1717 SYNOPSIS:
1818 Under existing federal law, an employer must
1919 provide a location and reasonable break time for an
2020 employee to express breast milk for a period of two
2121 years beginning on the date the circumstance relating
2222 to the need to express breast milk arises.
2323 This bill would create a state law requiring an
2424 employer to provide a location and reasonable break
2525 time for an employee to express breast milk.

2929 Relating to employment; to require an employer to
3030 provide a location and reasonable break time for an employee
3131 to express breast milk.
3232 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3333 Section 1. This bill shall be known and cited as the
3434 Nursing Mother's Act.
3535 Section 2. (a) As used in this section, "employer"
3636 means an individual or entity that employs one or more
3737 employees, including all departments, agencies, authorities,
3838 and any other office of this state and its political

6969 subdivisions.
7070 (b)(1) An employer shall provide an employee with
7171 reasonable unpaid break time or shall permit an employee to
7272 use paid break time or meal time each day to express breast
7373 milk.
7474 (2) The break time, if possible, shall run concurrently
7575 with any break time already provided to the employee.
7676 (3) This section does not require an employer to
7777 provide break time if doing so would create an undue hardship
7878 on the operations of the employer.
7979 (4) The employee shall make reasonable efforts to
8080 minimize disruption to the employer's operations.
8181 (c)(1) The employer shall make reasonable efforts to
8282 provide a room or other location, other than a bathroom, in
8383 close proximity to the work area, where an employee may
8484 express breast milk in privacy.
8585 (2) Nothing in this section shall be construed to
8686 require an employer to build a room for the primary purpose of
8787 expressing breast milk.
8888 (d) An employer may not discriminate against an
8989 employee for choosing to express breast milk in the workplace
9090 in compliance with this section.
9191 (e) The employer shall be held harmless if it makes
9292 reasonable efforts to comply with this subsection.
9393 Section 3. This act shall become effective on October
9494 1, 2025.
