1717 SYNOPSIS:
1818 Under existing law, a person commits the crime
1919 of resisting arrest if the person intentionally
2020 prevents or attempts to prevent a peace officer from
2121 arresting the person or another person.
2222 This bill would provide that a person who
2323 resists arrest shall be held in custody for 24 hours
2424 before becoming eligible for release.

2828 Relating to crimes and offenses; to amend Section
2929 13A-10-41, Code of Alabama 1975, to provide for a mandatory
3030 temporary holding period for persons who resist arrest.
3131 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3232 Section 1. Section 13A-10-41, Code of Alabama 1975, is
3333 amended to read as follows:
3434 "ยง13A-10-41
3535 (a) A person commits the crime of resisting arrest if
3636 he or she intentionally prevents or attempts to prevent a
3737 peace officer from affecting a lawful arrest of himself ,
3838 herself, or of another person.
