17+SYNOPSIS:
18+Under existing law, sex offenders have
19+restrictions regarding where they may be employed or
20+volunteer.
21+This bill would prohibit sex offenders from
22+being employed or volunteering as a first responder.
23+This bill would also provide for limited
24+liability in certain circumstances.

2028 Relating to sex offenders; to amend Sections 15-20A-13
2129 and 15-20A-31, Code of Alabama 1975, to prohibit sex offenders
22-from being employed or volunteering as a first responder.
30+from being employed or volunteering as a first responder; and
31+to limit liability in certain circumstances.
2332 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2433 Section 1. Sections 15-20A-13 and 15-20A-31, Code of
2534 Alabama 1975, are amended to read as follows:
2635 "§15-20A-13
2736 (a) No adult sex offender shall accept or maintain
2837 employment or a volunteer position at any school, childcare
2938 facility, mobile vending business that provides services
30-primarily to children, or any other business or organization
31-that provides services primarily to children, or any amusement
32-or water park.
33-(b) No adult sex offender shall accept or maintain
34-employment or a volunteer position within 2,000 feet of the
35-property on which a school or childcare facility is located
36-unless otherwise exempted pursuant to Sections 15-20A-24 and
37-15-20A-25.
38-(c) No adult sex offender, after having been convicted
39-of a sex offense involving a child, shall accept or maintain

69+primarily to children, or any other business or organization
70+that provides services primarily to children, or any amusement
71+or water park.
72+(b) No adult sex offender shall accept or maintain
73+employment or a volunteer position within 2,000 feet of the
74+property on which a school or childcare facility is located
75+unless otherwise exempted pursuant to Sections 15-20A-24 and
76+15-20A-25.
77+(c) No adult sex offender, after having been convicted
6978 of a sex offense involving a child, shall accept or maintain
7079 employment or a volunteer position within 500 feet of a
7180 playground, park, athletic field or facility, or any other
7281 business or facility having a principal purpose of caring for,
7382 educating, or entertaining minors.
7483 (d) Changes to property within 2,000 feet of an adult
7584 sex offender's place of employment which occur after an adult
7685 sex offender accepts employment shall not form the basis for
7786 finding that an adult sex offender is in violation of this
7887 section.
7988 (e) It shall be unlawful for the owner or operator of
8089 any childcare facility or any other organization that provides
8190 services primarily to children to knowingly provide employment
8291 or a volunteer position to an adult sex offender.
8392 (f) For the purposes of this section, the 2,000-foot
8493 measurement shall be taken in a straight line from nearest
8594 property line to nearest property line.
8695 (g)(1) No adult sex offender shall accept or maintain
8796 employment or a volunteer position as a first responder.
88-(2) For the purposes of this section, a "first
89-responder" means a paramedic, firefighter, rescue squad
90-member, emergency medical technician, or other individual who,
91-in the course of his or her professional duties, responds to
92-fire, medical, hazardous material, or other similar
93-emergencies, whether compensated or not.
94-(g)(h) Any person who knowingly violates this section
95-shall be guilty of a Class C felony."

133145 (b) It shall be unlawful for the owner or operator of
134146 any childcare facility or any other organization that provides
135147 services primarily to children to knowingly provide employment
136148 or a volunteer position to a juvenile sex offender.
137149 (c)(1) No juvenile sex offender shall accept or
138150 maintain employment or a volunteer position as a first
139151 responder.
140152 (2) For the purposes of this section, a "first
141153 responder" means a paramedic, firefighter, rescue squad
142154 member, emergency medical technician, or other individual who,
143-in the course of his or her professional duties, responds to
144-fire, medical, hazardous material, or other similar
145-emergencies, whether compensated or not.
146-(c)(d) Any person who knowingly violates this section
147-shall be guilty of a Class C felony."
148-Section 2. This act shall become effective on October
