1515 SYNOPSIS:
1616 This bill makes an appropriation of
1717 $15,816,579 from the Education Trust Fund to Tuskegee
1818 University in Tuskegee, Alabama, for the support and
1919 maintenance of the educational program of the
2020 institution, for the fiscal year ending September 30,
2121 2026; to provide that the appropriation is subject to
2222 certain provisions of the Code of Alabama 1975; to
2323 require an operations plan and an audited financial
2424 statement prior to the release of any funds; and to
2525 require an end of year report.

2828 AN ACT
2929 To make an appropriation of $15,816,579 from the
3030 Education Trust Fund to Tuskegee University in Tuskegee,
3131 Alabama, for the support and maintenance of the educational
3232 program of the institution, for the fiscal year ending
3333 September 30, 2026; to provide that the appropriation is
3434 subject to certain provisions of the Code of Alabama 1975; to
3535 require an operations plan and an audited financial statement
3636 prior to the release of any funds; and to require an end of
3737 year report.

6666 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6767 Section 1. Tuskegee University has a unique
6868 relationship to the State of Alabama. Due to the unique nature
6969 of the circumstances related to the establishment and
7070 development of Tuskegee Institute which differs from that of
7171 private schools and colleges receiving funds from the state
7272 and from the state's public colleges and universities, the
7373 institution should be afforded a unique treatment relative to
7474 funding from the Education Trust Fund. Tuskegee Institute was
7575 established by an act of the Legislature in 1881 and
7676 separately incorporated by an act of the Legislature in 1892;
7777 the Governor appoints five commissioners who serve as voting
7878 members on the Tuskegee University Board; and the State
7979 Superintendent of Education serves as an ex officio voting
8080 commissioner on the Tuskegee University Board. Tuskegee has
8181 received appropriations from the Legislature since 1881. Being
8282 a private institution as well as a state related and supported
8383 institution, it is deemed that Tuskegee University should be
8484 funded accordingly and not as the private schools and colleges
8585 nor as the state public colleges and universities are funded.
8686 Section 2. There is hereby appropriated the sum of
8787 $15,816,579 from the Education Trust Fund to Tuskegee
8888 University in Tuskegee, Alabama, for the support and
8989 maintenance of the educational program of the institution, for
9090 the fiscal year ending September 30, 2026. Of the above
9191 appropriation, at least $2,000,000 shall be expended for the
9292 agricultural research and extension service state match.
9393 Section 3. The above appropriation is made for the
9494 support of public education in Alabama and for the support and

124124 support of public education in Alabama and for the support and
125125 maintenance of the above program. The appropriation shall be
126126 subject to the provisions, terms, conditions, and limitations
127127 of the Budget and Financial Control Act, Section 41-4-80 et
128128 seq., Code of Alabama 1975, the provisions of the Budget
129129 Management Act of 1976, Section 41-19-1 et seq., Code of
130130 Alabama 1975, and any other provisions of this act.
131131 Section 4. (a) Prior to the release of any funds
132132 appropriated under this act the following reports shall be
133133 submitted:
134134 (1) An operations plan for the 2026 fiscal year,
135135 including goals and measurable performance indicators, shall
136136 be submitted to and approved by the Director of Finance, as
137137 provided for state agencies in Section 41-19-10 of the Code of
138138 Alabama 1975.
139139 (2) An audited financial statement for all operations
140140 during the 2024 fiscal year.
141141 (b) It is the intent that funds appropriated for the
142142 2026 fiscal year shall be released by the Director of Finance
143143 following receipt of the above reports.
144144 (c) In addition, quarterly reports shall be made to the
145145 Director of Finance relating actual expenditures and
146146 accomplishments to planned expenditures and accomplishments.
147147 An end of year performance report for the 2026 fiscal year
148148 shall be made to the Director of Finance stating the work
149149 accomplished and the services provided and the costs of
150150 accomplishing the work and providing the services, citing
151151 meaningful measures of program effectiveness and costs, as is
152152 required for state agencies in Section 41-19-11 of the Code of

184184 (d) The Director of Finance shall forward a copy of all
185185 required reports to the Legislative Council in a timely
186186 manner.
187187 Section 5. This act shall become effective October 1, 2025.
