1717 SYNOPSIS:
1818 Under existing law, a person may be issued a
1919 permit to carry certain firearms.
2020 This bill would require a person to have a
2121 permit to legally carry an assault weapon in a vehicle
2222 or on his or her person.
2323 This bill would require a person to have a
2424 permit to purchase or otherwise acquire an assault
2525 weapon.
2626 This bill would provide exceptions for certain
2727 entities and circumstances from these requirements.
2828 This bill would also provide a criminal penalty
2929 for a violation.

3333 Relating to firearms; to require a permit to carry an
3434 assault weapon in a vehicle or on one's person; to require a
3535 permit to purchase or acquire an assault weapon; to provide
3636 certain exceptions; and to provide criminal penalties for
3737 violations.

6868 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6969 Section 1. (a) For the purposes of this section, the
7070 following terms have the following meanings:
7171 (1) ANTIQUE FIREARM. A firearm or replica of a firearm
7272 not designed or redesigned for using rim fire or conventional
7373 center fire ignition with fixed ammunition and manufactured in
7474 or before 1898, including any matchlock, flintlock, percussion
7575 cap, or similar type of ignition system. The term includes any
7676 firearm using fixed ammunition manufactured in or before 1898,
7777 for which ammunition is no longer manufactured in the United
7878 States and is not readily available in the ordinary channels
7979 of commercial trade.
8080 (2) ASSAULT WEAPON. a. A weapon that is:
8181 1. A semiautomatic rifle that has the capacity to
8282 accept a detachable magazine and has one or more of the
8383 following:
8484 (i) A pistol grip that protrudes conspicuously beneath
8585 the action of the weapon.
8686 (ii) A thumbhole stock.
8787 (iii) A folding or telescoping stock.
8888 (iv) A second handgrip or a protruding grip that can be
8989 held by the nontrigger hand.
9090 (v) A flash suppressor, muzzle break, muzzle
9191 compensator, or threaded barrel designed to accommodate a
9292 flash suppressor, muzzle break, or muzzle compensator.
9393 (vi) A grenade launcher or flare launcher.
9494 2. A semiautomatic pistol that has the capacity to
9595 accept a detachable magazine and has one or more of the
9696 following:

127127 (i) Any feature capable of functioning as a protruding
128128 grip that can be held by the nontrigger hand.
129129 (ii) A threaded barrel capable of accepting a flash
130130 suppressor, forward handgrip, or silencer.
131131 (iii) A shroud attached to the barrel, or that
132132 partially or completely encircles the barrel, allowing the
133133 bearer to hold the firearm with the nontrigger hand without
134134 being burned, but excluding a slide that encloses the barrel.
135135 (iv) The capacity to accept a detachable magazine at
136136 any location outside of the pistol grip.
137137 3. A semiautomatic pistol or a semiautomatic centerfire
138138 or rimfire rifle with a fixed magazine that has the capacity
139139 to accept more than 10 rounds of ammunition.
140140 4. A semiautomatic centerfire or rimfire rifle that has
141141 an overall length of less than 30 inches.
142142 5. A semiautomatic shotgun that has all of the
143143 following:
144144 (i) A pistol grip that protrudes conspicuously beneath
145145 the action of the weapon, thumbhole stock, or vertical
146146 handgrip.
147147 (ii) A folding or telescoping stock.
148148 (iii) The ability to accept a detachable magazine.
149149 6. A shotgun with a revolving cylinder.
150150 7. A conversion kit, part, or combination of parts from
151151 which a weapon described in this paragraph may be assembled if
152152 those parts are in the possession or under the control of the
153153 same person.
154154 b. The term does not include an antique firearm, any

184184 b. The term does not include an antique firearm, any
185185 firearm that has been made permanently inoperable, or any
186186 firearm that is manually operated by bolt, pump, lever, or
187187 slide action.
188188 (3) CAPACITY TO ACCEPT MORE THAN 10 ROUNDS. Capable of
189189 accommodating more than 10 rounds of ammunition. The term does
190190 not include a feeding device that has been permanently altered
191191 so that it cannot accommodate more than 10 rounds of
192192 ammunition.
193193 (4) FIREARM. Has the same meaning as provided in
194194 Section 13A-8-1, Code of Alabama 1975.
195195 (5) MAGAZINE. Any ammunition feeding device.
196196 (6) PISTOL. Has the same meaning as provided in Section
197197 13A-11-70, Code of Alabama 1975.
198198 (7) RIFLE. Has the same meaning as provided in Section
199199 13A-11-62, Code of Alabama 1975.
200200 (8) SHOTGUN. Has the same meaning as provided in
201201 Section 13A-11-62, Code of Alabama 1975.
202202 (b)(1) No person shall knowingly carry an assault
203203 weapon in a vehicle or on his or her person unless he or she
204204 possesses a valid assault weapon permit issued in accordance
205205 with this section.
206206 (2) No person shall purchase or otherwise acquire an
207207 assault weapon unless he or she possesses a valid assault
208208 weapon permit issued in accordance with this section
209209 (c) A person who acquires an assault weapon by means of
210210 bequest or intestate succession shall have a grace period of
211211 90 days from the date of acquisition to apply for an assault
212212 weapon permit.

243243 (d) A person may apply to the sheriff of the county in
244244 which he or she resides for the issuance or renewal of an
245245 assault weapon permit. An assault weapon permit shall be
246246 issued or renewed at the discretion of the sheriff according
247247 to the procedures for issuing and renewing a concealed carry
248248 permit as provided in Section 13A-11-75, Code of Alabama 1975.
249249 The fee for an assault weapon permit, and the distribution of
250250 funds collected therefrom, shall be as provided for a
251251 concealed carry permit in Section 13A-11-75, Code of Alabama
252252 1975.
253253 (e) A violation of subsection (b) is a Class C felony.
254254 (f) This section shall not apply to any of the
255255 following:
256256 (1) A federal, state, or local law enforcement officer
257257 or member of the military or naval forces of this state or of
258258 the United States while acting in an official capacity.
259259 (2) A person who possesses a federal firearm license
260260 pursuant to 18 U.S.C ยง 923.
261261 (3) A person that is on land under his or her control,
262262 in his or her place of residence, or in his or her fixed place
263263 of business.
264264 Section 2. This act shall become effective on October
265265 1, 2025.
