1515 SYNOPSIS:
1616 Under existing law, commonly known as the
1717 Omnibus Pay Act, designated elected local officials are
1818 entitled to receive the same uniform increases in
1919 compensation, such as cost-of-living increases, as
2020 county employees. However, the law provides that the
2121 uniform increases are not included in the base
2222 compensation for the local official.
2323 This bill would provide that the uniform
2424 increases in compensation granted to local officials
2525 would be included in the initial compensation of the
2626 local officials.

2929 AN ACT
3030 Relating to local county officials; to amend Section
3131 11-2A-4 of the Code of Alabama 1975, commonly known as the
3232 Omnibus Pay Act, to provide that uniform increases in
3333 compensation granted to local officials would be included in
3434 the initial compensation of the local officials.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

6666 Section 1. Section 11-2A-4 of the Code of Alabama 1975,
6767 is amended to read as follows:
6868 "ยง11-2A-4
6969 (a)(1) After August 1, 2016, the local officials
7070 covered by this chapter shall be entitled to receive the same
7171 uniform increases in compensation, whether the uniform
7272 increases are based on a percentage of compensation or a flat
7373 dollar amount, that are granted equally to all county
7474 employees by the county commission. The increases shall be in
7575 the same amount or percentage, as the case may be, as that
7676 amount or percentage increase provided to the county's
7777 employees.
7878 (2) Except as otherwise provided herein, officials in
7979 Category 2 shall be eligible for the cost-of-living increases
8080 beginning on October 1, 2000. If the implementation of this
8181 chapter increases the compensation of an incumbent office
8282 holder, the increase shall be paid as provided in subdivision
8383 (5) of Section 11-2A-2.
8484 (3) The base compensation for the purposes of
8585 implementation of this subsection shall be that compensation
8686 established on October 1, 2000, and shall remain those
8787 respective amounts until increased as provided under the
8888 provisions of this chapter of any local official elected or
8989 appointed after July 1, 2025, shall be the compensation of the
9090 immediately prior officeholder including any uniform increases
9191 received by the prior officeholder. Any official shall
9292 continue to be entitled to receive uniform increases in
9393 compensation as provided in subdivision (1) .
9494 (b) Any provision of this chapter to the contrary

124124 (b) Any provision of this chapter to the contrary
125125 notwithstanding, the Legislature, by local law, may increase
126126 the compensation for local officials covered under this
127127 chapter. However, if a local law increases the compensation of
128128 a local official, such the local official shall not be
129129 entitled to any uniform increases pursuant to the procedure in
130130 subsection (a), until such time as the total compensation he
131131 or she would have received under subsection (a) is equal to or
132132 exceeds the increase provided by the local law except as
133133 otherwise provided by local law ."
134134 Section 2. This act shall become effective on July 1,
135135 2025.
