder, and each
85-shall be a bona fide resident of the State of Alabama. One
86-member shall be a building official or inspector currently
87-employed by a city, county, or state governmental entity and
88-actively engaged in inspecting or regulating residential
89-construction in this state. One shall be a consumer member of
90-the general public not employed by or affiliated with a
91-licensee hereunder, and who has no spouse or immediate family
92-member employed by or affiliated with a licensee hereunder.
93-(d) Each member of the board shall be a citizen
94-resident of this state, and the membership of the board shall
95-be inclusive and reflect the racial, gender, geographic,
96-urban/rural urban, rural, and economic diversity of the state.

70+Builders Licensure Board , created and functioning pursuant to
71+Sections 34-14A-1 to 34-14A-83, inclusive, Code of Alabama

74+Section 3. The Legislature concurs in the
75+recommendations of the Sunset Committee as provided in
76+Sections 1 and 2.
77+Section 4. This act shall become effective June 1,

127-Commencing on June 1, 2025, as the terms of the members
128-serving on the board expire, the membership of the board shall
129-be appointed so that one member resides in and is appointed
130-from each congressional district in this state with the
131-remaining members being appointed from the state at-large.
132-(e) Of the initial members of this board, the
133-appointing authorities shall designate that each appointee
134-shall serve for an initial term of one, two, or three years,
135-their terms of office expiring on December 31 of the years.
136-Subsequent terms shall be for a period of three years.
137-(f) This The respective appointing authority shall make
138-an appointment to fill a vacancy for the remainder of any
139-unexpired term from a list of three qualified persons
140-individuals supplied by the governing body of the Home
141-Builders Association of Alabama. Each board member shall hold
142-over after the expiration of his or her term until his or her
143-successor shall be duly appointed and qualified."
144-Section 4. The Legislature concurs in the
145-recommendation of the Sunset Committee as provided in Sections
146-1, 2, and 3.
147-Section 5. This act shall become effective on June 1,
