18	18	Relating to Marshall County; to amend Section 45-48-161
19	19	of the Code of Alabama 1975, to provide further for the
20	20	distribution of in-lieu-of-taxes payments of the Tennessee
21	21	Valley Authority.
22	22	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
23	23	Section 1. Section 45-48-161 of the Code of Alabama
24	24	1975, is amended to read as follows:
25	25	"§45-48-161
26	26	In each fiscal year, the distribution of the share of
27	27	in-lieu-of-taxes payments of the Tennessee Valley Authority
28	28	for Marshall County shall be as follows:
29	29	(1) Twenty-five percent of the total amount allocated
30	30	to Marshall County shall be distributed to the Marshall County
31	31	Board of Education, the Arab City Board of Education, the
32	32	Guntersville City Board of Education, the Albertville City
33	33	Board of Education, and the Boaz City Board of Education, on a
34	34	per pupil basis based upon the student enrollment of the
35	35	respective schools on the last day of the first monthly
36	36	attendance report of each school year.
37	37	(2)a. Four percent of the remaining 75 percent or two

67	67	(2)a. Four percent of the remaining 75 percent or two
68	68	hundred forty thousand dollars ($240,000), whichever is
69	69	greater, shall be allocated for the operation of the Marshall
70	70	County Legislative Delegation Office.
71	71	b. Any funds not expended for the operation of the
72	72	legislative office may be used for educational purposes or
73	73	industrial or economic development projects in Marshall County
74	74	as approved by unanimous consent of the legislative
75	75	delegation.
76	76	(3) The remaining 71 percent funds shall be allocated
77	77	as provided herein and shall be reviewed by the county
78	78	legislative delegation every four years.
79	79	a.1. Six percent of the remaining 71 percent funds or
80	80	two hundred thirty two thousand dollars ($232,000) two hundred
81	81	forty-seven thousand dollars ($247,000) , whichever is greater,
82	82	shall be allocated to the Marshall County Economic Development
83	83	Office. These moneys monies shall be used to employ a director
84	84	and staff and to carry out the operation of recruiting
85	85	industries and job opportunities for Marshall County and each
86	86	of the municipalities in the county. The director shall be
87	87	employed by the Economic Development Board.
88	88	2. All money previously allocated to the Marshall
89	89	County Economic Development Board which is accumulated and
90	90	held in a designated fund for industrial or economic
91	91	development projects in Marshall County is released for
92	92	further allocation at the direction of the board.
93	93	b. Thirty thousand dollars ($30,000) shall be allocated
94	94	to the Marshall County Commission to help provide for school
95	95	resource officers in the Marshall County school system.

125	125	resource officers in the Marshall County school system.
126	126	c. Fifteen thousand dollars ($15,000) shall be
127	127	allocated to the Marshall County Economic Development Board in
128	128	addition to the allocation in paragraph a.
129	129	d.c. Twenty-five thousand dollars ($25,000) shall be
130	130	allocated to the Mountain Valley Council on the Arts
131	131	commencing on October 1, 2006 .
132	132	e.d. Thirteen thousand dollars ($13,000) shall be
133	133	allocated to the City of Albertville for ambulance use so long
134	134	as the ambulance service is provided by the city; and
135	135	twenty-seven thousand dollars ($27,000) thirteen thousand
136	136	dollars ($13,000) shall be allocated to the City of Arab Boaz
137	137	for ambulance use so long as the ambulance service is provided
138	138	by the city.
139	139	f.e. Fifty thousand dollars ($50,000) shall be
140	140	allocated to Mountain Lakes Behavioral Health Care, for mental
141	141	health services, including substance abuse treatment and
142	142	prevention.
143	143	g.f. Eighteen thousand dollars ($18,000) shall be
144	144	allocated to the Marshall County Convention and Visitors
145	145	Bureau.
146	146	h.g. Twenty-five thousand dollars ($25,000) shall be
147	147	allocated to the Marshall County Coalition Against Domestic
148	148	Violence.
149	149	i.h. Twenty-five thousand dollars ($25,000) shall be
150	150	allocated to CASA of Marshall County, Inc., for services to
151	151	the aging and homebound.
152	152	j.i. Twenty-five thousand dollars ($25,000) shall be
153	153	allocated to the Marshall County RSVP.

184	184	j. Twenty-five thousand dollars ($25,000) shall be
185	185	allocated to Snead State Community College.
186	186	(4) All remaining amounts after the preceding
187	187	allocations shall be paid to the county governing body to be
188	188	distributed to the county and municipalities as provided by
189	189	law."
190	190	Section 2. This act shall become effective on June 1,
191	191	2025.
