15	15	SYNOPSIS:
16	16	Under existing law, commonly known as the
17	17	Omnibus Pay Act, designated elected local officials are
18	18	entitled to receive the same uniform increases in
19	19	compensation, such as cost-of-living increases, as
20	20	county employees. However, the law provides that the
21	21	uniform increases are not included in the base
22	22	compensation for the local official.
23	23	This bill would provide that the uniform
24	24	increases in compensation granted to local officials
25	25	would be included in the initial compensation of the
26	26	local officials.

28	28	TO BE ENTITLED
29	29	AN ACT
30	30	Relating to local county officials; to amend Section
31	31	11-2A-4 of the Code of Alabama 1975, commonly known as the
32	32	Omnibus Pay Act, to provide that uniform increases in
33	33	compensation granted to local officials would be included in
34	34	the initial compensation of the local officials.
35	35	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
36	36	Section 1. Section 11-2A-4 of the Code of Alabama 1975,

66	66	Section 1. Section 11-2A-4 of the Code of Alabama 1975,
67	67	is amended to read as follows:
68	68	"§11-2A-4
69	69	(a)(1) After August 1, 2016, the local officials
70	70	covered by this chapter shall be entitled to receive the same
71	71	uniform increases in compensation, whether the uniform
72	72	increases are based on a percentage of compensation or a flat
73	73	dollar amount, that are granted equally to all county
74	74	employees by the county commission. The increases shall be in
75	75	the same amount or percentage, as the case may be, as that
76	76	amount or percentage increase provided to the county's
77	77	employees.
78	78	(2) Except as otherwise provided herein, officials in
79	79	Category 2 shall be eligible for the cost-of-living increases
80	80	beginning on October 1, 2000. If the implementation of this
81	81	chapter increases the compensation of an incumbent office
82	82	holder, the increase shall be paid as provided in subdivision
83	83	(5) of Section 11-2A-2.
84	84	(3) The base compensation for the purposes of
85	85	implementation of this subsection shall be that compensation
86	86	established on October 1, 2000, and shall remain those
87	87	respective amounts until increased as provided under the
88	88	provisions of this chapter of any local official elected or
89	89	appointed after July 1, 2025, shall be the compensation of the
90	90	immediately prior officeholder including any uniform increases
91	91	received by the prior officeholder. Any official shall
92	92	continue to be entitled to receive uniform increases in
93	93	compensation as provided in subdivision (1) .

124	124	(b) Any provision of this chapter to the contrary
125	125	notwithstanding, the Legislature, by local law, may increase
126	126	the compensation for local officials covered under this
127	127	chapter. However, if a local law increases the compensation of
128	128	a local official, such the local official shall not be
129	129	entitled to any uniform increases pursuant to the procedure in
130	130	subsection (a), until such time as the total compensation he
131	131	or she would have received under subsection (a) is equal to or
132	132	exceeds the increase provided by the local law except as
133	133	otherwise provided by local law ."
