1515 SYNOPSIS:
1616 This bill would prohibit the state and any
1717 political subdivision of the state and their law
1818 enforcement officers, agents, and employees from
1919 transporting homeless individuals to another city or
2020 county within the state unless authorized by law, court
2121 order, or the homeless individual or his or her agent.
2222 This bill would also provide criminal penalties
2323 for violations.

2727 Relating to crimes and offenses; to prohibit the state
2828 and political subdivisions of the state and their law
2929 enforcement officers, agents, and employees from transporting
3030 homeless individuals to another city or county within the
3131 state unless authorized by law, court order, or the homeless
3232 individual or his or her agent.
3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. (a) For the purpose of this section,
3535 "homeless" has the same meaning as in Section 15-20A-4, Code
3636 of Alabama 1975.

6767 (b) Unless authorized by law, court order, or the
6868 homeless individual or his or her agent, the state or a
6969 political subdivision of the state, or a law enforcement
7070 officer, agent, or employee thereof, when acting in his or her
7171 official capacity, shall not transport a homeless individual
7272 to another city or county within the state.
7373 (c) Subsection (b) does not apply if the state or a
7474 political subdivision of the state or a law enforcement
7575 officer, agent, or employee thereof has written consent from
7676 an entity in another city or county of this state agreeing to
7777 accept homeless individuals, and the entity actually accepts
7878 the individuals.
7979 (d) A violation of this section is a Class A
8080 misdemeanor. A separate violation is committed for each
8181 individual transported.
8282 Section 2. This act shall become effective on October
8383 1, 2025.
