1515 SYNOPSIS:
1616 This bill would prohibit the use of butyl
1717 nitrite or any mixtures containing butyl nitrite,
1818 commonly known as "whippets," except under certain
1919 circumstances.
2020 This bill would prohibit the use of nitrous
2121 oxide, commonly known as "laughing gas," and amyl
2222 nitrite, commonly known as "poppers" or "snappers,"
2323 except under certain circumstances.
2424 This bill would also provide penalties for any
2525 violations of the prohibition.

2828 AN ACT
2929 Relating to crimes and offenses; to prohibit the
3030 possession or use of certain inhalants and other chemical
3131 compounds, including butyl nitrite, nitrous oxide, or amyl
3232 nitrite, except under certain circumstances; and to provide
3333 penalties for any violation.
3434 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3535 Section 1. (a) A person commits the crime of unlawful
3636 possession of inhalants if he or she does any of the

6666 possession of inhalants if he or she does any of the
6767 following:
6868 (1) Inhales, ingests, uses, or possesses any compound,
6969 liquid, gas, or chemical which contains butyl nitrite,
7070 isobutyl nitrite, secondary butyl nitrite, tertiary butyl
7171 nitrite, or any mixtures containing butyl nitrite, isobutyl
7272 nitrite, secondary butyl nitrite, or tertiary butyl nitrite.
7373 (2) Inhales, ingests, uses, or possesses any compound,
7474 liquid, gas, or chemical which contains nitrous oxide,
7575 commonly known as "laughing gas," or any amyl nitrite,
7676 commonly known as "poppers" or "snappers."
7777 (3) Produces, manufactures, buys, sells, or otherwise
7878 transfers any substance specified in subdivisions (1) or (2).
7979 (b) Subsection (a) shall not apply to any of the
8080 following:
8181 (1) The possession and use of the substances lawfully
8282 prescribed as part of the care or treatment of a disease,
8383 condition, or injury by a licensed medical or dental
8484 practitioner by a person at least 21 years of age.
8585 (2) The possession and use of the substances by a
8686 manufacturer as part of a manufacturing process or industrial
8787 operation by a person at least 21 years of age.
8888 (3) The possession, use, or sale of nitrous oxide as a
8989 propellant in food preparation for restaurant, food service,
9090 or houseware products by a person at least 21 years of age.
9191 (4) The possession, use, or sale of nitrous oxide for
9292 automotive purposes by a person at least 21 years of age.
9393 (c) The presence of additional flavoring in a substance
9494 or labeling on any part of a container of a substance

124124 or labeling on any part of a container of a substance
125125 referring to the substance being flavored shall create a
126126 rebuttable presumption against the exceptions listed in
127127 subsection (b).
128128 (d) Unlawful possession of inhalants is a Class A
129129 misdemeanor.
130130 Section 2. This act shall become effective on October
131131 1, 2025.
