19+SYNOPSIS:
20+This bill would provide for the recognition of
21+firearm hold agreements between a federal firearm
22+licensee or a municipal or county law enforcement
23+officer and an individual firearm owner where the
24+licensee or law enforcement officer agrees to hold a
25+lawfully possessed firearm for a specified period of
26+time.
27+This bill would also provide civil immunity for
28+a federal firearm licensee or municipal or county law
29+enforcement officer who enters into a lawful firearm
30+hold agreement.

2638 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2739 Section 1. (a) This section shall be known as and may
2840 be cited as the Houston/Hunter Act.
29-(b) For the purposes of this act, the following terms
30-have the following meanings:
31-(1) FEDERAL FIREARMS LICENSEE. Any person who is
32-licensed pursuant to 18 U.S.C. Chapter 44.
33-(2) FIREARM. Has the same meaning as provided in 18
34-U.S.C. § 921.
35-(3) FIREARM HOLD AGREEMENT. A private transaction
36-between a federal firearm licensee and an individual firearm
37-owner where the licensee agrees to: (i) take physical
38-possession of the owner's lawfully possessed firearm at the
39-owner's request; (ii) hold the firearm for an agreed period of
40-time; and (iii) return the firearm to the owner.
41-(c) No individual shall have a private cause of action

71-(c) No individual shall have a private cause of action
72-against a federal firearm licensee operating lawfully in this
73-state for returning a firearm to the firearm owner at the
74-termination of a firearm hold agreement.

84+(c) No individual shall have a cause of action against
85+a federal firearm licensee or municipal or county law
86+enforcement officer operating lawfully in this state for any
87+act or omission arising from a firearm hold agreement which
88+results in personal injury or death of any individual,
89+including the return of any firearm to the individual firearm
90+owner at the termination of a firearm hold agreement.
7591 (d) The immunity from civil liability provided in
7692 subsection (c) shall not apply to any action arising from a
7793 firearm hold agreement if that action is the result of
78-unlawful conduct on the part of the federal firearm licensee.
94+unlawful conduct on the part of the federal firearm licensee
95+or municipal or county law enforcement officer.
7996 (e) This section shall not apply to firearm transfers
8097 made in violation of Title 13A or Chapter 27 of Title 41, Code
8198 of Alabama 1975.
82-Section 2. This act shall become effective on June 1,
83-2025.
