1515 SYNOPSIS:
1616 Under existing law, the primary in
1717 off-presidential years is held on the fourth Tuesday in

1919 This bill would change the primary in
2020 off-presidential years from the fourth to the second

2525 Relating to elections; to amend Section 17-13-3, Code
2626 of Alabama 1975, to change the primary election in
2727 off-presidential years to the second Tuesday in
2828 May.
2929 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3030 Section 1. Section 17-13-3, Code of Alabama 1975, is
3131 amended to read as follows:
3232 "ยง17-13-3
3333 (a) Except as otherwise provided in subsections (b) and
3434 (d), primary elections held at the expense of the state or
3535 counties shall be held on the fourthsecond Tuesday in May.

6666 When necessary, as provided in this chapter, a second or
6767 runoff primary election shall be held on the fourth Tuesday
6868 following the primary election. Any second primary shall be
6969 held by the same election officers who held the first primary
7070 election, and be held at the same places as the first primary
7171 election. No primary election shall be held by any political
7272 party except as provided in this subsection. Primary elections
7373 shall be held at the regular polling places established for
7474 the purpose of holding general elections.
7575 (b) In years in which a presidential primary is
7676 conducted, the primary election shall be the first Tuesday in
7777 March.
7878 (c) Notwithstanding any other provision of law, in any
7979 year in which the primary election is held in March and the
8080 primary election is held in conjunction with the presidential
8181 preference primary election, as provided in this section and
8282 Section 17-13-100, any reference in any existing statutes to a
8383 primary election being held in June or May shall be construed
8484 to refer to the primary election in March.
8585 (d) Special primary elections, held at the expense of
8686 the state or counties, shall be held following the issuance of
8787 a proclamation by the Governor or as otherwise provided by
8888 law. When necessary, as provided in this chapter, a second or
8989 runoff special primary election shall be held on the fourth
9090 Tuesday following the special primary election. Any second
9191 special primary election shall be held by the same election
9292 officers who held the first special primary election , and be
9393 held at the same places as the first special primary election.
