16	16	Under existing law, the primary in
17	17	off-presidential years is held on the fourth Tuesday in
18	18	May.
19	19	This bill would change the primary in
20	20	off-presidential years from the fourth to the second
21	21	Tuesday in May.

23	23	TO BE ENTITLED
24	24	AN ACT
25	25	Relating to elections; to amend Section 17-13-3, Code
26	26	of Alabama 1975, to change the primary election in
27	27	off-presidential years to the second Tuesday in
28	28	May.
29	29	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
30	30	Section 1. Section 17-13-3, Code of Alabama 1975, is
31	31	amended to read as follows:
32	32	"§17-13-3
33	33	(a) Except as otherwise provided in subsections (b) and
34	34	(d), primary elections held at the expense of the state or
35	35	counties shall be held on the fourthsecond Tuesday in May.
36	36	When necessary, as provided in this chapter, a second or

66	66	When necessary, as provided in this chapter, a second or
67	67	runoff primary election shall be held on the fourth Tuesday
68	68	following the primary election. Any second primary shall be
69	69	held by the same election officers who held the first primary
70	70	election, and be held at the same places as the first primary
71	71	election. No primary election shall be held by any political
72	72	party except as provided in this subsection. Primary elections
73	73	shall be held at the regular polling places established for
74	74	the purpose of holding general elections.
75	75	(b) In years in which a presidential primary is
76	76	conducted, the primary election shall be the first Tuesday in
77	77	March.
78	78	(c) Notwithstanding any other provision of law, in any
79	79	year in which the primary election is held in March and the
80	80	primary election is held in conjunction with the presidential
81	81	preference primary election, as provided in this section and
82	82	Section 17-13-100, any reference in any existing statutes to a
83	83	primary election being held in June or May shall be construed
84	84	to refer to the primary election in March.
85	85	(d) Special primary elections, held at the expense of
86	86	the state or counties, shall be held following the issuance of
87	87	a proclamation by the Governor or as otherwise provided by
88	88	law. When necessary, as provided in this chapter, a second or
89	89	runoff special primary election shall be held on the fourth
90	90	Tuesday following the special primary election. Any second
91	91	special primary election shall be held by the same election
92	92	officers who held the first special primary election , and be
93	93	held at the same places as the first special primary election.
