16	16	This bill makes an appropriation of
17	17	$15,816,579 from the Education Trust Fund to Tuskegee
18	18	University in Tuskegee, Alabama, for the support and
19	19	maintenance of the educational program of the
20	20	institution, for the fiscal year ending September 30,
21	21	2026; to provide that the appropriation is subject to
22	22	certain provisions of the Code of Alabama 1975; to
23	23	require an operations plan and an audited financial
24	24	statement prior to the release of any funds; and to
25	25	require an end of year report.

28	28	AN ACT
29	29	To make an appropriation of $15,816,579 from the
30	30	Education Trust Fund to Tuskegee University in Tuskegee,
31	31	Alabama, for the support and maintenance of the educational
32	32	program of the institution, for the fiscal year ending
33	33	September 30, 2026; to provide that the appropriation is
34	34	subject to certain provisions of the Code of Alabama 1975; to
35	35	require an operations plan and an audited financial statement
36	36	prior to the release of any funds; and to require an end of
37	37	year report.

66	66	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
67	67	Section 1. Tuskegee University has a unique
68	68	relationship to the State of Alabama. Due to the unique nature
69	69	of the circumstances related to the establishment and
70	70	development of Tuskegee Institute which differs from that of
71	71	private schools and colleges receiving funds from the state
72	72	and from the state's public colleges and universities, the
73	73	institution should be afforded a unique treatment relative to
74	74	funding from the Education Trust Fund. Tuskegee Institute was
75	75	established by an act of the Legislature in 1881 and
76	76	separately incorporated by an act of the Legislature in 1892;
77	77	the Governor appoints five commissioners who serve as voting
78	78	members on the Tuskegee University Board; and the State
79	79	Superintendent of Education serves as an ex officio voting
80	80	commissioner on the Tuskegee University Board. Tuskegee has
81	81	received appropriations from the Legislature since 1881. Being
82	82	a private institution as well as a state related and supported
83	83	institution, it is deemed that Tuskegee University should be
84	84	funded accordingly and not as the private schools and colleges
85	85	nor as the state public colleges and universities are funded.
86	86	Section 2. There is hereby appropriated the sum of
87	87	$15,816,579 from the Education Trust Fund to Tuskegee
88	88	University in Tuskegee, Alabama, for the support and
89	89	maintenance of the educational program of the institution, for
90	90	the fiscal year ending September 30, 2026. Of the above
91	91	appropriation, at least $2,000,000 shall be expended for the
92	92	agricultural research and extension service state match.
93	93	Section 3. The above appropriation is made for the
94	94	support of public education in Alabama and for the support and

124	124	support of public education in Alabama and for the support and
125	125	maintenance of the above program. The appropriation shall be
126	126	subject to the provisions, terms, conditions, and limitations
127	127	of the Budget and Financial Control Act, Section 41-4-80 et
128	128	seq., Code of Alabama 1975, the provisions of the Budget
129	129	Management Act of 1976, Section 41-19-1 et seq., Code of
130	130	Alabama 1975, and any other provisions of this act.
131	131	Section 4. (a) Prior to the release of any funds
132	132	appropriated under this act the following reports shall be
133	133	submitted:
134	134	(1) An operations plan for the 2026 fiscal year,
135	135	including goals and measurable performance indicators, shall
136	136	be submitted to and approved by the Director of Finance, as
137	137	provided for state agencies in Section 41-19-10 of the Code of
138	138	Alabama 1975.
139	139	(2) An audited financial statement for all operations
140	140	during the 2024 fiscal year.
141	141	(b) It is the intent that funds appropriated for the
142	142	2026 fiscal year shall be released by the Director of Finance
143	143	following receipt of the above reports.
144	144	(c) In addition, quarterly reports shall be made to the
145	145	Director of Finance relating actual expenditures and
146	146	accomplishments to planned expenditures and accomplishments.
147	147	An end of year performance report for the 2026 fiscal year
148	148	shall be made to the Director of Finance stating the work
149	149	accomplished and the services provided and the costs of
150	150	accomplishing the work and providing the services, citing
151	151	meaningful measures of program effectiveness and costs, as is
152	152	required for state agencies in Section 41-19-11 of the Code of

183	183	Alabama 1975.
184	184	(d) The Director of Finance shall forward a copy of all
185	185	required reports to the Legislative Council in a timely
186	186	manner.
187	187	Section 5. This act shall become effective October 1, 2025.
