1717 SYNOPSIS:
1818 This bill would prohibit a state or local agency
1919 from entering into an agreement with a media monitoring
2020 organization or a company that uses the services of a
2121 media monitoring organization, or from providing
2222 support to a media monitoring organization.
2323 This bill would require any company attempting
2424 to enter into an agreement with a state or local agency
2525 to certify that the company will refrain from entering
2626 into an agreement with a media monitoring organization
2727 or a company that uses the services of a media
2828 monitoring organization.
2929 This bill would also require a contractor to
3030 certify that the contractor has not entered into an
3131 agreement with a media monitoring organization or a
3232 company that uses the services of a media monitoring
3333 organization before the contractor can modify an
3434 agreement with a state or local agency.

6868 Relating to state and local government; to prevent
6969 certain state and local agencies from entering into agreements
7070 with media monitoring organizations; and to require such
7171 agencies to take certain actions regarding contractors and
7272 companies with relation to media monitoring organizations.
7373 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7474 Section 1. For the purposes of this act, the following
7575 terms have the following meanings:
7676 (1) AGENCY. The state or any political subdivision of
7777 the state; or any department, agency, division, council,
7878 bureau, board, public corporation, educational institution, or
7979 authority of the state or any political subdivision of the
8080 state.
8181 (2) COMPANY. Any sole proprietorship, organization,
8282 association, corporation, partnership, joint venture, limited
8383 partnership, limited liability partnership, limited liability
8484 company, or other entity or business association, including
8585 all wholly owned subsidiaries, majority-owned subsidiaries,
8686 parent companies, or affiliates of any entity or business
8787 association, whether for profit or not for profit.
8888 (3) MEDIA MONITORING ORGANIZATION. a. Any company
8989 created to do either of the following:
9090 1. Rate or rank news or information services for the
9191 factual accuracy of their content, whether published online,
9292 in print, by audio, or digitally, or broadcast via radio,
9393 television, cable, streaming service, or any other way news is
9494 delivered to the public.
9595 2. Provide ratings or rankings of new sources based on
9696 misinformation, bias, adherence to journalistic standards or

126126 misinformation, bias, adherence to journalistic standards or
127127 ethics, including, but not limited to, organizations that
128128 claim to engage in fact-checking or determining overall news
129129 accuracy.
130130 b. The term does not include organizations that rate
131131 media outlets for audience size, viwership, or demographic
132132 information or that monitor media outlets for the purposes of
133133 compiling press or video clippings or aggregating news sources
134134 for the purposes of public relations or public awareness,
135135 unless an organization also engages in the activities
136136 described in subparagraphs a.1. or b.1.
137137 Section 2. (a) An agency shall not do any of the
138138 following:
139139 (1) Enter into any contract or other agreement with any
140140 media monitoring organization.
141141 (2) Enter into any contract or agreement with any
142142 advertising or marketing agency that uses the services of a
143143 media monitoring organization.
144144 (3) Provide support in any form to a media monitoring
145145 organization, other than non discretionary actions otherwise
146146 required by law.
147147 (b) An agency shall require any company that submits a
148148 bid or proposal for a contract for marketing services to
149149 certify that the company is in compliance with subdivisions
150150 (a)(1) and (a)(2).
151151 (c) An agency shall obtain from any contractor a
152152 certification that the contractor is in compliance with
153153 subdivisions (a)(1) and (a)(2) prior to extending, renewing,
154154 or otherwise modifying an agreement or contract for

184184 or otherwise modifying an agreement or contract for
185185 advertising or marketing services with the contractor
186186 effective on October 1, 2025.
187187 (d) Nothing in this act shall prevent an agency from
188188 contracting for services which aggregate news articles or
189189 information relevant to the agency or its constituents.
190190 (e) Nothing in this act shall prevent a company from
191191 providing analytical or statistical information on the
192192 performance of advertisements placed by an agency.
193193 Section 3. This act shall become effective on October
194194 1, 2025.
