17	17	SYNOPSIS:
18	18	Under current law, it is a crime to give a false
19	19	name or address to a law enforcement officer in the
20	20	course of the officer's official duties with the intent
21	21	to mislead the officer.
22	22	This bill would also make it a crime to give a
23	23	false date of birth to a law enforcement officer in the
24	24	course of the officer's official duties with the intent
25	25	to mislead the officer.
26	26	Under current law, a law enforcement officer may
27	27	stop an individual the officer suspects is committing,
28	28	has committed, or is about to commit a felony or other
29	29	public offense and demand the individual's name,
30	30	address, and an explanation of the individual's
31	31	actions.
32	32	This bill would also authorize a law enforcement
33	33	officer to demand an individual's date of birth if the
34	34	officer suspects the individual is committing, has
35	35	committed, or is about to commit a felony or other
36	36	public offense.

70	70	Relating to crimes and offenses; to amend Sections
71	71	13A-9-18.1 and 15-5-30, Code of Alabama 1975; to further
72	72	provide for the information a law enforcement officer can
73	73	demand in the course of the officer's official duties.
74	74	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
75	75	Section 1. Sections 13A-9-18.1 and 15-5-30, Code of
76	76	Alabama 1975, are amended to read as follows:
77	77	"§13A-9-18.1
78	78	(a) A person commits the crime of giving a false name
79	79	or address information to a law enforcement officer if the
80	80	person gives a false name or, address, or date of birth to a
81	81	law enforcement officer in the course of the officer's
82	82	official duties with intent to mislead the officer.
83	83	(b) Giving a false name or address information to a law
84	84	enforcement officer is a Class A misdemeanor."

86	86	A sheriff or other officer acting as sheriff, his
87	87	deputy or any constable, acting within their respective
88	88	counties, any marshal, deputy marshal or policeman of any
89	89	incorporated city or town within the limits of the county or
90	90	any highway patrolman or state trooper law enforcement officer
91	91	may stop any person abroad individual in a public place whom
92	92	he the officer reasonably suspects is committing, has
93	93	committed, or is about to commit a felony or other public
94	94	offense and may demand of him the individual his or her name,
95	95	address, date of birth, and an explanation of his or her
96	96	actions."
