17	17	SYNOPSIS:
18	18	Under existing federal law, an employer must
19	19	provide a location and reasonable break time for an
20	20	employee to express breast milk for a period of two
21	21	years beginning on the date the circumstance relating
22	22	to the need to express breast milk arises.
23	23	This bill would create a state law requiring an
24	24	employer to provide a location and reasonable break
25	25	time for an employee to express breast milk.

28	28	AN ACT
29	29	Relating to employment; to require an employer to
30	30	provide a location and reasonable break time for an employee
31	31	to express breast milk.
32	32	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
33	33	Section 1. This bill shall be known and cited as the
34	34	Nursing Mother's Act.
35	35	Section 2. (a) As used in this section, "employer"
36	36	means an individual or entity that employs one or more
37	37	employees, including all departments, agencies, authorities,
38	38	and any other office of this state and its political

69	69	subdivisions.
70	70	(b)(1) An employer shall provide an employee with
71	71	reasonable unpaid break time or shall permit an employee to
72	72	use paid break time or meal time each day to express breast
73	73	milk.
74	74	(2) The break time, if possible, shall run concurrently
75	75	with any break time already provided to the employee.
76	76	(3) This section does not require an employer to
77	77	provide break time if doing so would create an undue hardship
78	78	on the operations of the employer.
79	79	(4) The employee shall make reasonable efforts to
80	80	minimize disruption to the employer's operations.
81	81	(c)(1) The employer shall make reasonable efforts to
82	82	provide a room or other location, other than a bathroom, in
83	83	close proximity to the work area, where an employee may
84	84	express breast milk in privacy.
85	85	(2) Nothing in this section shall be construed to
86	86	require an employer to build a room for the primary purpose of
87	87	expressing breast milk.
88	88	(d) An employer may not discriminate against an
89	89	employee for choosing to express breast milk in the workplace
90	90	in compliance with this section.
91	91	(e) The employer shall be held harmless if it makes
92	92	reasonable efforts to comply with this subsection.
93	93	Section 3. This act shall become effective on October
94	94	1, 2025.
