1717 AN ACT
1818 Relating to Calhoun County; to amend Section
1919 45-8-60.01, Code of Alabama 1975, to further provide for the
2020 compensation of the coroner; and to repeal Section 45-8-60,
2121 Code of Alabama 1975, relating to the compensation of the
2222 coroner.
2323 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2424 Section 1. Section 45-8-60.01, Code of Alabama 1975, is
2525 amended to read as follows:
2626 "ยง45-8-60.01
2727 (a) This section shall apply only to Calhoun County.
2828 (b)(1)(a)(1) After May 6, 2009May 31, 2025, the coroner
2929 shall continue to receive the salary and expense allowances
3030 the coroner is receiving on May 6, 2009May 31, 2025, subject
3131 to any adjustments as further provided herein.
3232 (2) Commencing June 1, 20092025, the coroner shall
3333 receive an expense allowance in the amount of five thousand
3434 dollars ($5,000) twenty thousand dollars ($20,000) per annum
3535 payable in equal bi-weekly installments as provided in
3636 subsection (d)(c).
3737 (3) At the beginning of the next term of office of the

6767 (3) At the beginning of the next term of office of the
6868 coronerCommencing January 18, 2027 , the base annual salary for
6969 the coroner shall be increased by five thousand dollars
7070 ($5,000) fifty-four thousand seven hundred fifty dollars
7171 ($54,750) per annum, and the all other expense allowance
7272 provided for in subdivision (2) allowances or other forms of
7373 compensation shall become void.
7474 (c)(b)Commencing on May 6, 2009, there shall be no
7575 more than The coroner may employ up to two compensated
7676 assistant coroners. The compensation of a compensated
7777 assistant coroner shall be in the form of a salary of four
7878 thousand eight hundred dollars ($4,800) six thousand one
7979 hundred dollars ($6,100) annually.
8080 (d)(c) Any salary or expense allowances provided
8181 pursuant to this section shall be paid bi-weekly out of the
8282 general fund of the county at the same time as county
8383 employees are paid.
8484 (e)(d) The county commission may, in addition to the
8585 expense allowances already provided by law, may provide
8686 additional funds to pay the necessary expenses to provide for
8787 the operation of the office of the coroner.
8888 (f)(1)a.(e)(1)a. Except as otherwise provided in
8989 paragraph b., commencing on June 1, 2009, the coroner shall
9090 receive the same uniform increases in compensation, including
9191 cost-of-living increases, longevity increases, merit raises,
9292 and bonuses that are granted to county employees by the county
9393 commission at the time of the approval of the county budget.
9494 The increases shall be in the same amount or percentage, as
9595 the case may be, as that amount or percentage increase

125125 the case may be, as that amount or percentage increase
126126 provided to the employees of the county.
127127 b. Notwithstanding any provision of this section to the
128128 contrary, longevity increases for the incumbent coroner shall
129129 be due and payable commencing January 6, 2010.
130130 c. If the implementation of any cost-of-living
131131 adjustment increases the salary of an incumbent coroner, the
132132 increase shall be paid as provided in subdivision (3). The
133133 base compensation for the purpose of implementing this
134134 subsection shall be that compensation established on June 1,
135135 2009, and shall remain that amount unless increased as
136136 provided by general or local law applicable to the coroner.
137137 d. Longevity increases of the coroner shall be based on
138138 the average of longevity increases of all county employees as
139139 shown on county pay scales, as determined by the county
140140 commission. Longevity increases for the coroner shall be based
141141 on the coroner's most recent period of continuous,
142142 uninterrupted service as the coroner. The coroner shall be
143143 entitled to receive longevity increases for up to the same
144144 number of years as a county employee is entitled to receive
145145 increases. Past service as a county employee shall not be
146146 counted in determining the number of years a coroner may
147147 receive longevity increases. Compensation increases provided
148148 for in this section shall be calculated based on the
149149 compensation of the coroner being received at the time the
150150 increases become effective for county employees. The inclusion
151151 of funds in the county budget, at the time of its approval, to
152152 cover the costs for compensation increases, as provided in
153153 this section, shall be considered the granting of an increase

183183 this section, shall be considered the granting of an increase
184184 for whatever type of compensation increases funds are included
185185 in the county budget when it is approved.
186186 e. Notwithstanding any provision of this section to the
187187 contrary, the starting salary of any successor coroner shall
188188 be the salary of his or her predecessor, including all
189189 cost-of-living increases of his or her predecessor in office,
190190 but not including longevity increases, merit raises, or
191191 bonuses received by any of his or her predecessors in office.
192192 (2) Notwithstanding any provision of this section to
193193 the contrary, the expense allowances provided for in
194194 subsection (b) of Section 45-8-11.03 shall not be increased or
195195 become part of the salary of the coroner.
196196 (3)(2) Unless otherwise authorized by the law,
197197 compensation increases provided for in this section to an
198198 incumbent coroner shall be paid as an expense allowance until
199199 the beginning of the next term of office whereupon the expense
200200 allowance shall be included in the base salary for the
201201 coroner, and the expense allowance shall be void.
202202 (g)(f) The coroner may accept reimbursement from
203203 funeral establishments for the reasonable and necessary cost
204204 to the office of the coroner for removing and transporting the
205205 body of a decedent to a funeral establishment and
206206 reimbursement for the reasonable and necessary cost of
207207 providing copies of reports and other documentation. Before
208208 the tenth of each month all amounts reimbursed to the office
209209 of the coroner during the preceding month shall be disbursed
210210 by the coroner to the county commission and deposited in a
211211 separate account for use by the coroner to pay operating

241241 separate account for use by the coroner to pay operating
242242 expenses of the coroner's office, to furnish supplies and
243243 equipment necessary for the performance of the official duties
244244 of the office, and to pay training expenses, including
245245 expenses for travel to obtain training for the coroner,
246246 assistant coroners, and other personnel of the coroner's
247247 office."
248248 Section 2. Section 45-8-60, Code of Alabama 1975,
249249 relating to the compensation of the coroner in Calhoun County,
250250 is repealed.
251251 Section 3. This act shall become effective on June 1,
252252 2025.
