17+SYNOPSIS:
18+Under existing law, termination dates are
19+established for enumerated state agencies. The agencies
20+are periodically reviewed by the Alabama Sunset
21+Committee. After the review process is completed, the
22+committee prepares its recommendation for the agencies
23+to the Legislature in the form of sunset bills which
24+either continue, terminate, or continue with
25+modification each agency reviewed.
26+This bill would provide for the continuance of
27+the Alabama Board of Licensure for Professional
28+Geologists until October 1, 2027.

1931 AN ACT
2032 Relating to the Alabama Sunset Law; to continue the
2133 existence and functioning of the Alabama Board of Licensure
22-for Professional Geologists until October 1, 2027, with
23-certain modifications; to amend Sections 34-41-4, Code of
24-Alabama 1975, to require that a board member resides in and be
25-appointed from each congressional district in this state.

2635 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2736 Section 1. Pursuant to the Alabama Sunset Law, the
2837 Sunset Committee recommends the continuance of the Alabama
2938 Board of Licensure for Professional Geologists until October
30-1, 2027, with additional recommendation for statutory change
31-as set out in Section 3.
32-Section 2. The existence and functioning of the
33-Alabama Board of Licensure for Professional Geologists,
34-created and functioning pursuant to Sections 34-41-1 to
35-34-41-24, inclusive, Code of Alabama 1975, is continued until
36-October 1, 2027, and those code sections are expressly
37-preserved.

68-Section 3. Section 34-41-4, Code of Alabama 1975, is
69-amended to read as follows:
70-"ยง34-41-4
71-(a) There is created the Alabama Board of Licensure for
72-Professional Geologists which shall administer and enforce
73-this chapter.
74-(b) The board shall consist of seven members appointed
75-by the Governor from a list of nominees submitted by the
76-board, or any entity designated by the board. Members of the
77-board, except for the initial board, shall be licensed
78-professional geologists. Whenever possible the membership of
79-the board shall be inclusive and reflect the racial, gender,
80-geographic, urban/rural urban, rural, and economic diversity
81-of the state. Commencing on June 1, 2025, as the terms of the
82-members serving on the board expire, the membership of the
83-board shall be appointed so that one member resides in and is
84-appointed from each congressional district in this state.
85-(c) Each member of the board shall be a citizen of the
86-United States, a resident of the State of Alabama this state
87-for at least five years immediately preceding appointment,
88-reside in the this state during the term of office, and be at
89-least 25 years of age.
90-(d) All members of the initial board shall be appointed
91-by the Governor from a list of nominees who shall at the time
92-of their appointment qualify for licensing under this chapter
93-and become duly licensed during their term. Membership of the
94-board shall include at least one representative member from
95-each of the following professional subgroups of geologists:
96-Faculty of the departments of geology at colleges and

69+1, 2027.
70+Section 2. The existence and functioning of the Alabama
71+Board of Licensure for Professional Geologists , created and
72+functioning pursuant to Sections *ENTER SECTIONS*, inclusive,
73+Code of Alabama 1975, is continued until October 1, 20**, and
74+those code sections are expressly preserved.
75+Section 3. The Legislature concurs in the
76+recommendations of the Sunset Committee as provided in
77+Sections 1 and 2.
78+Section 4. This act shall become effective June 1,
79+2025.

126-Faculty of the departments of geology at colleges and
127-universities in the State of Alabama this state that grant
128-degrees in the geological sciences; governmental agencies
129-employing geologists; businesses, exclusive of those exempted
130-herein; mining industry; petroleum industry; geotechnical
131-engineering firms; and/or environmental engineering firms; and
132-independent geological consultants.
133-(e) After the establishment of the initial board, all
134-members of the board shall be licensed under this chapter. The
135-term of office of each member of the board shall be three
136-years. Notwithstanding the foregoing, of the first members
137-appointed, two shall be appointed for a term of one year, two
138-for terms of two years, and three for terms of three years. No
139-member shall serve more than two consecutive three-year terms,
140-without interruption in service of at least three years.
141-(f) Each term on the board shall expire on September 30
142-of the year in which the term expires. When the term of a
143-member expires, the Governor shall appoint a new member or
144-reappoint the current member for a full term under subsections
145-(d) and (e). If a vacancy occurs, within 90 days of the
146-vacancy the Governor shall appoint a replacement to fill the
147-vacancy for the remainder of the unexpired term. Except for
148-the members of the initial board, all appointments and
149-reappointments to the board shall be made by the Governor from
150-a list of nominees submitted by the board, or any entity
151-designated by the board. In appointing members to the board,
152-the Governor shall strive to achieve diversity in race,
153-gender, geography, residence, and economic condition.
154-(g) The Governor may remove a member of the board only

184-(g) The Governor may remove a member of the board only
185-for neglect of duty, an unexcused failure to attend more than
186-one of the regularly scheduled meetings held in a calendar
187-year during the term in office of the member, malfeasance,
188-violation of this chapter, or conviction of a felony or other
189-crime of moral turpitude.
190-(h) Members of the board shall receive reimbursement
191-for expenses incurred in the performance of duties of one
192-hundred dollars ($100) per day plus mileage payable at the
193-same rate as paid for state officers and employees for each
194-day of actual attendance at a regular or special meeting of
195-the board.
196-(i) The board may employ the necessary personnel for
197-performance of its functions and fix their compensation. The
198-board may appoint committees to aid in the performance of its
199-functions."
200-Section 4. The Legislature concurs in the
201-recommendation of the Sunset Committee as provided in Sections
202-1, 2, and 3.
203-Section 5. This act shall become effective on June 1,
