1717 SYNOPSIS:
1818 Under current law, it is a crime to give a false
1919 name or address to a law enforcement officer in the
2020 course of the officer's official duties with the intent
2121 to mislead the officer.
2222 This bill would also make it a crime to give a
2323 false date of birth to a law enforcement officer in the
2424 course of the officer's official duties with the intent
2525 to mislead the officer.
2626 Under current law, a law enforcement officer may
2727 stop an individual the officer suspects is committing,
2828 has committed, or is about to commit a felony or other
2929 public offense and demand the individual's name,
3030 address, and an explanation of the individual's
3131 actions.
3232 This bill would also authorize a law enforcement
3333 officer to demand an individual's date of birth if the
3434 officer suspects the individual is committing, has
3535 committed, or is about to commit a felony or other
3636 public offense.

7070 Relating to crimes and offenses; to amend Sections
7171 13A-9-18.1 and 15-5-30, Code of Alabama 1975; to further
7272 provide for the information a law enforcement officer can
7373 demand in the course of the officer's official duties.
7474 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7575 Section 1. Sections 13A-9-18.1 and 15-5-30, Code of
7676 Alabama 1975, are amended to read as follows:
7777 "§13A-9-18.1
7878 (a) A person commits the crime of giving a false name
7979 or address information to a law enforcement officer if the
8080 person gives a false name or, address, or date of birth to a
8181 law enforcement officer in the course of the officer's
8282 official duties with intent to mislead the officer.
8383 (b) Giving a false name or address information to a law
8484 enforcement officer is a Class A misdemeanor."
8585 "§15-5-30
8686 A sheriff or other officer acting as sheriff, his
8787 deputy or any constable, acting within their respective
8888 counties, any marshal, deputy marshal or policeman of any
8989 incorporated city or town within the limits of the county or
9090 any highway patrolman or state trooper law enforcement officer
9191 may stop any person abroad individual in a public place whom
9292 he the officer reasonably suspects is committing, has
9393 committed, or is about to commit a felony or other public
9494 offense and may demand of him the individual his or her name,
9595 address, date of birth, and an explanation of his or her
9696 actions."
