18	20		Relating to the Alabama Sunset Law; to continue the
19	21		existence and functioning of the State Board of Genetic
20	22		Counseling until October 1, 2027, with certain modifications;
21	23		to amend Section 34-13A-3, Code of Alabama 1975, to require
22	24		that a board member resides in and be appointed from each
23	25		congressional district in this state and that any remaining
24	26		members be appointed from the state at-large.
25	27		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
26	28		Section 1. Pursuant to the Alabama Sunset Law, the
27	29		Sunset Committee recommends the continuance of the State Board
28	30		of Genetic Counseling until October 1, 2027, with additional
29	31		recommendation for statutory change as set out in Section 3.
30	32		Section 2. The existence and functioning of the State
31	33		Board of Genetic Counseling, created and functioning pursuant
32	34		to Sections 34-13A-1 to 34-13A-11, inclusive, Code of Alabama
33	35		1975, is continued until October 1, 2027, and those code
34	36		sections are expressly preserved.
35	37		Section 3. Section 34-13A-3, Code of Alabama 1975, is
36	38		amended to read as follows:
37		-	"§34-13A-3
38		-	(a) The State Board of Genetic Counseling is created to
39		-	implement and administer this chapter.
40		-	(b) The membership of the board shall consist of all of
41		-	the following:
42		-	(1) One individual appointed by the Department of

	70	+	(a) The State Board of Genetic Counseling is created to
	71	+	implement and administer this chapter.
	72	+	(b) The membership of the board shall consist of all of
	73	+	the following:
72	74		(1) One individual appointed by the Department of
73	75		Genetics at the University of Alabama at Birmingham.
74	76		(2) Four individuals who practice genetic counseling in
75	77		Alabama and who hold a master's degree or doctoral degree in
76	78		genetic counseling from an ACGC or ABMGG accredited training
77	79		program, or an equivalent program approved by the ACGC or the
78	80		ABMGG, appointed by the Governor.
79	81		(3) One physician appointed by the Medical Association
80	82		of the State of Alabama.
81	83		(4) One physician appointed by the State Board of
82	84		Medical Examiners.
83	85		(5) One physician who specializes in pediatric genetics
84	86		appointed by the Lieutenant Governor.
85	87		(6) One physician appointed by the Speaker of the House
86	88		of Representatives.
87	89		(c) Board members appointed by the Governor shall serve
88	90		for terms of two years and, upon the expiration of a term, may
89	91		continue to serve until replaced or reappointed. All other
90	92		board members shall serve until they are replaced by their
91	93		respective appointing authority.
92	94		(d) The board shall annually elect from its membership
93	95		a chair, a vice chair, and a secretary.
94	96		(e) The appointing authorities shall coordinate their
95		-	appointments to assure the board membership is inclusive and
96		-	reflects the racial, gender, geographic, urban, rural, and
97		-	economic diversity of this the state. Commencing on June 1,
98		-	2025, as the terms of the members serving on the board expire,
99		-	the membership of the board shall be appointed so that one
100		-	member resides in and is appointed from each congressional

	126	+	(e) The appointing authorities shall coordinate their
	127	+	appointments to assure the board membership is inclusive and
	128	+	reflects the racial, gender, geographic, urban, rural, and
	129	+	economic diversity of this the state. Commencing on June 1,

133	135		(f) Unless acting unreasonably or in bad faith, no
134	136		member of the board shall be civilly liable for acting within
135	137		the scope of his or her duties as a board member.
136	138		(g) Members of the board shall serve without
137	139		compensation but, to the extent funds are available, may
138	140		receive the same per diem and travel allowance as state
139	141		employees.
140	142		(h)(1) Except as provided in subdivision (2), members
141	143		of the board may participate in a regular meeting of the board
142	144		by means of telephone conference, video conference, or similar
143	145		communications equipment pursuant to the Alabama Open Meetings
144	146		Act, Chapter 25A of Title 36.
145	147		(2) Members of the board may only participate in a
146	148		meeting of the board relating to a disciplinary action in
147	149		person."
148	150		Section 4. The Legislature concurs in the
149	151		recommendation of the Sunset Committee as provided in Sections
150	152		1, 2, and 3.
151	153		Section 5. This act shall become effective on June 1,
