1515 SYNOPSIS:
1616 Under existing law, the Alabama Job Creation and
1717 Military Stability Commission consists of 13 members,
1818 representing the State Legislature, state law
1919 enforcement, the Alabama National Guard, state
2020 agencies, including the Alabama Department of Veterans
2121 Affairs, retired military personnel, and civic leaders.
2222 This bill would expand the membership of the
2323 Alabama Job Creation and Military Stability Commission
2424 to include the Chairs of the Alabama House Military and
2525 Veterans Affairs Committee and the Alabama Senate
2626 Veterans, Military Affairs, and Public Safety
2727 Committee.

3131 Relating to Military Affairs; to amend Section 31-14-3,
3232 Code of Alabama 1975, to expand the membership of the Alabama
3333 Job Creation and Military Stability Commission to include the

3535 Committee and the Alabama Senate Veterans, Military Affairs,
3636 and Public Safety Committee.

6767 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6868 Section 1. Section 31-14-3, Code of Alabama 1975, is
6969 amended to read as follows:
7070 "ยง31-14-3
7171 (a) The Alabama Job Creation and Military Stability
7272 Commission is created. Members of the commission shall include
7373 a chair and two vice chairs. The chair shall be the Lieutenant
7474 Governor, or in the absence of a Lieutenant Governor, the
7575 chair shall be the Governor, or his or her designee. The vice
7676 chairs shall be the President Pro Tempore of the Senate, or
7777 his or her designee, and the Speaker of the House of
7878 Representatives, or his or her designee.
7979 (b) The commission shall also consist of the following
8080 members:
8181 (1) Two members of the House of Representatives
8282 appointed by the Speaker of the House of Representatives.
8383 (2) Two members of the Senate appointed by the
8484 President Pro Tempore of the Senate.
8585 (3) The Adjutant General of the Alabama National Guard.
8686 (4) The Secretary of the Alabama State Law Enforcement
8787 Agency.
8888 (5) The Secretary of the Department of Commerce.
8989 (6) The Director of the Alabama Department of Economic
9090 and Community Affairs.
9191 (7) The Commissioner of the Alabama Department of
9292 Veterans Affairs.
9393 (8) One senator from the minority caucus appointed by
9494 the Lieutenant Governor.

125125 (9) One representative from the minority caucus
126126 appointed by the Speaker of the House of Representatives.
127127 (10) The chair of the Alabama House Military and
128128 Veterans Affairs Committee.
129129 (11) The chair of the Alabama Senate Veterans, Military
130130 Affairs, and Public Safety Committee.
131131 (10)(12) One retired senior member of the Armed Forces
132132 for each of the five major military facilities in Alabama,
133133 Redstone Arsenal, Anniston Army Depot, Maxwell Air Force Base
134134 including the Gunter Annex, Fort Moore, and Fort Novosel who
135135 shall be appointed by the Governor, after consultation with
136136 the individual designated in subdivision (11)(13) as the civic
137137 leader from the community which the senior member of the
138138 military shall represent.
139139 (11)(13) One civic leader with significant experience
140140 in military relocations from each of the five communities
141141 currently impacted most significantly by the presence of
142142 military facilities and assigned personnel who shall be
143143 appointed by the chair after consultation with the existing
144144 organizations described in subsection (h).
145145 (c) Members of the commission shall serve for a term of
146146 four years with each appointment, may be reappointed for an
147147 unlimited number of terms, and shall serve on the commission
148148 until a replacement is appointed.
149149 (d) The members of the Alabama Job Creation and
150150 Military Stability Commission created by Act 2011-350, as
151151 amended by Act 2013-156, shall be the initial members of the
152152 commission created under this section and shall continue to

182182 commission created under this section and shall continue to
183183 serve on the commission at the pleasure of the appointing
184184 authority until the quadrennium commencing in 2019. Persons
185185 appointed after the commencement of the quadrennium commencing
186186 in 2019 commission shall serve a term of four years.
187187 (e) The commission shall hold its organizational
188188 meeting by August 31, 2017. Thereafter, the commission shall
189189 meet at the call of the chair; provided, that the commission
190190 shall meet at least once annually.
191191 (f) The commission shall adopt rules for its
192192 governance, including, but not limited to, the filling of
193193 vacancies, the election of officers, the creation of
194194 committees, including an executive committee, and the
195195 execution of documents. Members of the commission, the
196196 executive committee of the commission, or any other committee
197197 established by the commission may participate in a meeting of
198198 the commission or committee by means of telephone conference,
199199 video conference, or using similar communications methods by
200200 means of which all individuals participating in the meeting
201201 may hear one another. Participation by such means shall
202202 constitute presence in person at a meeting for all purposes,
203203 including for purposes of establishing a quorum. Notice of
204204 meetings shall be provided in accordance with the Alabama Open
205205 Meetings Act and similar means of communication be allowed to
206206 provide for members of the public to listen and observe
207207 meetings.
208208 (g) The Secretary of the Senate, the Clerk of the House
209209 of Representatives, the Legislative Services Agency, Legal
210210 Division, the Legislative Services Agency, Fiscal Division,

240240 Division, the Legislative Services Agency, Fiscal Division,
241241 and the Examiners of Public Accounts shall provide assistance
242242 as requested by the commission. Each legislative member of the
243243 commission and supporting staff shall be entitled to his or
244244 her regular legislative compensation and his or her per diem
245245 and travel expenses for each day he or she attends a meeting
246246 of the commission which shall be paid out of any funds
247247 appropriated for the use of the Legislature, upon warrants
248248 drawn on the Comptroller upon requisition signed by the
249249 commission's chair. Members shall not receive additional
250250 legislative compensation or per diem when the Legislature is
251251 in session but shall receive his or her travel expenses for
252252 all meetings attended.
253253 (h) The commission shall make proactive attempts to
254254 ensure the stability of Alabama-assigned Department of Defense
255255 resources by the study and evaluation of military
256256 organizations, personnel, civilian support personnel,
257257 equipment, and infrastructure currently located in the state,
258258 and the re-stationing or reorganization of military resources
259259 located in, relocating to, or outside of the state using the
260260 following items of evaluation:
261261 (1) All Department of Defense personnel, assets, and
262262 equipment, including that belonging to the Alabama National
263263 Guard and Reserve units or forces.
264264 (2) The economic impact of these resources on
265265 surrounding communities.
266266 (3) Current policies, programs, and services that
267267 impact Department of Defense resources located in the state.
268268 (4) The impact these Department of Defense assets and

298298 (4) The impact these Department of Defense assets and
299299 resources have on state and local job creation.
300300 (5) The impact of Department of Defense assets and
301301 resources on local businesses and industry.
302302 (6) Funding available or required to promote the
303303 sustained presence of Department of Defense assets and
304304 resources appropriated to the state.
305305 (i) The commission shall not alter the purpose,
306306 replace, or change the role of any existing organization, task
307307 force, or committee within a military community with the
308308 purpose of promoting military growth , including Base Closure
309309 and Realignment Commission associated actions.
310310 (j) The appointing authorities of the commission shall
311311 coordinate their appointments to assure the membership of the
312312 Alabama Job Creation and Military Stability Commission is
313313 inclusive and reflects the racial, gender, geographic, urban,
314314 rural, and economic diversity of the state.
315315 (k) The commission shall make an annual report to
316316 members of the Legislature no later than the seventh
317317 legislative day of each regular session beginning in 2018
318318 detailing all commission activities and recommendations.
319319 (l) The commission may accept gifts, contributions,
320320 bequests, grants, and other donations, whether public or
321321 private, of money, real property, or personal property and
322322 shall expend the same in furtherance of the work of the
323323 commission.
324324 (m) The work of the commission shall be supported by
325325 the Military Stability Foundation, an Alabama nonprofit
326326 corporation incorporated on September 8, 2011, which shall not

356356 corporation incorporated on September 8, 2011, which shall not
357357 be considered a government body. Documents produced by or for
358358 the foundation shall not be considered public writings, even
359359 if viewed by or delivered to the commission, as the disclosure
360360 of the documents would be detrimental to the best interest of
361361 the public."
362362 Section 2. This act shall become effective on October
363363 1, 2025.
