1919 SYNOPSIS:
2020 Under existing law, persons are prohibited from
2121 possessing certain firearms.
2222 This bill would prohibit persons from possessing
2323 a pistol with a part or combination of parts designed
2424 or intended to covert a pistol into a machine gun
2525 installed on or attached to the pistol.
2626 This bill would also provide criminal penalties
2727 for violations.

3030 AN ACT
3131 Relating to firearms; to prohibit persons from
3232 possessing a pistol that has a part or combination of parts
3333 designed or intended to convert a pistol into a machine gun
3434 installed on or attached to the pistol; and to provide
3535 penalties for violations.
3636 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3737 Section 1. (a) For the purposes of this section, the
3838 term "machine gun" means any weapon which shoots, is designed
3939 to shoot, or can be readily restored to shoot, automatically
4040 more than one shot, without manual reloading, by a single
4141 function of the trigger. The term shall also include the frame

7171 function of the trigger. The term shall also include the frame
7272 or receiver of any such weapon, any part designed and intended
7373 solely and exclusively, or combination of parts designed and
7474 intended, for use in converting a weapon into a machine gun,
7575 and any combination of parts from which a machine gun can be
7676 assembled if such parts are in the possession or under the
7777 control of a person.
7878 (b) No person shall knowingly own or have in his or her
7979 possession, control, care, or custody a pistol that has a part
8080 or combination of parts designed or intended to convert a
8181 pistol into a machine gun installed on or attached to the
8282 pistol.
8383 (c) A violation of this section is a Class C felony.
8484 (d) This section does not apply to any of the
8585 following:
8686 (1) A state or local law enforcement officer while
8787 acting in an official capacity.
8888 (2) A person who owns or has in his or her possession,
8989 control, care, or custody a firearm, part, or combination of
9090 parts that are registered in the National Firearms
9191 Registration and Transfer Record maintained by the Bureau of
9292 Alcohol, Tobacco, Firearms, and Explosives or is otherwise not
9393 subject to that registration requirement.
9494 (3) Any part, combination of parts, or device designed
9595 or intended to increase a pistol's rate of fire but that does
9696 not enable a semiautomatic pistol to fire more than two shots,
9797 without manual reloading, by a single function of the trigger.
9898 Section 2. This act shall become effective on October
9999 1, 2025.
