23 | 23 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
24 | 24 | | Section 1. Section 45-8-60.01, Code of Alabama 1975, is |
---|
25 | 25 | | amended to read as follows: |
---|
26 | 26 | | "ยง45-8-60.01 |
---|
27 | 27 | | (a) This section shall apply only to Calhoun County. |
---|
28 | 28 | | (b)(1)(a)(1) After May 6, 2009May 31, 2025, the coroner |
---|
29 | 29 | | shall continue to receive the salary and expense allowances |
---|
30 | 30 | | the coroner is receiving on May 6, 2009May 31, 2025, subject |
---|
31 | 31 | | to any adjustments as further provided herein. |
---|
32 | 32 | | (2) Commencing June 1, 20092025, the coroner shall |
---|
33 | 33 | | receive an expense allowance in the amount of five thousand |
---|
34 | 34 | | dollars ($5,000) twenty thousand dollars ($20,000) per annum |
---|
35 | 35 | | payable in equal bi-weekly installments as provided in |
---|
36 | 36 | | subsection (d)(c). |

68 | 68 | | coronerCommencing January 18, 2027 , the base annual salary for |
---|
69 | 69 | | the coroner shall be increased by five thousand dollars |
---|
70 | 70 | | ($5,000) fifty-four thousand seven hundred fifty dollars |
---|
71 | 71 | | ($54,750) per annum, and the all other expense allowance |
---|
72 | 72 | | provided for in subdivision (2) allowances or other forms of |
---|
73 | 73 | | compensation shall become void. |

74 | 74 | | (c)(b)Commencing on May 6, 2009, there shall be no |
---|
75 | 75 | | more than The coroner may employ up to two compensated |
---|
76 | 76 | | assistant coroners. The compensation of a compensated |
---|
77 | 77 | | assistant coroner shall be in the form of a salary of four |
---|
78 | 78 | | thousand eight hundred dollars ($4,800) six thousand one |
---|
79 | 79 | | hundred dollars ($6,100) annually. |

80 | 80 | | (d)(c) Any salary or expense allowances provided |
---|
81 | 81 | | pursuant to this section shall be paid bi-weekly out of the |
---|
82 | 82 | | general fund of the county at the same time as county |
---|
83 | 83 | | employees are paid. |
---|
84 | 84 | | (e)(d) The county commission may, in addition to the |
---|
85 | 85 | | expense allowances already provided by law, may provide |
---|
86 | 86 | | additional funds to pay the necessary expenses to provide for |
---|
87 | 87 | | the operation of the office of the coroner. |
---|
88 | 88 | | (f)(1)a.(e)(1)a. Except as otherwise provided in |
---|
89 | 89 | | paragraph b., commencing on June 1, 2009, the coroner shall |
---|
90 | 90 | | receive the same uniform increases in compensation, including |
---|
91 | 91 | | cost-of-living increases, longevity increases, merit raises, |
---|
92 | 92 | | and bonuses that are granted to county employees by the county |
---|
93 | 93 | | commission at the time of the approval of the county budget. |
---|
94 | 94 | | The increases shall be in the same amount or percentage, as |
---|
95 | 95 | | the case may be, as that amount or percentage increase |

127 | 127 | | b. Notwithstanding any provision of this section to the |
---|
128 | 128 | | contrary, longevity increases for the incumbent coroner shall |
---|
129 | 129 | | be due and payable commencing January 6, 2010. |
---|
130 | 130 | | c. If the implementation of any cost-of-living |
---|
131 | 131 | | adjustment increases the salary of an incumbent coroner, the |
---|
132 | 132 | | increase shall be paid as provided in subdivision (3). The |
---|
133 | 133 | | base compensation for the purpose of implementing this |
---|
134 | 134 | | subsection shall be that compensation established on June 1, |
---|
135 | 135 | | 2009, and shall remain that amount unless increased as |
---|
136 | 136 | | provided by general or local law applicable to the coroner. |
---|
137 | 137 | | d. Longevity increases of the coroner shall be based on |
---|
138 | 138 | | the average of longevity increases of all county employees as |
---|
139 | 139 | | shown on county pay scales, as determined by the county |
---|
140 | 140 | | commission. Longevity increases for the coroner shall be based |
---|
141 | 141 | | on the coroner's most recent period of continuous, |
---|
142 | 142 | | uninterrupted service as the coroner. The coroner shall be |
---|
143 | 143 | | entitled to receive longevity increases for up to the same |
---|
144 | 144 | | number of years as a county employee is entitled to receive |
---|
145 | 145 | | increases. Past service as a county employee shall not be |
---|
146 | 146 | | counted in determining the number of years a coroner may |
---|
147 | 147 | | receive longevity increases. Compensation increases provided |
---|
148 | 148 | | for in this section shall be calculated based on the |
---|
149 | 149 | | compensation of the coroner being received at the time the |
---|
150 | 150 | | increases become effective for county employees. The inclusion |
---|
151 | 151 | | of funds in the county budget, at the time of its approval, to |
---|
152 | 152 | | cover the costs for compensation increases, as provided in |
---|
153 | 153 | | this section, shall be considered the granting of an increase |

186 | 186 | | e. Notwithstanding any provision of this section to the |

187 | 187 | | contrary, the starting salary of any successor coroner shall |
---|
188 | 188 | | be the salary of his or her predecessor, including all |
---|
189 | 189 | | cost-of-living increases of his or her predecessor in office, |
---|
190 | 190 | | but not including longevity increases, merit raises, or |
---|
191 | 191 | | bonuses received by any of his or her predecessors in office. |
---|
192 | 192 | | (2) Notwithstanding any provision of this section to |
---|
193 | 193 | | the contrary, the expense allowances provided for in |
---|
194 | 194 | | subsection (b) of Section 45-8-11.03 shall not be increased or |
---|
195 | 195 | | become part of the salary of the coroner. |
---|
196 | 196 | | (3)(2) Unless otherwise authorized by the law, |
---|
197 | 197 | | compensation increases provided for in this section to an |
---|
198 | 198 | | incumbent coroner shall be paid as an expense allowance until |
---|
199 | 199 | | the beginning of the next term of office whereupon the expense |
---|
200 | 200 | | allowance shall be included in the base salary for the |
---|
201 | 201 | | coroner, and the expense allowance shall be void. |
---|
202 | 202 | | (g)(f) The coroner may accept reimbursement from |
---|
203 | 203 | | funeral establishments for the reasonable and necessary cost |
---|
204 | 204 | | to the office of the coroner for removing and transporting the |
---|
205 | 205 | | body of a decedent to a funeral establishment and |
---|
206 | 206 | | reimbursement for the reasonable and necessary cost of |
---|
207 | 207 | | providing copies of reports and other documentation. Before |
---|
208 | 208 | | the tenth of each month all amounts reimbursed to the office |
---|
209 | 209 | | of the coroner during the preceding month shall be disbursed |
---|
210 | 210 | | by the coroner to the county commission and deposited in a |
---|
211 | 211 | | separate account for use by the coroner to pay operating |
---|
