---|
18 | 18 | | Under existing law, a person may be issued a |

19 | 19 | | permit to carry certain firearms. |

20 | 20 | | This bill would require a person to have a |

21 | 21 | | permit to legally carry an assault weapon in a vehicle |
---|
22 | 22 | | or on his or her person. |

23 | 23 | | This bill would require a person to have a |

24 | 24 | | permit to purchase or otherwise acquire an assault |
---|
25 | 25 | | weapon. |

26 | 26 | | This bill would provide exceptions for certain |

27 | 27 | | entities and circumstances from these requirements. |

68 | 68 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |

69 | 69 | | Section 1. (a) For the purposes of this section, the |
---|
70 | 70 | | following terms have the following meanings: |
---|
71 | 71 | | (1) ANTIQUE FIREARM. A firearm or replica of a firearm |
---|
72 | 72 | | not designed or redesigned for using rim fire or conventional |
---|
73 | 73 | | center fire ignition with fixed ammunition and manufactured in |
---|
74 | 74 | | or before 1898, including any matchlock, flintlock, percussion |
---|
75 | 75 | | cap, or similar type of ignition system. The term includes any |
---|
76 | 76 | | firearm using fixed ammunition manufactured in or before 1898, |
---|
77 | 77 | | for which ammunition is no longer manufactured in the United |
---|
78 | 78 | | States and is not readily available in the ordinary channels |
---|
79 | 79 | | of commercial trade. |
---|
80 | 80 | | (2) ASSAULT WEAPON. a. A weapon that is: |
---|
81 | 81 | | 1. A semiautomatic rifle that has the capacity to |
---|
82 | 82 | | accept a detachable magazine and has one or more of the |
---|
83 | 83 | | following: |
---|
84 | 84 | | (i) A pistol grip that protrudes conspicuously beneath |
---|
85 | 85 | | the action of the weapon. |
---|
86 | 86 | | (ii) A thumbhole stock. |
---|
87 | 87 | | (iii) A folding or telescoping stock. |
---|
88 | 88 | | (iv) A second handgrip or a protruding grip that can be |
---|
89 | 89 | | held by the nontrigger hand. |
---|
90 | 90 | | (v) A flash suppressor, muzzle break, muzzle |
---|
91 | 91 | | compensator, or threaded barrel designed to accommodate a |
---|
92 | 92 | | flash suppressor, muzzle break, or muzzle compensator. |
---|
93 | 93 | | (vi) A grenade launcher or flare launcher. |
---|
94 | 94 | | 2. A semiautomatic pistol that has the capacity to |
---|
95 | 95 | | accept a detachable magazine and has one or more of the |
---|

131 | 131 | | (iii) A shroud attached to the barrel, or that |

132 | 132 | | partially or completely encircles the barrel, allowing the |
---|
133 | 133 | | bearer to hold the firearm with the nontrigger hand without |
---|
134 | 134 | | being burned, but excluding a slide that encloses the barrel. |
---|
135 | 135 | | (iv) The capacity to accept a detachable magazine at |
---|
136 | 136 | | any location outside of the pistol grip. |
---|
137 | 137 | | 3. A semiautomatic pistol or a semiautomatic centerfire |
---|
138 | 138 | | or rimfire rifle with a fixed magazine that has the capacity |
---|
139 | 139 | | to accept more than 10 rounds of ammunition. |
---|
140 | 140 | | 4. A semiautomatic centerfire or rimfire rifle that has |
---|
141 | 141 | | an overall length of less than 30 inches. |
---|
142 | 142 | | 5. A semiautomatic shotgun that has all of the |
---|
143 | 143 | | following: |
---|
144 | 144 | | (i) A pistol grip that protrudes conspicuously beneath |
---|
145 | 145 | | the action of the weapon, thumbhole stock, or vertical |
---|
146 | 146 | | handgrip. |
---|
147 | 147 | | (ii) A folding or telescoping stock. |
---|
148 | 148 | | (iii) The ability to accept a detachable magazine. |
---|
149 | 149 | | 6. A shotgun with a revolving cylinder. |
---|
150 | 150 | | 7. A conversion kit, part, or combination of parts from |
---|
151 | 151 | | which a weapon described in this paragraph may be assembled if |
---|
152 | 152 | | those parts are in the possession or under the control of the |
---|
153 | 153 | | same person. |
---|
154 | 154 | | b. The term does not include an antique firearm, any |

193 | 193 | | (4) FIREARM. Has the same meaning as provided in |

194 | 194 | | Section 13A-8-1, Code of Alabama 1975. |

195 | 195 | | (5) MAGAZINE. Any ammunition feeding device. |
---|
196 | 196 | | (6) PISTOL. Has the same meaning as provided in Section |
---|
197 | 197 | | 13A-11-70, Code of Alabama 1975. |
---|
198 | 198 | | (7) RIFLE. Has the same meaning as provided in Section |
---|
199 | 199 | | 13A-11-62, Code of Alabama 1975. |
---|
200 | 200 | | (8) SHOTGUN. Has the same meaning as provided in |

201 | 201 | | Section 13A-11-62, Code of Alabama 1975. |
---|
202 | 202 | | (b)(1) No person shall knowingly carry an assault |
---|
203 | 203 | | weapon in a vehicle or on his or her person unless he or she |
---|
204 | 204 | | possesses a valid assault weapon permit issued in accordance |
---|
205 | 205 | | with this section. |

206 | 206 | | (2) No person shall purchase or otherwise acquire an |

207 | 207 | | assault weapon unless he or she possesses a valid assault |
---|
208 | 208 | | weapon permit issued in accordance with this section |

209 | 209 | | (c) A person who acquires an assault weapon by means of |

210 | 210 | | bequest or intestate succession shall have a grace period of |

211 | 211 | | 90 days from the date of acquisition to apply for an assault |

212 | 212 | | weapon permit. |

246 | 246 | | issued or renewed at the discretion of the sheriff according |
---|
247 | 247 | | to the procedures for issuing and renewing a concealed carry |
---|
248 | 248 | | permit as provided in Section 13A-11-75, Code of Alabama 1975. |
---|
249 | 249 | | The fee for an assault weapon permit, and the distribution of |
---|
250 | 250 | | funds collected therefrom, shall be as provided for a |
---|
251 | 251 | | concealed carry permit in Section 13A-11-75, Code of Alabama |
---|
252 | 252 | | 1975. |
---|
253 | 253 | | (e) A violation of subsection (b) is a Class C felony. |
---|
254 | 254 | | (f) This section shall not apply to any of the |
---|
255 | 255 | | following: |
---|
256 | 256 | | (1) A federal, state, or local law enforcement officer |
---|
257 | 257 | | or member of the military or naval forces of this state or of |
---|
258 | 258 | | the United States while acting in an official capacity. |
---|
259 | 259 | | (2) A person who possesses a federal firearm license |
---|
260 | 260 | | pursuant to 18 U.S.C ยง 923. |
---|
261 | 261 | | (3) A person that is on land under his or her control, |
---|
262 | 262 | | in his or her place of residence, or in his or her fixed place |
---|
263 | 263 | | of business. |
---|
264 | 264 | | Section 2. This act shall become effective on October |
---|
