19+AN ACT
1820 Relating to the Alabama Sunset Law; to continue the
1921 existence and functioning of the State Board of Genetic
2022 Counseling until October 1, 2027, with certain modifications;
2123 to amend Section 34-13A-3, Code of Alabama 1975, to require
2224 that a board member resides in and be appointed from each
2325 congressional district in this state and that any remaining
2426 members be appointed from the state at-large.
2527 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2628 Section 1. Pursuant to the Alabama Sunset Law, the
2729 Sunset Committee recommends the continuance of the State Board
2830 of Genetic Counseling until October 1, 2027, with additional
2931 recommendation for statutory change as set out in Section 3.
3032 Section 2. The existence and functioning of the State
3133 Board of Genetic Counseling, created and functioning pursuant
3234 to Sections 34-13A-1 to 34-13A-11, inclusive, Code of Alabama
3335 1975, is continued until October 1, 2027, and those code
3436 sections are expressly preserved.
3537 Section 3. Section 34-13A-3, Code of Alabama 1975, is
3638 amended to read as follows:
37-"§34-13A-3
38-(a) The State Board of Genetic Counseling is created to
39-implement and administer this chapter.
40-(b) The membership of the board shall consist of all of
41-the following:
42-(1) One individual appointed by the Department of

70+(a) The State Board of Genetic Counseling is created to
71+implement and administer this chapter.
72+(b) The membership of the board shall consist of all of
73+the following:
7274 (1) One individual appointed by the Department of
7375 Genetics at the University of Alabama at Birmingham.
7476 (2) Four individuals who practice genetic counseling in
7577 Alabama and who hold a master's degree or doctoral degree in
7678 genetic counseling from an ACGC or ABMGG accredited training
7779 program, or an equivalent program approved by the ACGC or the
7880 ABMGG, appointed by the Governor.
7981 (3) One physician appointed by the Medical Association
8082 of the State of Alabama.
8183 (4) One physician appointed by the State Board of
8284 Medical Examiners.
8385 (5) One physician who specializes in pediatric genetics
8486 appointed by the Lieutenant Governor.
8587 (6) One physician appointed by the Speaker of the House
8688 of Representatives.
8789 (c) Board members appointed by the Governor shall serve
8890 for terms of two years and, upon the expiration of a term, may
8991 continue to serve until replaced or reappointed. All other
9092 board members shall serve until they are replaced by their
9193 respective appointing authority.
9294 (d) The board shall annually elect from its membership
9395 a chair, a vice chair, and a secretary.
9496 (e) The appointing authorities shall coordinate their
95-appointments to assure the board membership is inclusive and
96-reflects the racial, gender, geographic, urban, rural, and
97-economic diversity of this the state. Commencing on June 1,
98-2025, as the terms of the members serving on the board expire,
99-the membership of the board shall be appointed so that one
100-member resides in and is appointed from each congressional

126+(e) The appointing authorities shall coordinate their
127+appointments to assure the board membership is inclusive and

130+2025, as the terms of the members serving on the board expire,
131+the membership of the board shall be appointed so that one

133135 (f) Unless acting unreasonably or in bad faith, no
134136 member of the board shall be civilly liable for acting within
135137 the scope of his or her duties as a board member.
136138 (g) Members of the board shall serve without
137139 compensation but, to the extent funds are available, may
138140 receive the same per diem and travel allowance as state
139141 employees.
140142 (h)(1) Except as provided in subdivision (2), members
141143 of the board may participate in a regular meeting of the board
142144 by means of telephone conference, video conference, or similar
143145 communications equipment pursuant to the Alabama Open Meetings
144146 Act, Chapter 25A of Title 36.
145147 (2) Members of the board may only participate in a
146148 meeting of the board relating to a disciplinary action in
147149 person."
148150 Section 4. The Legislature concurs in the
149151 recommendation of the Sunset Committee as provided in Sections
150152 1, 2, and 3.
151153 Section 5. This act shall become effective on June 1,
152154 2025.
