16+SYNOPSIS:
17+Existing law establishes state holidays.
18+This bill would add Juneteenth as a state
19+holiday and provide that state employees must be given
20+the option to observe either Jefferson Davis' birthday
21+or Juneteenth in accordance with each state agency's
22+policy.
23+This bill would also delete duplicative language
24+and make nonsubstantive, technical revisions to update
25+the existing code language to current style.

1929 Relating to state holidays; to amend Section 1-3-8,
20-Code of Alabama 1975, to add Juneteenth as a state holiday;
30+Code of Alabama 1975, to add Juneteenth as a state holiday and
31+provide that state employees may observe Jefferson Davis'
32+birthday or Juneteenth in accordance with state agency policy;
2133 and to delete duplicative language and make nonsubstantive,
2234 technical revisions to update the existing code language to
2335 current style.
2436 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2537 Section 1. Section 1-3-8, Code of Alabama 1975, is
26-amended to read as follows:
27-"§1-3-8
28-(a) Sunday, Christmas Day, The following days are
29-official state holidays:
30-(1) New Year's Day, January 1.
31-(2) Martin Luther King, Jr.'s birthday , and Robert E.
32-Lee's birthday, the third Monday in January.
33-(3) George Washington's birthday , and Thomas
34-Jefferson's birthday, Confederate Memorial Day, National the
35-third Monday in February.
36-(4) Confederate Memorial Day, the fourth Monday in
37-April.
38-(5) Memorial Day, the last Monday in May.
39-(6) Jefferson Davis' birthday, the first Monday in

8193 (b) If any holiday falls on Sunday, the following day
8294 is the holiday. If any holiday falls on Saturday, the
8395 preceding day is the holiday.
84-(c) All state holidays shall be observed by the closing
85-of all state offices. In addition, Veterans' Day shall be
86-observed by the closing of all state, county, and municipal
87-offices, all banks located within this state, and the all
88-public K-12 schools,on such day. Public schools, grades K to
89-12, inclusive, and all public two-year institutions of higher
90-education shall also be closed on National Memorial Day, and
91-such closing shall be applicable to all students and
92-non-essential employees and Memorial Day shall be observed by
93-the closing of all public K-12 schools and all public two-year
94-and four-year institutions of higher education .
95-(d) The Superintendent of Banks, with the concurrence
96-of not less than two members of the state Banking Board, may
97-authorize anythe closure of state bank to close on National

125+preceding day is the holiday.
126+(c)(1) All state holidays, except Jefferson Davis'
127+birthday and Juneteenth, shall be observed by the closing of
128+all state offices. In addition, Veterans' Day shall be
129+observed by the closing of all state, county, and municipal
130+offices, all banks located within this state, and the all
131+public K-12 schools,on such day. Public schools, grades K to
132+12, inclusive, and all public two-year institutions of higher
133+education shall also be closed on National Memorial Day, and
134+such closing shall be applicable to all students and
135+non-essential employees and Memorial Day shall be observed by
136+the closing of all public K-12 schools and all public two-year
137+and four-year institutions of higher education .
138+(2) Notwithstanding subdivision (1), employees shall be
139+given the option to observe either Jefferson Davis' birthday
140+or Juneteenth as a state holiday. Each agency shall establish
141+a policy to implement this subdivision.
142+(d) The Superintendent of Banks, with the concurrence
143+of not less than two members of the state Banking Board, may
127144 authorize anythe closure of state bank to close on National
128145 Memorial Day, the last Monday in May, banks in observance of
129146 any state or federal holiday and on such any other days as may
130147 be declared by the Governor to be a state holidays holiday in
131148 honor of a special event. If any authorized a state holiday
132149 falls on Friday, the Superintendent of Banks may authorize the
133150 Saturday following that Friday to be a holiday. The
134151 superintendent may also authorize the closing of banks at
135152 12:00 noon on the day prior to Christmas Day, and the day
136153 prior to New Year's Day, if such days the holidays fall on
137-business days.
138-(b) Of the above enumerated legal public holidays, the
139-following shall be observed on the dates herein prescribed:
140-(1) Robert E. Lee's birthday - the third Monday in
141-January.
142-(2) George Washington's birthday - the third Monday in
143-February.
144-(3) Confederate Memorial Day - the fourth Monday in
145-April.
146-(4) Jefferson Davis' birthday - the first Monday in
147-June.
148-(5) Columbus Day and Fraternal Day - the second Monday
149-in October.
150-(6) Veterans' Day - the eleventh day of November.

189206 provided abovein subsection (a) , Mardi Gras shall be deemed a
190207 holiday in Mobile and Baldwin and Mobile Counties, and all
191208 state offices shall be closed in those counties on Mardi Gras.
192209 (d)(2)In addition to the legal holidays provided above
193210 all state employees, except All state employees other than
194211 those employed in Baldwin and Mobile Counties , shall be
195-granted one personal leave day per year. The personal leave
196-day shall be granted on January 1 of each year. All state
197-employees employed in Baldwin and Mobile Counties shall be
198-granted no personal leave day. All such personal leave days
199-granted in any year pursuant to this subdivision shall be used
200-by the end of the calendar year . All such personal leave days
201-shall and must be scheduled during the year with the approval
202-of the supervisor. Supervisors failing to schedule personal
203-leave days for employees shall justify that action in writing
204-to the Director of State Personnel and the employee shall
205-receive pay at a rate not less than the employee's usual and
206-customary rate of pay for any personal leave day not taken by
207-December 31 of each year.
208-(e)(f)(1)All state holidays shall be observed by the
209-closing of all state offices. Any state office may remain open
210-on a state holiday upon written notice by the appointing
211-authority to the State Personnel Board at least 60 days in
212-advance of the holiday. Provided, that In addition, any state

243+day shall be granted on January 1 of each year. All state
244+employees employed in Baldwin and Mobile Counties shall be
245+granted no personal leave day. All such personal leave days
246+granted in any year pursuant to this subdivision shall be used
247+by the end of the calendar year . All such personal leave days
248+shall and must be scheduled during the year with the approval
249+of the supervisor. Supervisors failing to schedule personal
250+leave days for employees shall justify that action in writing
251+to the Director of State Personnel and the employee shall

245262 openings opening of state offices needing to be open on
246263 holidays on a regular basis for essential services.
247264 (2) Any state employee working on a state holiday shall
248265 receive a day of compensatory leave or paid compensation in
249266 lieu of the holiday as provided herein .
250267 (f) Each employee shall attempt to schedule any
251268 compensatory leave day provided in lieu of a regularly
252269 scheduled holiday, subject to the approval of the his or her
253-supervisor, during the quarter that the regularly scheduled
254-holiday occurred. If any compensatory leave day cannot be
255-scheduled during the designated quarter, the compensatory
256-leave day may be accumulated at the request of the employee
257-for up to one year. Supervisors failing to schedule
258-compensatory leave days for employees within the quarter,
259-unless the day is carried forward at the request of the
260-employee, shall justify that action in writing to the Director
261-of State Personnel and the employee shall receive pay at a
262-rate not less than the employee's usual and customary rate of
263-pay for any compensatory leave day to which the employee may
264-be entitled and which has not been taken.
265-(g)(1) The first day in December of each year is
266-designated as Mrs. Rosa L. Parks Day in this state. All
267-citizens of this state are requested to devote some portion of
268-Mrs. Rosa L. Parks Day to commemorate the accomplishments of
269-Mrs. Rosa L. Parks, a woman of great courage, vision, love,
270-and faith who helped usher in the modern civil rights movement
271-on December 1, 1955, by refusing to give up her seat on a bus
