1616 This bill makes appropriations for the support,

2727 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2828 Section 1. There is hereby appropriated for the support
2929 of public education in Alabama for the fiscal year ending
3030 September 30, 2026, for debt service, and for capital outlay
3131 to be paid out of funds specified in subsection (a) of Section
3232 2 of this act and the amounts specified in subsections (a),
3333 (b), (c), (d), and (e) of Section 3 of this act. For the
3434 purpose specified in subsection (b) of Section 2 of this act,
3535 amounts are shown by programmatic area and the total for all
3636 programs is shown so as to include estimated sources of funds

6868 Education Trust Fund and "Federal and Local Funds" shall mean

7272 Section 2. (a) The appropriations provided for in this
7373 act shall be paid from funds in the State Treasury to the
7474 credit of the Education Trust Fund, Alabama Peace Officers'
7575 Standards and Training Fund, Impaired Drivers Trust Fund,
7676 Driver Education and Training Fund, Special Education
7777 Catastrophic Fund, Public School Fund and other listed funds
7878 and are hereby made for the support of public education in
7979 Alabama for the fiscal year ending September 30, 2026, and the
8080 appropriations herein made shall be subject to the provisions,
8181 terms, conditions and limitations of the Budget and Financial
8282 Control Act (Code of Alabama 1975, Sections 41-4-80 et seq.),
8383 the provisions of the Budget Management Act of 1976 (Code of
8484 Alabama 1975, Sections 41-19-1 et seq.), and shall be in the
8585 amounts hereinafter specified.
8686 (b) Amounts shown hereinunder the columns "Other Funds"
8787 and "Total" are as set forth for the purpose of establishing
8888 amounts estimated to be available by programmatic area from
8989 sources other than those listed in subsection (a) of this

379379 The funds appropriated for Workforce Development are to be expended for those costs
380380 incurred by the State in honoring commitments to pay workforce development costs,
381381 including services and other assistance and expenses of recruitment and training of
382382 a company's workforce, that are undertaken to induce companies to locate and expand
383383 their operations in Alabama (described hereinafter as a "Project") and to develop
384384 and implement training, placement and recruitment programs that will improve
385385 development and expand the State's workforce. Such costs include, but are not
386386 limited to: (i) AIDT operating costs directly related to a Project; (ii) wages and
387387 benefits for trainers engaged by AIDT for the purpose of a Project; (iii) costs
388388 which the State has agreed to pay under the terms of a Project Agreement with a
389389 company that are necessary and reasonable charges incurred by the company or its
390390 affiliates for personnel providing training to the company's employees, whether
391391 those trainers are employees of the company or its vendors or suppliers, including
392392 wages, benefits and travel (domestic and, when necessary, international); (iv) any
393393 necessary materials, equipment, manuals, or other relevant training materials; (v)
394394 the costs incurred for purchasing or repairing or replacing training tools and
395395 equipment; (vi) costs incurred for the purchase or construction and maintenance of
396396 training facilities; (vii) travel expenses for prospective and current employees and
397397 trainees, including travel, food, lodging, relocation, and other costs necessary and
398398 reasonable to enable the company to secure a qualified workforce; and (viii) outside
399399 training fees. The above funds appropriated for Workforce Development shall be
400400 expended primarily for the training of Alabama residents. It is further the intent
401401 that contracts with vendors to provide workforce training shall be inclusive and
402402 reflect the racial and gender diversity of the State. The Secretary of the
403403 Department of Commerce shall report semi-annually to the Chairs of the Senate
404404 Committee on Finance and Taxation-Education, the House Ways and Means-Education
405405 Committee, the Finance Director, and the Legislative Fiscal Officer any funds
406406 allocated for workforce training. Such report shall include a summary of the persons
407407 trained and the vendors providing the training. The report shall contain information
408408 including the residence, race and gender of the persons trained and of the principal
409409 or majority owner of the firm or business contracted with to provide the training
410410 services.

716716 The above appropriation shall be expended to support students in obtaining
717717 certifications and post-secondary degrees, to aid in scholarships, support
718718 services including transportation, tuition and fees, and academic support
719719 services. This appropriation is contingent upon the Women's Foundation of
720720 Alabama providing a match of private funding and programmatic supports of
721721 $400,000. The Foundation shall file a report no later than December 31, 2026
722722 to the Governor and the Chairs of the Senate Committee on Finance and
723723 Taxation-Education and the House Ways and Means-Education Committee detailing
724724 the costs, benefits, and economic impacts on the Fund.

730730 The Board of Trustees of the Alabama Community College System, in consultation
731731 with the Alabama Industrial Development and Training Institute, shall
732732 establish qualifications for the award of scholarships to high school students
733733 and adults enrolled in a state educational program relating to the automotive
734734 manufacturing industry and shall further provide for the implementation and
735735 administration of the scholarships. Scholarship recipients shall be selected
736736 by the Board, in consultation with a scholarship committee, comprised of
737737 members of the Board of Directors of the Alabama Automotive Manufacturers
738738 Association, from applications submitted to the association. The Board shall
739739 file a report with the Chairs of the Senate Committee on Finance and
740740 Taxation-Education, the House Ways and Means-Education Committee, the
741741 Legislative Fiscal Officer, and the Finance Director on September 30, 2026
742742 regarding the total number of scholarships awarded for the Fall term of the
743743 2025-2026 academic year and the institution attended by the scholarship
744744 recipients. The report shall also include the name of each scholarship
745745 recipient and the number of years the recipient has received a scholarship.

20022002 Certified Academic Language Therapists (CALT) and other costs of the program. Supplement
20032003 amounts will be determined by the availability of funds based on the number of CALT

56085608 offices, commissions, and agencies are hereby directed to make
56095609 the transfer of funds to the State Personnel Department in the
56105610 amounts enumerated in the general appropriations act for the
56115611 fiscal year ending September 30, 2026. All agencies and
56125612 institutions enumerated in this act that receive services from
56135613 other governmental agencies enumerated in this act or the
56145614 general appropriations act shall make full payment in a timely
56155615 manner for such services.
56165616 Section 9. All encumbered balances of a previous
56175617 fiscal year appropriation other than the exclusions authorized
56185618 by the Code of Alabama 1975, Section 41-4-93, shall lapse no
56195619 later than September 30 of the fiscal year immediately
56205620 following the fiscal year for which the appropriation was made
56215621 and shall revert to the credit of the Education Trust Fund or
56225622 earmarked fund from which the appropriation or appropriations
56235623 were made.
56245624 Section 10. Upon certification to the Director of
56255625 Finance by the State Attorney General that a federal court has
56265626 ordered the State of Alabama to pay claims, attorney fees, or
56275627 other costs relating to said court order, funds are hereby
56285628 appropriated to the affected department, board, bureau, or
56295629 commission in the amount necessary to satisfy that court
56305630 order. Such appropriations are in addition to any other

56715671 redirecting Other Current Expense funds designated for

56755675 maintaining a one-month fund balance.
56765676 Section 13. The appropriations made herein to the
56775677 departments, boards, offices, commissions, and agencies
56785678 include the amounts necessary to pay the State Employees'
56795679 Insurance Board (SEIB). The SEIB rate shall be $1,025 per
56805680 month for each full-time employee for the fiscal year ending
56815681 September 30, 2026. The State Employees' Insurance Board will
56825682 adjust the insurance program wherever appropriate to maintain
56835683 the aforementioned fixed rate.
56845684 Section 14. Notwithstanding any other provisions of
56855685 this act or any other act, any amount from appropriations for
56865686 the fiscal year ending September 30, 2025 to the various state
56875687 agencies and institutions in this act, including
56885688 appropriations from the Education Trust Fund, which are

57215721 Section 15. (a) The At-Risk and High Hopes
57225722 appropriations made to the State Department of Education shall
57235723 be expended as follows: 50% shall be at the discretion of the
57245724 State Superintendent of Education and 50% shall be awarded in
57255725 the form of grants to school systems/entities for activities
57265726 or programs designed to enhance outcomes for At-Risk Students.
57275727 At-Risk Students shall be defined as students who have not met
57285728 proficiency standards for state accountability assessments and
57295729 one or more of the following apply: the student attends a
57305730 Title I school; qualifies for free or reduced lunch; qualifies
57315731 for special education or Tier III intervention; or is an
57325732 English language learner. In the awarding of grants,
57335733 preference will be given to undertakings that will directly
57345734 impact student achievement and improve performance on state
57355735 assessments to include remediation for students, after-school
57365736 and tutorial programs, career/technical programs, character
57375737 education, enrichment activities, programs that enhance
57385738 reading and mathematics abilities in students, activities that
57395739 increase grade-to-grade promotion, career and college
57405740 readiness, and early warning and prevention programs. Programs
57415741 must employ evidence-based practices and measure student
57425742 growth and achievement using research-based norms and
57435743 criterion. Funds should be awarded on a per-pupil basis, with
57445744 no more than ten percent of the grant award going toward
57455745 personnel costs.

57755775 (b) In an effort to provide the best and most
57765776 efficient implementation for intervention and innovation in
57775777 schools, administration of the grant awards shall be assigned
57785778 to the Alabama State Department of Education's Division of
57795779 Administrative and Financial Support with evaluative input
57805780 from other Alabama State Department of Education advisory
57815781 personnel, including the State Superintendent of Education, as
57825782 appropriate. The grant application process must require
57835783 districts to submit plans to the Alabama State Department of
57845784 Education detailing their intended use of the grant funds with
57855785 regard to student proficiency and growth. Grants may be
57865786 awarded any time after July 1st so schools can prepare for the
57875787 new school year. Notwithstanding the foregoing, the Alabama
57885788 State Department of Education's Division of Administrative and
57895789 Financial Support shall make every reasonable effort to notify
57905790 grant recipients of awards by August 1, 2025. No funding will
57915791 be available until October 1, 2025. Grantees will have no
57925792 guarantee of funding until October 1, 2025.
57935793 (c) Upon the awarding of any grant funds, the Alabama
57945794 State Department of Education must submit a report to the
57955795 Chairs of the House Ways and Means-Education Committee, the
57965796 Senate Committee on Finance and Taxation-Education, the
57975797 Finance Director, and the Legislative Fiscal Officer that
57985798 shall indicate the grant-recipient districts and each
57995799 district’s plan for those funds. Those districts shall submit
58005800 follow-up reports indicating the results of those plans from
58015801 the previous school year by July 31, 2026.

58315831 Section 16. (a) All nongovernmental entities,
58325832 identified by the Legislative Services Agency, which are
58335833 allocated funds in Section 3 of this act shall file a report
58345834 with the Chairs of the House Ways and Means-Education
58355835 Committee, the Senate Committee on Finance and
58365836 Taxation-Education, Finance Director, and the Legislative
58375837 Fiscal Officer prior to the start of the 2026 Regular Session,
58385838 regarding the proposed expenditures and usage of the funds
58395839 appropriated in the fiscal year ending September 30, 2026. The
58405840 Legislative Services Agency shall provide notice to the
58415841 identified nongovernmental entities within 60 days following
58425842 enactment of this act regarding the reporting requirements and
58435843 the methodology to submit reports and format to be used, which
58445844 may include an online platform.
58455845 (b) In the event an entity was appropriated funds from
58465846 the Education Trust Fund in the fiscal year ending September
58475847 30, 2025, the entity shall also include in its report a
58485848 detailed breakdown of the expenditure and use of those funds,
58495849 including an inventory of the services delivered and number of
58505850 clients served, pursuant to guidelines established by the
58515851 Legislative Services Agency.
58525852 Section 17. The State Superintendent of Education
58535853 shall notify each local superintendent and finance officer of
58545854 each local education agency by email regarding the
58555855 availability and application process, including any required
58565856 forms, for any available grant opportunities during FY 2026.
58575857 The State Superintendent shall notify all members of the local
58585858 legislative delegation five days prior to the announcement of

58885888 any grant made to any entity located in the legislative
58895889 jurisdiction. The five days prior notice requirement shall be
58905890 waived in the event of a declared emergency. The Governor
58915891 shall encourage the Department to disburse the funds provided
58925892 herein on a nondiscriminatory basis.
58935893 Section 18. If any section, paragraph, sentence,
58945894 clause, provision, or portion of this act or all or any
58955895 portion of the appropriations herein made is held
58965896 unconstitutional or invalid, it shall not affect any other
58975897 section, paragraph, sentence, clause, provision, or portion of
58985898 this act or any other appropriation or appropriations or
58995899 portion thereof hereby made not in and of itself
59005900 unconstitutional or invalid.
59015901 Section 19. All laws or parts of laws, general,
59025902 special, private, or local in conflict with or inconsistent
59035903 with the provisions of this act are hereby expressly repealed.
59045904 Section 20. This act shall become effective on October
59055905 1, 2025.
