---|
74 | 74 | | (b) The board shall pay all of its expenses from its |
---|
75 | 75 | | own funds, and no expenses shall be borne by the State of |
---|
76 | 76 | | Alabama from the State General Fund. |
---|
77 | 77 | | (c) The board shall consist of seven members appointed |
---|
78 | 78 | | by the Governor and , subject to confirmation by the Senate, |
---|
79 | 79 | | from a list of qualified individuals nominated by the |
---|
80 | 80 | | designated organization. Each list shall contain the names of |
---|
81 | 81 | | at least two individuals for each position to be filled. |
---|
82 | 82 | | (d) The members of the board shall be appointed for |
---|
83 | 83 | | staggered initial terms and subsequent terms shall be for a |
---|
84 | 84 | | minimum of four years or until his or her successor has been |
---|
85 | 85 | | appointed and qualified. |
---|
86 | 86 | | (e) The board shall meet at least twice each year, |
---|
87 | 87 | | conducting its business in person or by electronic methods. |
---|
88 | 88 | | (f) The board shall elect one of its members to serve |
---|
89 | 89 | | as chair for a two-year term. The chair may not serve |
---|
90 | 90 | | consecutive terms. |
---|
91 | 91 | | (g) The composition of the board shall be as follows: |
---|
92 | 92 | | (1) Four members shall hold a valid certified |
---|
93 | 93 | | professional midwife credential from the North American |
---|
94 | 94 | | Registry of Midwives. These members shall be appointed from a |
---|
95 | 95 | | list of names submitted by the Alabama Birth CoalitionMidwives |

96 | 96 | | Alliance or its successor professional midwifery organization. |
---|
97 | 97 | | One of these members shall be appointed to an initial term of |
---|
98 | 98 | | four years, one to a term of three years, and two to a term of |
---|

137 | 137 | | (4) One member shall have used midwifery services in |

138 | 138 | | the state. This member shall be appointed from a list of names |
---|
139 | 139 | | submitted by the Alabama Birth Coalition. This member shall be |
---|
140 | 140 | | appointed to an initial term of three years. |
---|
141 | 141 | | (h) When choosing individuals to be considered by the |
---|
142 | 142 | | Governor for appointment to the board, the nominating |
---|
143 | 143 | | authorities shall strive to assure membership is inclusive and |
---|
144 | 144 | | reflects the racial, gender, geographic, urban, rural, and |
---|
145 | 145 | | economic diversity of the state. |
---|
146 | 146 | | (i) All members of the board shall be immune from |
---|
147 | 147 | | individual civil liability while acting within the scope of |
---|
148 | 148 | | their duties as board members, unless conduct is unreasonable. |
---|
149 | 149 | | (j) Vacancies shall be filled by the Governor and |
---|
150 | 150 | | confirmed by the Senate in the same manner as other |
---|
151 | 151 | | appointments are made. In the case of a vacancy, the new |
---|
152 | 152 | | appointee shall serve for the remainder of the unexpired term. |
---|
153 | 153 | | (k) Members of the board shall serve without |
---|
154 | 154 | | compensation but shall be allowed travel and per diem expenses |
---|
155 | 155 | | at the same rate paid to state employees, to be paid from the |

---|
200 | 200 | | midwife in the previous year, including births where the |
---|
201 | 201 | | licensed midwife was assisting another licensed midwife. |
---|
202 | 202 | | b. The number of maternal transfers to a health care |
---|
203 | 203 | | facility from births attended by the licensed midwife, |
---|
204 | 204 | | including instances where the licensed midwife was assisting |
---|
205 | 205 | | another licensed midwife. |
---|
206 | 206 | | c. The number of infant transfers to a health care |
---|
207 | 207 | | facility from births attended by the licensed midwife, |
---|
208 | 208 | | including instances where the licensed midwife was assisting |
---|

255 | 255 | | (a) The board shall do all of the following consistent |

257 | 257 | | (1) Approve, renew, suspend, or revoke licenses for the |
---|
258 | 258 | | practice of midwifery. |

259 | 259 | | (2) Investigate and conduct hearings regarding |
---|
260 | 260 | | complaints against a licensed midwife in order to determine if |
---|
261 | 261 | | disciplinary action is warranted. |
---|
262 | 262 | | (3) Establish reasonable licensure fees, including, but |
---|
263 | 263 | | not limited to, initial application, renewal, and |
---|
264 | 264 | | reinstatement fees. |
---|
265 | 265 | | (4) Develop standardized forms , including, but not |
---|
266 | 266 | | limited to, a midwife disclosure form, informed consent form, |
---|
267 | 267 | | emergency care form, and applications for licensure and |
---|
268 | 268 | | renewal. |
---|
269 | 269 | | (5) Impose administrative fines, not to exceed one |
---|
270 | 270 | | thousand dollars ($1,000) per violation, for violating this |
---|

324 | 324 | | (c) A licensed midwife may not administer or perform |

435 | 435 | | (c) A licensed midwife shall ensure that the client has |
---|
436 | 436 | | signed an informed consent form provided by the board. |

437 | 437 | | (d) For screening purposes only, a licensed midwife may |
---|
438 | 438 | | order routine antepartum and postpartum laboratory analyses to |
---|
439 | 439 | | be performed by a licensed laboratory. |
---|
440 | 440 | | (e) After a client has secured the services of a |
---|
441 | 441 | | licensed midwife, the licensed midwife shall document an |
---|
442 | 442 | | emergency care plan on a form provided by the board. |
---|
443 | 443 | | (f) A licensed midwife shall determine the progress of |

444 | 444 | | labor and, when birth is imminent, shall be available until |
---|
445 | 445 | | delivery is accomplished. |
